HomeMy WebLinkAbout19-047CITY OF LAKEVILLE RESOLUTION NO. 19-47 RESOLUTION ADOPTING ASSESSMENTS FOR HAMBURG AVENUE IMPROVEMENTS WHEREAS, pursuant to proper notice duly given as required by law, the Council has met, heard and passed upon all objections to the proposed assessment for City Project 19-05 along the segment of Hamburg Avenue between Lakeville Boulevard and County State Aid Highway (CSAH) 50 (202"d Street). NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakeville, Minnesota: 1. Such proposed assessments. copies of which are attached hereto and made a part hereof, are hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included in the hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Assessment No. 221378 shall be considered payable in equal annual principal installments over a period of ten (10) years the first of the installments to be payable on or before the first Monday in January 2020 and shall bear interest at the rate of 5.0% percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2020. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. Assessment No. 221379 shall be deferred without interest for a period of eight (8) years from the date of the adoption of this resolution. Upon termination of the deferment, the assessments shall be considered payable in equal annual principal installments over a period of ten (10) years and shall bear interest at the rate of 6.0% percent per annum. To the first installment shall be added interest on the entire assessment from the termination of the deferment until December 31, 2028. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 4. Assessment No. 221379 shall be deferred without interest for services installed for all future potential lots that would be created with the development of PID 22-02800-04-010 and PID 22-02800-04-020. In this case, "development" shall mean the City approval of a plat or subdivision, the issuance of building permits or combination under common ownership with another abutting parcel resulting in the creation of additional units requiring services. 5. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City of Lakeville, except that no interest shall be charged if the entire assessment is paid on or before November 15, 2019. The first-year installment payments will include interest accrued from November 16, 2019 — December 31, 2020. The property owner may at any time thereafter, pay to the City of Lakeville the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. 6. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes. ADOPTED by the Lakeville City Council this 15 I day of April 2019. Douglas P.
