The pledge of allegiance to the flag was given. 2. Swearing in of new Planning Commission Member Jenna Majorowicz The Recording Secretary, Penny Brevig swore in Jenna Majorowicz at tonight’s meeting. Members Present: Chair Pat Kaluza, Karl Drotning, Scott Einck, Jenna Majorowicz, Jason Kelvie, Paul Reuvers, Ex-officio Mike Lamm Members Absent: Jeff Witte, Jason Swenson, Brooks Lillehei Others Present: Daryl Morey, Planning Director; Joe Powers, Project Engineer; Penny Brevig, Recording Secretary 3. Approval of the Meeting Minutes The March 21, 2019 Planning Commission meeting minutes were approved as presented. 4. Announcements Mr. Morey stated that amended wording for Stipulation #5 from the March 27, 2019 engineering report was distributed at tonight’s meeting. Mr. Morey welcomed Commissioner Majorowicz to the Planning Commission. 5. Casey’s Retail Company (Tabled at the March 21, 2019 Planning Commission meeting) Chair Kaluza continued the hearing to consider the applications of Casey’s Retail Company for the following, located at 17150 Kenyon Avenue: A. Conditional use permit to allow motor vehicle fuel sales with a convenience store in the C-3, General Commercial District; and B. Vacation of public road right-of-way. Jared Sargent from Casey’s Retail Company presented an overview of their request. He introduced Andy Berg, their project engineer from Kimley-Horn, who was also present at tonight’s meeting. Mr. Sargent stated that Casey’s is based in Iowa, is the fifth largest pizza company in the country, and historically they have built in towns of less than 5,000 people. Today they have shifted their focus and are excited about serving larger markets, such as Lakeville. They are looking forward to serving the citizens of Lakeville and building their brand in the metro area. Planning Commission Meeting Minutes, April 4, 2019 Page 2 Planning Director Daryl Morey presented the planning report. Mr. Morey stated that this application includes a vacation of public road right-of-way and a conditional use permit (CUP) for a convenience store with motor vehicle fuel sales. The property is zoned PUD, Planned Unit Development District and is part of the Kenwood Place plat approved in 2016. The proposed convenience store with motor vehicle fuel sales is an allowed use of this property subject to the approval of a CUP under the performance standards of the C-3, General Commercial District, which is the underlying zoning of this property. Mr. Morey indicated that the proposed building and parking lot meet the required setbacks in the C-3 District. The site is accessed from a single driveway off of Kenyon Avenue on the west side of the property. Mr. Morey reviewed the pertinent Zoning Ordinance criteria for the approval of a CUP in the C-3 District, which are listed in detail in the March 28, 2019 planning report. At staff’s request, a traffic signal analysis was completed by the applicant, which determined that one or more signal warrants will likely be met for the intersection of Kenyon Avenue and Kenwood Trail (CSAH 5) after Casey’s opens. Staff recommends revised wording to Stipulation #5 from the March 27, 2019 engineering report as follows: 5. The applicant shall execute a Public Improvement and Assessment Agreement for $45,000 for the construction of a new traffic signal at the intersection of Kenyon Avenue and Kenwood Trail (CSAH 5). Mr. Morey stated that the hours of operation are not restricted in the C-3 District unless the City Council decides to restrict the hours. The exterior elevation was shown with the earth tone requirement. Mr. Morey stated that the ACM (aluminum composite) panel on the front elevation with Casey’s name on it is not allowed in the C-3 District and must be replaced with a Grade A, B, C, or D material in compliance with Zoning Ordinance requirements. The lighting on the site will primarily be the glow from underneath the canopy. A revised photometric plan that was submitted by the applicant does meet Zoning Ordinance requirements. The project landscaping is focused on the perimeter of the site and consists of deciduous and evergreen trees and shrubs in compliance with Zoning Ordinance requirements. An estimate must be provided for the cost of installing the landscaping. A financial security will be required for this amount prior to a building permit being issued to guarantee installation of the landscaping. Planning Commission Meeting Minutes, April 4, 2019 Page 3 Mr. Morey indicated that there will be no signage on the canopy. An advertising monument sign with electronic fuel pricing will be installed near the northeast corner of the site that meets the Zoning Ordinance requirements. Mr. Morey stated that City staff recommends approval of the vacation of public road right-of-way and a CUP for Casey’s Retail Stores, subject to the 14 stipulations listed in the March 28, 2019 planning report, and adoption of the Findings of Fact dated April 4, 2019. Chair Kaluza opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Kelvie, seconded by Drotning to close the public hearing at 6:15 p.m. Voice vote was taken on the motion. Ayes - unanimous Chair Kaluza asked for comments from the Planning Commission. Discussion points included: • Commissioner Drotning asked Mr. Sargent to elaborate on the sidewalk barrier curb and bollards at the front of the building, if there would be any outside sales, and if so, the location of any outside sales. • Mr. Sargent stated that there is raised curb everywhere except at the front of the store where they are using bollards with a flush curb. The only thing that would be outside sales would be refillable propane tanks to be located at the front of the building. • Commissioner Drotning encouraged Casey’s to consider their outside sales and include any outside sales on the site plan prior to consideration of the CUP by the City Council. • Chair Kaluza asked about the timeline for the potential traffic signal at the intersection of Kenyon Avenue and Kenwood Trail (CSAH 5). Mr. Powers indicated that there is no set timeline. He speculated that it would likely be included in the next five-year Capital Improvement Plan. Motion was made by Drotning, seconded by Reuvers to recommend to City Council approval of the Casey’s Retail Company Conditional Use Permit to allow motor vehicle fuel sales with a convenience store in the C-3, General Commercial District, located at 17150 Kenyon Avenue, and a public road right-of-way vacation, subject to the following stipulations, and adoption of the Findings of Fact dated April 4, 2019. 1. The site shall comply with the stipulations listed in the engineering memo dated March 27, 2019. 2. A building permit is required prior to commencing any site improvements. 3. The site shall be developed in accordance with the approved plans and in compliance with Zoning Ordinance requirements. Planning Commission Meeting Minutes, April 4, 2019 Page 4 4. Landscaping shall be installed in accordance with the approved landscape plan. A financial security will be required prior to the issuance of a building permit to guarantee installation of the landscaping. The property owner shall be responsible for maintenance of all landscaping, including within the boulevard. 5. Site lighting shall be installed in accordance with the approved lighting plan and shall meet the requirements of the Zoning Ordinance at all times. 6. All signage on the property must meet the requirements of Section 11-23 of the Zoning Ordinance. A sign permit is required prior to the installation of any signs. 7. The fascia of the canopy shall not be illuminated. 8. No additional outdoor sales or services shall be allowed without approval of an amended conditional use permit. 9. Snow storage shall not occur within required parking spaces, vehicle driving lanes or on public property. 10. Pump islands must be elevated six inches above the traveled surface of the site. 11. A continuous and permanent concrete curb not less than six inches above grade or bollards a minimum of three feet in height shall separate internal sidewalks for pedestrian traffic from motor vehicle areas. 12. The convenience store shall comply with all Zoning ordinance requirements for motor fuel facilities. 13. The applicant shall dedicate additional drainage and utility easement over the vacated area of the right-of-way along Kenyon Avenue. 14. The tan ACM (aluminum composite) panel on the front elevation must be replaced with Grade A, B, C, or D material in compliance with Zoning Ordinance requirements. Ayes: Kelvie, Einck, Kaluza, Majorowicz, Reuvers, Drotning Nays: 0 7. Elections Motion was made by Kelvie, seconded by Drotning to nominate Commissioner Kaluza to the office of Chair and to nominate Commissioner Einck to the office of Vice Chair, effective April 18, 2019, and to close the nominations. Ayes: Einck, Kaluza, Majorowicz, Reuvers, Drotning, Kelvie Nays: 0 Chair Kaluza stated that he has enjoyed being the Planning Commission Chair and thanked the Planning Commissioners for re-electing him to another term.
