HomeMy WebLinkAbout0448 ORDINANCE NO. 4 4 8 CITY OF LAI~EVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING ORDINANCE NO. 167 BEING THE ZONING ORDINANCE OF THE CITY OF LAKEVILLE The City Council of the City of Lakeville :ordains. as follows: Section 1: That Ordinance No. 167 is hereby amended to rezone from R-2, Single Family Residential District to R-5, Single .and Two Family Medium Density Residential District the following described land located within the City of Lakeville, Minnesota: The east 122.27 feet of Lot A, Yung Addition, Dakota County, Minnesota, according to the :plat thereof on file. and of record, in the office. of the County Recorder, Dakota County, Minnesota. Also: That part of the SE 1/4 of the SE 1/4 of Section 29, Township 114, Range 20, Dakota County, Minnesota, described. as follows: Commencing at the southeast-corner of said Section 29; thence North 0 degrees 04 minutes 17 seconds East, assumed bearing, on the east line. of the SE 1 j4 of said Section 547.62 feet to the former southerly right of way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad and the point of beginning; thence North 73 degrees 52 minutes 24 seconds West on the said former southerly right of way line 156.65 feet to the intersection with the southerly extension of the west line of the east 122.27 feet of said Lot A, Yung Addition; thence North 0 degrees 23 minutes 47 seconds West. on the said southerly extension 104.31 feet to the former northerly right of way line of..said railroad, said point begin on the southerly line. of said Lot. A, Yun Addition; thence South 73 degrees. 52 minutes 24 seconds East on the said former northerly right of way line and on the southerly point of said Lot A, Yung Addition; 157.54 feet to the east line of the SE 1 4 of said Section 29; thence South 0 degrees 04 minutes 17 seconds West on the said east line 104.Ob feet to the point of beginning. And that part of East Avenue: as dedicated in said plat of Yungg Addition, which.. lies southerly of the easterly extension of the southerly right of way line of 208th Street West as dedicated in said plat of Yung Addition. And the west 40.00 feet of .Lot 1, Block 3, Park Terrace 3rd Addition, according to said plat on file and of record in the. office of the County Recorder, Dakota County, Minnesota; And also that part of the North one-half of the vacated Chicago, Milwaukee, St. Paul and Pacific Railroad which lies East of the Southerly extension of the. West line of said Lot 1 and West. of a line distant 40.00 feet: East of and parallel to said southerly extension of the West line of Lot 1. Section 2. The zoning map of the-City of Lakeville shah not be republished to show the aforesaid zoning, but the clerk shall appropriately mark the zoning map on file in the Clerk's office. for the purpose. of indicating the rezoning hereinabove provided for in this Ordinance, and all of the notations, references`and other information shown thereon are hereby incorporated by reference and made a part of this Ordinance. Section 3. This Ordinance shall be in full force and effect from and after its publication according to law. Enacted and ordained into an Ordinance this 3rd day of September, 1991. Since the developer never recorded the plat, the rezoning does not take effect and the property remains zoned R-2. /dm (morey-larson)
