HomeMy WebLinkAbout79-046CITY OF LAKEVILLE RESOLUTION Date June 4, 1979 Resolution No. 79-46 Motion by Curry Seconded by Nelson RESOLUTION ESTABLISHING POLICY ON THE ASSESSMENT OF CITY WATER AND SEWER UTILITY CONNECTION CHARGES. WHEREAS, the City Council has set rates by the acre and unit on connections to the City water and sanitary sewer systems, and WHEREAS, these changes are necessary to help retire the debt on the bonds sold to finance the construction of the trunk sanitary sewer system and the trunk water system, towers, wells, pumps and booster stations, and WHEREAS, the number of connection units is measured by the equivalent to a single family dwelling unit in average daily usage, and WHEREAS, each facility or development is charged for the number of residential equivalent connections it requires, and WHEREAS, it may be advantageous to the City to allow the City connection charges to be assessed, with interest charged. NOW THEREFORE, BE IT RESOLVED that 1. The City Council may approve the assessment of City water and sanitary sewer connection charges when requested by legal petition of the property owner. 2. Assessments of 20 residential equivalent connections or less for water and sewer may be assessed for up to five years at the maximum legal rate of interest allowed by state law for City assessments on the unpaid principal. 3. Assessment of over 20 residential equivalent connections for water and sanitary sewer, may be assessed for up to ten years at the maximum legal rate of interest allowed by state law for City assessments on the unpaid principal. 4. All connection charges not approved for assessment by the City Council are due upon issuance of a building permit, or occupancy permit, or water and sewer tap connection permit, or increase in use above the residential equivalent connections previously paid for when notified by the City.
