Home My WebLink About78-090Date: November 20. 1978 Motion by RESOLUTION NO. 78-90 Zaun CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA Resolution No. 78-90 Seconded by Curry RECOMMENDATION ADOPTING EASEMENT ACQUISITION PROCEDURE WHEREAS, it is in the best interests of the City to adopt a standard procedure for acquiring easements, NOW THEREFORE, BE IT RESOLVED by the Lakeville City Council: 1. The City Administrator shall send a letter to the property owner explaining that the City intends to acquire an easement and that a condemnation suit will be commenced. 2. After the City Administrator has sent a letter to the pro- perty owner, the City Attorney shall promptly commence condemnation proceedings. 3. After the action has been commenced, the City Attorney shall make the owner an offer for the property. If the offer is refused, the condemnation proceedings shall be carried out. 4. Upon the request of the City Administrator or the City Attorney, the procedure set forth in the Resoltuion may be altered by the City Council. Adopted this 20th day of ATTEST: Patrick E.
