RESOLUTION ESTABLISHING TEMPORARY $100.00 SEWER CONNECTION
FEE ON THE SETTER TRIBUTARY TO THE APPLE VALLEY WASTE WATER
TREATMENT PLANT
WHEREAS, the Cities of Apple Valley and Lakeville share the use of
the Apple Valley waste water treatment plant; and
WHEREAS, Apple Valley WWTP has had restrictions placed on it by the
Metropolitan Waste Control Commission and Minnesota Pollution Control Agency
on the number of sewer connections since April, 1977; and
WHEREAS, after 1,100 sewer connections have been used by the two Cities,
a diversion of existing sewer connections is necessary to allow further connec-
tions in the two Cities; and
WHEREAS, the City of Apple Valley has initiated sanitary sewer diver-
sion project to divert the 850 residential equivalent connections to the Seneca
WWTP; and
WHEREAS, the benefit received from the additional capacity the diver-
sion will provide is available to both the Cities of Apple Valley and Lakeville;
and
WHEREAS, the City Council of the City of Lakeville believes the bene-
fit received in connecting to the sewer system is the responsibility of the party
making the connection.
NOW, THEREFORE, BE IT RESOLVED that:
1. The City of Lakeville shall charge a $100.00 sewer connection
fee on any connections on that part of the sewer system in
Lakeville that is tributary to the Apple Valley Waste Water
Treatment Plant after the 1,100 connections are issued.
2. That the $100.00 connection fee is in addition to the normal
City of Lakeville sewer connection charge as established by
Resolution #77-48.
3. That the $100.00 fee shall be collected on the issuance of the
sewer permit and remitted to the City of Apple Valley on a month-
ly basis until said connection fees received by the Cities of
Apple Valley and Lakeville are equal to the total cost of the
Apple Valley sewer diversion project, or the date that the new
Empire Waste Water Treatment plant..serving said Cities is in
operation, whichever occurs first.
ADOPTED by the City Council of the City of Lakeville this 5th day
of July, 1978.
