HomeMy WebLinkAbout78-006CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLUTION Date: 16 January, 1978 Resolution No. 78-6 Motion by Curry Seconded by Zaun RESOLUTION ENCOURAGING MINNESOTA LEGISLATORS TO AMEND MINNESOTA STATUTES 272.02 Subd. 1(15) AND AUTHORIZE TAXATION OF COMMERCIAL SOLID - LANDFILLS OR PROVIDE ALTERNATIVE REMEDIES WHEREAS, the City of Lakeville is located'in the County of Dakota, and WHEREAS, solid waste landfills are located in the County of Dakota, and WHEREAS, landfills are exepgpt.£rpm real estate taxation pursuant to Minnesota Statutes 272.02, Subd. 1(15), and WHEREAS, the ]%ipn*-%sotarTax Court has ruled on the matter excluding landfills frowrs$: estate tabes bwle"pber 10, 1976, and WHEREAS, Minnesota Statutes, Chapter 473, restricts licensing of landfills to counties-, and WHEREAS, municipal govern *vbuld+have increased costs of service as a result of sujh:an operation, some of which includes, but are not limited to: + y a. Increased police;'costs to protect against vandalism, traffic hazards, a=#'deni investigations and reporting and patrolling to ensure haufirs': use only approved haul routes. b. Costs of pickup of spilled trash along the right-of-way. c. Cost of fire protection related services, not covered by the contract for such services involving periodic inspections and "hot loads" of trash carriers. d. Exceptional City street mAintenance costs of the City street leading to the landfill. e. Answering complaints and referring complaints to designated governmental units charged with specific areas of landfill regulation. AP f. Providing emergency rescue service to employees or others who may suffer injuries at the site. g. Working with those units of governments charged with the enforce- ment of operating regulations of the landfill, and WHEREAS, the landfill results in other non-measurable expenses to the City in terms of its affect on the surrounding environment and the image it gives the City, and WHEREAS, the real estate tax remains the single largest source of operating revenue for the City. NOW THEREFORE, BE IT RESOLVED by the Lakeville City Council: That the State Legislature of the State of Minnesota is hereby encouraged to correct this gross inequity by (1) amending Minnesota Stautes 272.02, Subd. 1(15) to provide for normal real estate taxation upon commercial solid waste landfills in the Metropolitan area or (2) allowing cities to levy charges in lieu of taxes against landfills, and BE IT FURTHER RESOLVED: That this Resolution be forwarded to all Dakota County Legislators, Dakota County Commissioners, Mayors and Councils of the Cities of Dakota County, Metropolitan Council, Minnesota Pollution Control Agency, Minnesota Commissioner of Revenue and the Governor of the State of Minnesota.
