WHEREAS, the'City of Lakeville has provided street lighting in various
areas of the City in past years, and
WHEREAS., -,the growth of+the City and increase in the cost to the City
for electrical ener,&y'aU,-maintvnance of the street lights is accelerating each
year, and
WHEREAS, the street light system serves developed areas of the City
at a higher level of intensity, and
WHEREAS, a more equitable policy of providing street lighting, assess-
ing installation costs and allocating energy and maintenance costs to the most
benefitted areas is deemed necessary by the City Council.
NOW THEREFORE BE IT RESOLVED that the following policies and charges
be established for the City of Lakeville:
1. Any new residential, commercial or industrial development shall,
at Council discretion, have a street lighting plan prepared by
the developer submitted as a part of the development plans, and
said plan must be approved by the City Council with costs of the
approved installation paid by the developer.
2. Any area of the City already developed, but without a street
lighting plan may have street lights installed if a substanial
number of property owners petition for street lighting improve-
ments or if the City Council finds that improved street lighting
is necessary for the public health, safety and welfare, with the
cost of installation assessed or billed to the benefitted property.
3. In areasof the City that have street lighting on public right-
of-ways in accordance with an approved plan for the area, a
charge to the benefitted property shall be made on a quarterly
utility bill.
4. In commercial and industrial areas the costs of installing street
lighting in accordance with a plan approved by the City Council
shall be paid by the developer in new areas, and assessed or
billed to the benefitted property by the City in existing areas.
5. In commercial and industrial areas with street lighting on pub-
lic right-of-ways in accordance with an approved plan the bene-
fitted property shall be charged on a quarterly utility bill.
6. On any public right-of-way deemed by the City Council to require
a higher intensity of street lighting to protect the public
health, safety and welfare of the City of Lakeville, the month-
ly energy and maintenance cost for lighting fixtures above 175
watts shall be paid out of the General Fund of the City.
7. In areas of the City when the City Council deems it necessary
to install a street light to protect the public health, safety
and welfare at a street intersection or along a State of County
highway, the monthly energy and maintenance cost shall be paid
by the City from the General Fund.
8. Only energy efficient high pressure sodium street lights shall
be installed.
9. The lighting standard in residential areas may range from 100
watt H.P.S. to 175 watt H.P.S. and be spaced from 300 to 500
feet apart. The wattage and spacing in commercial and indus-
trial areas shall be reviewed by the City Council for each
area in determining the intensity of wattage and spacing of
the street lights.
10. The energy and maintenance charge is to be initiated on the
April 1978 utility bill.
11. Citizens who are receiving social security retirement benefits
or disability benefits shall be exempt from energy and main-
tenance charges provided they have signed an affidavit swear-
ing to the receipt of said benefits with the City Clerk.
