HomeMy WebLinkAbout77-71CITY OF LAKEVILLE RESOLUTION Date: 7 November, 1977 Resolution No. 77-71 Motion by Emond Seconded by Zaun REGULATING THE DEVELOPMENT AND ISSUANCE OF BUILDING PERMITS IN THE CITY WHEREAS, the City of Lakeville is concerned with the potential pollu- tion of its water resources and soils; and WHEREAS, the Twin Cities Metropolitan Council has urged the City to adopt an urban/rural service area plan and appropriately regulate development in each district; and WHEREAS, the City's professional planning consultant, Midwest Planning and Research, Inc., has prepared a report on an urban/rural concept plan and a community profile and addendum report for the City, copies of which are attach- ed and incorporated heiein; and{° WHEREAS, the City has adopted an interim urban/rural service area con- cept ipap, a copy of which is attachi'd hereto afid_incorporated herein; and WHEREAS, on the'bosis of Profesawional information and advice provided to the City, it has bean determfned,that adequate land is available for develop - meat within the short range growth stage delineated on said map; and WHEREAS, the :City has -made subst ntial public service improvement investments capable of accommodating all anticipated urban developmentsfor a h period in excess of ten years. NOW THEREFORE, BE IT RESQfVID by the City Council of the City of Lakeville that: 1. The following regulations shall govern development in the mid- range and long-range growth stages as identified on the attached map. A. There shall be no building permits issued for any new construc- tion unless the development is located on a minimum of ten acres per principal use. Additionally, the area per develop- ment shall be increased two point five acres per principal use for each unit of sewage volume YQ*.d one unit. An ex- ception shall exist for residential dwellings to be logatod _ on a lot platted or parcel divided by contract on or before October 4, 1976. B. An appeal may be filed according to the provisions of the zoning ordinance for a reduction in the minimum area for development as stipulated in the preceding clause. In such cases it is the responsibility of the applicant to demonstrate that the proposed development is located within an area with specialized characteristics or is a unique type of operation which justifies an area reduction as it will cause pollution and/or increase City service demands and expenses. In no case shall the lot size be less than what is stipulated by the Lakeville Zoning Ordinance. C. There shall be no building permits issued for the expan- sion of existing development unless it is thoroughly demonstrated and documented by the applicant that such expansion can be adequately handled by the existing private sewer and water system and does not create a demand for additional public services. D. Remodeling of existing development or changes in use as per zoning ordinance provisions shall be permitted if it does not constitute expansion of use and increased sewer discharge. 2. The following regulations shall govern non-sewered development in the short-range growth stage as identified on the attached map. A. Development shall comply to the provisions of 1 A of this resolution unless it can be demonstrated and reasonably projected that public sewer and water will be provided and available within five years of anticipated construc- tion. Where such service can be anticipated the applic- able provisions of the zoning ordinance shall apply. B. An appeal may be filed according to the provisions of the zoning ordinance for a reduction in the minimum area for development as stipulated in the preceding clause. In such cases it is the responsibility of the applicant to demonstrate that the proposed development is located with- in an area with specialized characteristics or is a unique type of operation which justifies an area reduction as it will not cause pollution and/or increase City service de- mands and expenses. In no case shall the lot size be less than what is stipulated by the Lakeville Zoning Or- dinance. 3. The following regulations shall govern development in all por- tions of the City: A. In all cases of development, the City's sewer connection charge shall be paid at time of application for building permit. ADOPTED by the Lakeville City Council this 7th day of November , 1977.
