HomeMy WebLinkAbout77-23RESOLUTION Date: April 18, 1977 Resolution No. 77 - 23 Motion by: Curry Seconded by: Emond RESOLUTION OF POLICY ON EXTENSIONS AND CONNECTION TO THE SANITARY SEWER SYSTEM TRIBUTARY TO THE LAKEVILLE WASTE WATER TREATMENT PLANT WHEREAS, the Federal Government through its Environmental Protection Agency (EPA) establishes effluent standards for discharges of waste water into public waters, and WHEREAS, the Minnesota Pollution Control Agency (MPCA) is charged with the enforcement of such standards within the State of Minnesota, and WHEREAS, the Metropolitan Waste Control Commission (MWCC) operates the Lakeville Waste Water Treatment Plant which discharges into public waters and into which flows waste water from the City of Lakeville, Dakota County, Minnesota, and WHEREAS, the MWCC operates said Lakeville plant under NPDES Permit issued by the the MPCA in cooperation with EPA, and WHEREAS, the MWCC has advised the City of Lakeville that a maximum number of 200 residential equivalent connections (REC) remain before said Lakeville plant reaches its capacity, and WHEREAS, the MWCC has further advised the City of Lakeville that a new plant known as the Empire plant is presently under construction, to be com- pleted on or before May 30, 1979, which plant will replace the said Lakeville Waste Treatment Plant and solve the problem with respect to the available hook-ups, and WHEREAS, the MPCA and MWCC have advised the City of Lakeville that unless the City agrees to limit additional connections through May 30, 1979, to a maximum of 200 REC; that they will not approve further lateral extension of the sanitary sewer system in Lakeville, and WHEREAS, it is the desire of the City of Lakeville to cooperate whith the above agencies with respect to the above described problem. NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Lakeville as follows: 1. That from the date of April 1, 1977 until May 30, 1979, the City will not allow more than a total of 200 REC to the sanitary sewer system within the City Tributaries to the Lakeville Waste Treatment Plant. 2. That the above maximum shall not apply if during said period other reasonable alternatives, acceptable to the above named agencies, can be devised. 3. That said 200 REC's shall be available in the City on a first come, first served basis, that receipt of a building permit fee by the City (including the MWCC's SAC charge) or the issuance by the City of a connection permit (for lots that on the date hereof are served by a private septic system) shall constitute usage of a part of the available 200 REC's. One (1) REC shall be understood as being equivalent to one (1) SAC unit as a SAC unit is defined by the MWCC. The City shall forward to the MWCC monthly a copy of its monthly SAC report, showing the number of REC on the sanitary sewer systems in Lakeville that are tributary to the Lakeville, Apple Valley,and Burnsville waste water treatment plants.
