HomeMy WebLinkAbout77-19RESOLUTION Date: 21 March, 1977 _Lakeville Resolution_No. 77-19 Date: 24 March, 1977 Apple Valley Resolution No. 77 -58 - JOINT RESOLUTION CITIES OF APPLE VALLEY AND LAKEVILLE WHEREAS, the Federal Government through its Environmental Protection Agency (EPA) establishes effluent standards for discharges of waste water into public waters, and WHEREAS, the Minnesota Pollution Control Agency (MPCA) is charged with the enforcement of such standards within the State of Minnesota, and WHEREAS, the Metropolitan Waste Control Commission (MWCC) operates the Apple Valley Waste Water Treatment Plant which discharges into public waters and into which flows waste waters from the Cities of Apple Valley and Lakeville, Dakota County, Minnesota, and WHEREAS, the MWCC operates said Apple Valley plant under NPDES Permit Number MN0022641 issued by the MPCA in cooperation with EPA, and WHEREAS, the MWCC has advised the Cities of Apple Valley and Lake- ville that a maximum number of 1,100 residential equivalent connections (REC) remain before said Apple Valley plant reaches its capacity, and WHEREAS, the MWCC has further advised the Cities of Apple Valley and Lakeville that a new plant known as the Empire plant is presently under construction, to be completed on or before May 30, 1979, which plant will replace the said Apple Valley Waste Treatment Plant and solve the problem with respect to the available hook-ups, and WHEREAS, the 14PCA and MWCC have advised the Cities of Apple Valley and Lakeville that unless they jointly agree to limit additional connections through May 30, 1979, to a maximum of 1,100 REC; that they will not approve further lateral extension of the sanitary sewer systems in Apple Valley and Lakeville, and WHEREAS, it is the mutual desire of the Cities of Apple Valley and Lakeville to cooperate with the above agencies and between themselves with respect to the above described problem. i NOW THEREFORE, BE IT RESOLVED, jointly and severally by the City Councils -of the Cities of Apple Valley and 'Lakeville as follows: 1. That from the date hereof until May 30,1979, they will not allow more than a total of 1,100.REC to the sanitary sewer system within the two communities, flowing into the Apple Valley Waste -Treatment Plant. 2. That the above maximum shall not apply if, dniiagr said period _ other reasonable alternatives, acceptable to the.above named -agencies, can be devised. 3. That said 1,100 REC's shall be available to either City on a first come, first served basis, that receipt of a building permit fee by either City (including the MWCC's SAC charge) or the issuance by either City of a connection permit (for lots that on the date hereof are served by a private septic system) shall constitute usage of a part of the avail- able 1,100 REC's. One (1) REC shall be understood as being equivalent to one (1) SAC unit as a SAC unit is defined by the MWCC. Each City shall forward to the other monthly a copy of its monthly SAC report, as submitted to the MWCC, and the total SAC units reported thereon shall constitute a p art of tber_- 1,100 .available REC's. 4. This Resolution shall become effective only if adopted by both the City Councils of Apple Valley and Lakeville. ADOPTED by the City Council of Apple Valley this 24th day of March , 1977.
