HomeMy WebLinkAbout77-060 RESOLUTION NO. 77-6 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLUTION APPROVING SET BACK AND LOT AREA VARIANCES FOR AN APARTMENT COMPLEX IN THE CITY OF LAKEVILLE WHEREAS, Mr. Brad Johnson is the owner of two apartment buildings located at Lots 7, 8 and 9, Block 1, Fairfield Addition; and WHEREAS, Mr. Johnson has petitioned the City for permission to construct an additional ten unit apartment building on the site; and WHEREAS, said petition reveals that the set back for the proposed apartment building is ten feet and the City's Zoning Ordinance requires a thirty foot set back unless a variance is granted; and WHEREAS, said petition further indicates that the lot size requirement is 2,300 square feet less than that required by the Zoning Ordinance unless a variance is granted; and WHEREAS, Mr. Johnson has requested the City to grant the necessary lot size and set back variances; and WHEREAS, there is a twenty foot drainage easement contiguous to the proposed apartment building which coupled with the ten foot set back available on the petitioner's property would satisfy the set back requirement; and WHEREAS, the addition of the third apartment building and the increase in the size of the property dedicated to the apartment complex would greatly reduce the overall deviation from the zoning ordinance's lot size requirement; and WHEREAS, strict compliance with the requirements of the zoning ordinance would create practical difficulties and unnecessary hardships due to the characteristics of the property. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Lakeville: 1. A rear set back variance allowing a ten foot rear yard set back is hereby granted for the aforementioned property. 2. A 2,300 square foot lot size variance permitting the construction of an additional ten unit apartment building is hereby approved. Dated February 7 , 1977.
