RESOLUTION NO. 76-49
CITY OF LAKEVILLE
DAKOTA COUNTY, MINNESOTA
A RESOLUTION IMPOSING A LIMITED MORATORIUM ON
DEVELOPMENT IN THE CITY.
WHEREAS, an updating and comprehensive review is
needed of the City's Comprehensive Plan, Zoning Ordinance
and Subdivision Ordinance; and
WHEREAS, the City's professional planning
consultant, Midwest Planning and Research, has previously
been directed to begin a study leading to the updating and
revision of the City's Comprehensive Plan, Zoning Ordinance and
Subdivision Ordinance; and
WHEREAS, the completion of said studies has been delayed
by recently enacted metropolitan planning legislation; and
WHEREAS, the development goals of said plans and
Ordinances are in danger of being jeopardized by new development
occurring before the completion of the updated Comprehensive
Plan and Ordinances; and
WHEREAS, Midwest Planning and Research has informed
the City that it will take approximately one year for said plans
to be finalized and put into effect; and
WHEREAS, the Metropolitan Council has urged the City
to adopt an urban/rural service area concept plan; and
WHEREAS, Midwest Planning and Research, has
prepared a report on an urban/rural concept plan for the City,
a copy of which is attached and incorporated herein; and
WHEREAS, the City has adopted an interim urban/rural
area concept map, a copy of which is attached hereto and
incorporated herein; and
WHEREAS, the City presently has adequate land
available for development within the short range growth stage
delienated on said map; and
WHEREAS, the Metropolitan Waste Control Commission
and the Minnesota Pollution Control Agency have informed the
City that the sewage treatment plants have reached their
capacity and have warned the City that they may not approve
extensions of the City's sewer lines until a new plant is
constructed; and
WHEREAS, as a result of the foregoing consideration
the Lakeville Planning Commission has urged the City Council
to adopt the moratorium set forth herein; and
WHEREAS, Midwest Planning and Research concurs in the
Planning Commission's recommendation.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF LAKEVILLE that from this date until October 1, 1977:
1. There shall be no building permits issued for new commer-
cial and industrial construction in the mid-range or long-range growth
stages, delineated on the attached map, and there shall be no building
permits issued for expansion of existing commercial or industrial
buildings unless it can be adequately handled by an existing private
sewer and water system and does not create a demand for additional
public services.
2. The City shall not issue building permits for residential
dwellings in either the mid-range or long-range growth stages, de-
lineated on the attached map, unless the dwelling is located on a
lot platted,•or parcel divided by contract, on or before the date
of this Resolution, or is located on a lot of ten acres or more,
other than permits to repair or alter presently existing dwelling
units.

3. The City shall not approve plats in the mid-range or long-ran€;e
growth stages, delineated on the attached map, with less than ten
acre size lots.
