REJECTION OF BIDS FOR THE INSTALLATION OF AMERICANS WITH DISABILITIES
ACT (ADA) COMPLIANT AUTOMATIC SWING DOOR OPERATORS
Proposed Action
Staff recommends adoption of the following motion: Move to reject bids for the installation of
ADA compliant automatic swing door operators.
Overview
The City solicited sealed bids for this project on April 5, 2019 and opened received bids on April
25, 2019. One contractor, Roy C., Inc, responded to the request for bids in the amount of
$10,985.00 for installations at the Central Maintenance and Water Treatment Facilities. That bid
response met the specifications for type and style of automatic door opener.
Funding was planned through Community Development Block Grant (CDBG) funds
administered by the Dakota County Community Development Agency. Installation included
surface mounted door openers with wireless activators. Sealed bids were required by the CDBG
procurement requirements. The contractor was required to comply with prevailing wage
requirements under the Davis-Bacon Act.
After reviewing the Davis-Bacon Act and prevailing wage requirements, the contractor revised
his original bid, which resulted in a material change in the bid that the City is not able to waive
by law. Therefore, the City is required to reject the bids. This project is being rebid with a
planned completion in June 2019.
Primary Issues to Consider
• Why did only one contractor respond? One contractor declined to bid because they would
have to subcontract the work. Another contractor did not return a bid.
