CITY COUNCIL MEETING MINUTES
May 20, 2019
Mayor Anderson called the meeting to order at 7:00 p.m. in the Council Chambers at City
Hall. After a moment of silence, the Pledge of Allegiance to the flag was given.

Motion was made by Hellier, seconded by Wheeler, to approve the following:
a. Check register review
b. Minutes of the May 6, 2019 City Council meeting
c. Mixed municipal solid waste and recyclable material collector license (Class B) to Nitti
Sanitation, Inc.
d. Agreement with St. Croix Recreation Company, Inc. for Cherryview Park playground
equipment
e. Agreement with Landscape Structures, Inc. for Dodd Pointe Park playground
equipment
f. Findings of fact and amendment to Conditional Use Permit 89-02 for Dakota Pet
Hospital, 20136 Icenic Trail
g. Resolution No. 19-57 establishing a no parking zone on both sides of Kenrick Court east
and west of Kenrick Avenue
h. Proposal for professional services from Bolton & Menk, Inc. for Dodd Boulevard and
Flagstaff Avenue intersection improvements, Project 18-05

Roll call was taken on the motion. Ayes – Volk, Anderson, Wheeler, Hellier, Lee
7. Pinnacle Reserve at Avonlea
Mike Suel of D.R. Horton requested Council approval of the Pinnacle Reserve at Avonlea
preliminary plat. The preliminary plat consists of three different housing products with a
variety of lot sizes.
Mr. Morey presented the staff report for Pinnacle Reserve at Avonlea consisting of 268
single family lots and 11 outlots on 139 acres located east of Highview Avenue and south
of Dodd Boulevard. The proposed number of lots is four less than approved with the
Avonlea Illustrative Master Plan. The plat is proposed to be developed in three phases,
and the developer will incorporate each housing style within each phase. The
architectural design standards were carried over from the Avonlea PUD to this
development for consistency in home quality and appearance.
Mr. Morey stated D.R. Horton will be responsible for constructing 185th Street between
Hamburg Avenue and Highview Avenue with this plat. He explained that the south half of
the west one-quarter mile segment of 185th Street abuts property that is not within the
Avonlea Planned Unit Development (PUD). City staff will work with that property owner to
obtain the necessary right-of-way to allow the construction of 185th Street to Highview
Avenue.
Motion was made by Wheeler, seconded by Hellier, to approve Resolution No. 19-59
approving the preliminary plat and development stage Planned Unit Development plans
for Pinnacle Reserve at Avonlea.

8. Jobi Properties
Joe Pannkuk and Bill Boldenow requested Council approval of an ordinance amendment
concerning commercial dog kennels and a conditional use permit to allow a commercial
dog kennel at 16320 Kenrick Loop.
Mr. Morey presented the proposed ordinance, which would allow the keeping of more
than 20 dogs in both day care and overnight kenneling in the C-2, C-3, O-P, I-1 and I-2
zoning districts. The ordinance eliminates the requirement for a City animal kennel license
and allows a fenced outdoor exercise area that is set back at least 500 feet from any
residential district. The ordinance allows for sick or injured animals to be separated from
healthy animals, and it requires the disposal of animal waste down an existing sanitary

sewer system or picked up by a waste disposal company a minimum of two times per
week.
Mr. Morey stated the Planning Commission reviewed the proposed ordinance, along with
a conditional use permit to allow a commercial dog kennel at 16320 Kenrick Loop. The
proposed conditional use permit and site plan comply with the proposed ordinance.
The mayor and council members asked several questions related to hours of operation,
maximum occupancy of the facility, noise from the outdoor exercise area, traffic
congestion on Kenrick Avenue and training criteria for facility personnel. Mr. Morey and
the applicants addressed all questions and concerns.
Motion was made by Hellier, seconded by Lee, to adopt Ordinance No. 1010 amending
Titles 5 and 11 of the City Code, summary ordinance for publication, findings of fact and a
conditional use permit to allow a commercial dog kennel at 16320 Kenrick Loop.
Roll call was taken on the motion. Ayes – Wheeler, Hellier, Lee, Volk, Anderson

Council Member Volk suggested discussion at a future council work session regarding
panhandlers. She also asked that copies of meeting minutes from external committees be
uploaded in the council’s Dropbox.
