KINGSLEY PLACE EASEMENT VACATION
Proposed Action
Staff recommends adoption of the following motion: Move to approve: 1) a resolution vacating a
public drainage and utility easement, 2) an amended and restated site improvement performance
agreement, and 3) a stormwater maintenance agreement, as presented.
Overview
Charthouse Senior Living, LLC has submitted revised plans for Kingsley Place, a 55-unit, four-
story senior independent living facility with a wellness center and underground parking that was
proposed by Steven Schoeben and approved by the City Council on February 6, 2017.
Charthouse Senior Living, LLC purchased the Kingsley Place project from Mr. Schoeben and is
the owner of the original Kingsley Shores Senior Living facility, which was approved in 2011 and
includes a total of 101 independent, assisted living, and memory care units. Kingsley Place is
located in the northwest corner of Kenwood Trail (CSAH 5) and Klamath Trail.
Since purchasing the Kingsley Place project, Charthouse Senior Living, LLC representatives have
modified the building and site plan and will include the Kingsley Place and Kingsley Shores
facilities under one ownership. As such, they are proposing to combine the Kingsley Place and
Kingsley Shores lots and vacate the boundary drainage and utility easement along the existing
shared lot line. The two buildings will be connected by a second story skyway and through their
underground parking garages. The proposed lot combination and site plan revisions require an
amendment to the Site Improvement Performance Agreement (SIPA) approved in 2017 and
approval of a Stormwater Maintenance Agreement (SMA).

Primary Issue to Consider
• What changes are proposed to the Kingsley Place site plan that was approved in 2017?
• The footprint of the proposed Kingsley Place building is slightly larger and shifted closer
to the existing Kingsley Shores building than what was approved in 2017. The number of
proposed dwelling units (55) will remain the same.
• The Kingsley Place and Kingsley Shores underground parking garages will be connected,
resulting in five fewer underground parking spaces and two more surface parking spaces
for Kingsley Place. Combined, the underground and surface parking for the Kingsley
Shores and Kingsley Place facilities will meet Zoning Ordinance requirements.
The proposed site and building changes can be handled administratively through the
amended and restated SIPA because they are consistent with the approved Kingsley Shores
Senior Living PUD and Shoreland Overlay District requirements.

RESOLUTION VACATING A PUBLIC DRAINAGE AND UTILITY EASEMENT
WHEREAS, the City Council has conducted a public hearing, preceded by two (2)
weeks published notice, to consider the following described public drainage and utility
easement vacation, and
WHEREAS, the City Council has determined that it is in the public interest to approve
the public drainage and utility easement vacation.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The following public drainage and utility easement is hereby vacated:
(see attached Exhibit A)
2. The City Clerk is directed to file a certified copy of this resolution with the Dakota
County Recorder.

Easment Vacation Description:
All that part of the publicly dedicated drainage and utility easements lying
adjacent to the shared lot line between Lot 1 and Lot 2, Block 1, KINGSLEY
SHORES SENIOR LIVING, Dakota County, Minnesota lying north of the south
40.00 feet of said Block 1 and lying south of the southwesterly extension of the
southerly line of the 30 foot wide drainage and utility easement dedicated on
said Lot 1. The centerline of said 30.00 foot wide easement begins at a point
219.16 feet north of the southwest corner of said Lot 1 as measured along the
west line of said Lot 1 as shown on the plat of KINGSLEY SHORES SENIOR
LIVING.
