HomeMy WebLinkAbout0455 ORDINANCE NO. 455 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLE 7 OF THE LAREVILLE CITY CODE BY ADDING CHAPTER 12 PROVIDING WATER SIIRFACE MANAGEMENT STANDARDS FOR ORCHARD LAKE THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS: Section i. Title 7 of the Lakeville City Code is hereby amended-by adding Chapter 12 to read as follows: CHAPTER 12 ORCHARD LAKE WATER SIIRFACE MANAGEMENT Sec. 7-12-1: Title. This Chapter shall be known and cited as "Orchard Lake Water Surface Management." Sec.. 7-12-2: Purpose. The purpose of this Chapter is to enhance and preserve the recreational use, safety, and enjoyment of Orchard. Lake.. Sec. 7-12-3: Prohibition. No watercraft shall be utilized on Orchard .Lake .except. in compliance. with this Chapter. Sec. 7-12-4: Euemption. Authorized resource management, emergency, and enforcement personnel when .acting in the performance of their assigned duties shall be exempt from this Chapter. Sec. ?-12-5: Definitions: The following terms shall have the meanings given herein: Slow No-Wake: Operation of a watercraft at the slowest possible speed necessary to maintain steerage and in no case greater than five (5) miles per hour. Watercraft: Any contrivance used or designed for navigation on water, other than seaplanes. r12/D5/91 Sec. 7-12-6: 81ow No-Wake Zones. A. From shore to a distance of one hundred feet (100') from share shall be slow no-wake zone. B. No watercraft towing a person on water skis, aquaplane, or a similar device shall be operated at any timen a slow wake zone; provided, however, that any watercraft launching or landing a person on water skis, aquaplane, or similar device by the. most direct route to open water or shore shall be. exempt from these subsections. S®c. 7-12-7: Controls. These controls are in effect Memorial Day weekend through. Labor Day..weekend: A. The maximum speed limit in a speed zone shall be forty (40).miles per hour. B. All power boats, whether or not pulling water .skiers shall travel in a general'.counter-clockwise direction on Saturday and Sunday and legal holidays from Memorial Day weekend through .Labor Day, except that any watercraft launching or landing a person on skis or similar device may..do so by the most-direct route to open water. C. The maximum speed limit for watercraft one-half hour after sunset to 8:3Q a.m. shall be fifteen (15) miles per .hour.." D. No person shall use an untethered inflatable watertoy, air mattress, or innertube more than 100 feet (100') from shore. Sec. 7-12-8: Enforcement and Penalties.. A. Enforcement. The provisions of his Chapter `shall be enforced by officers of the Dakota County Sheriff's Water Patrol and Conservation Officers of the .Minnesota Department of .Natural... Resources, and by other .law enforcement officers. B. Penalties. .Violation of any provision of this Chapter shall be a misdemeanor. S®ction 2.
