DAKOTA COUNTY, MINNESOTA
AN ORDINANCE AMENDING TITLE 6 OF T8E
LAKEVILLE CITY CODE CONCERNING MOTOR
VEHICLES AND TRAFFIC
THE CITY COUNCIL OF THE .CITY OF LAKEVILLE ORDAINS:
Section 1. Title 6 of the Lakeville City Code is amended by
.adding Section 6-1-9 to read:
SSC. 6-1-9. TRAFFIC SIGNAL PREEMPTION SYSTEM.
6-1-9-1: Definitions:
As used in this section, the following terms shall have the
respective meanings .ascribed to them:
EMERGENCY VEHICLE: A vehicle equipped and identified
according to law and operated by the Lakeville Police. or
Fire Departments or any other vehicle so designated by
M.S.A. 169.01, Subd. 5.
FIRE CHIEF: The-Fire Chief of the City of Lakeville or the
Chief's designee.
CHIEF OF POLICE: The Police Chief of the City of Lakeville
or the Chief's designee.
PUBLIC WORKS DIRECTOR: The Public Works Director of the
City of Lakeville or the Director's designee.
TRAFFIC SIGNAL PREEMPTION SYSTEM (TSPS) (OPTI-COMM): A
traffic control system designed for use by emergency
vehicles to improve traffic movement by temporarily
controlling signalized intersections. The TSPS is comprised
of four (4 } separate components: an emitter, a detector, an
.indicator, and a phase selector. The emitter (a high
intensity light source) is attached to the emergency vehicle
and functions like. a strobe light, pulsating at a frequency
in excess of ten (10) "beats" per second. As an emergency
vehicle approaches the intersection, this pulsating light is
received by a detector that is located at or near the
traffic signal. The detector relays the coded. message to the
phase selector, located in the traffic control box,. which
then either holds the existing green light in favor of the
approaching emergency vehicle or accelerates the normal
cycle of a signal change to provide green by the time the

vehicle reaches the intersection. The indicator is a light
source located near the detector which is directed toward
the oncoming emergency vehicle to indicate to the driver
whether or. not the traffic light has been preempted in their
favor.
6-1-9-2: Purpose..:
The purposefor using the Traffic Signal Preemption System
(TSPS) in Lakeville is to allow emergency vehicles to perform
emergency services in a safer and more timely manner by tempo-
rarily controlling motorized vehicle traffic flow at signalized
intersections. The City Council deems it advisable to formulate
policies and procedures for the use of the TSPS emitters so that
both pedestrians and drivers of motorized vehicles have adequate..
warning that emergency vehicles are changing normal.traffic
control timing at signalized intersections.
6-1-9-3: Conditions for IIsinq the Traffic Signal. Preemption
system (TSPS).
A. FIRE DEPARTMENT. City owned Fire Department vehicles may use
the TSPS while on emergency response.. Unless otherwise
provided for herein, or as approved by the Fire Chief, all
other use by the department is prohibited. Conditions for the
use of TSPS hereby become a part of the Fire Department
standard operating procedures 2-2300.
B. POLICE DEPARTMENT. City owned Police Department vehicles may
use the TSPS while on emergency response. Unless otherwise-
provided for herein, or as approved by the Chief of Police,.
all other use by the department is prohibited. Conditions for
the use of TSPS hereby become apart of the Police Department
Policy .and Procedures 3-4800.
C. ALF AMBULANCE. ALF Ambulance may use the TSPS while on
emergency response.
D. MAINTENANCE PERSONNEL. City of Lakeville, Dakota County,
.State of Minnesota maintenance personnel, or their
contractors under written agreement, may activate the TSPS
only when testing or repairing the system. Sirens and
flashing red lights need not be used except. when the testing
vehicle must exceed the posted speed limits. If an emergency
vehicle is to be used for the test, the Chief of Police shall
be notified prior to the test activation.
E. EMERGENCY VEHICLES NOT OWNED OR OPERATED BY THE CITY. The
use of TSPS within the City by non-City emergency vehicles
may be authorized in writing by the Chief of .Police of the
City of Lakeville.

F. Unless specifically approved herein, it shall be unlawful for
any person to activate the TSPS in Lakeville by any means
whatsoever. The installation of TSPS emitters on any vehicle
not identified in subsections 6-1-9-3 (A) through (D) is
prohibited.
6-1-9-4. Violations.
Violation of this Chapter shall be a misdemeanor and shall
be punishable as set forth by City Code. Each violation of this
Chapter shall be considereda separate offense.
Section 2. Thin ordinance shall be effective immediately
upon.. its passage and publication.

The purpose for using the Traffic
Signal Preemption System (TSPS) in
Lakeville is to allow emergency vehicles
to perform emergency services in a safer

(1) Lowest classified rate paid by commercial
users for comparable space: 6.16 per
column inch.
(2) Maximum rate allowed by law for the
above matter: 5.14 per column inch.
(3) Rate actually charged for the above
matter: 5.14 per column inch.
