Section 9.5 of Ordinance No. 167 is amended in its entirety to read: Sec. 9.5. ER08ION AND DRAINAGE. I) No land shall be developed and no use shall be permitted that results in water runoff causing flooding, erosion, or deposit of sediment on adjacent properties. Such runoff shall be properly channeled into a storm drain, water course, pondinq area, or other public facilities subject to the review and approval.. of the City Engineer. 2} In the case of all single family lots, multple~family lots, business, industrial .and institutional developments, the drainage plans shall be submitted to the City Engineer for his review and the final drainage plan shall be subject to his written approval. No modification in grade and drainage flow through fill, cuts, erection of retaining walls, or other such actions shall be permitted until such plans have been .reviewed. and received written approval from the. City Engineer. 3) Unless approved by the. Building Official or City .Engineer, the top of the foundation and garage•"floor of all structures shall be at least eighteen (18) inches above the grade of 'the crown ,of the street. 4) Property and streets adjacent to the site of a land disturbance shall be protected from sediment deposition. This shall be accomplished by preserving a well-vegetated buffer strip around the lower perimeter of the land disturbance, by installing perimeter controls such as sediment barriers, filters, dikes, or sediment basins, by stockpiling soil in appropriate locations, or by a combination of such measures. 5) All storm sewer inlets which are functioning during construction shall be protected so that sediment laden water will. not enter the conveyance system without first being filtered or otherwise treated to remove sediment. r01/07/92 6) Property and waterways downstream from development sites shall be protected from flooding and erosion due to increases in the volume, velocity, and peak water flew rate of storm water runoff. Concentrated storm runoff water leaving a development's site must be discharged directly into swell-defined natural or manmade off-site receiving channel or pipe.- 7) All on-site storm water conveyance channels shall be designed and constructed to withstand the design volume of storm ` water with appropriate-stabilization to prevent scour and erosion. Erosion controls must be provided at the outlets of all storm sewer pipes. 8) A permanent vegetative cover shall be established on denuded. areas not otherwise permanently stabilized forthwith after land. disturbing activity is complete. 9) Whenever construction vehicles access public roads, provision shall be made to minimize the transport of sediment by runoff or vehicle tracking onto the paved surface.•Where sediment is transported onto a public road surface, the roads shall be cleaned thoroughly at the end of each day. Sediment shall be removed from roads by shoveling or sweeping. 10) All temporary and permanent erosion and sediment control practices shall be maintained and repaired to assure the continued. performance of their intended function.. 11) All temporary erosion and sediment. .control. measures shall be removed within thirty (30j days after final site stabilization is achieved or after the temporary measures are no longer needed. 12) The City's Building Official may issue stop work orders for any violation of this ordinance.
