1 City of Lakeville Planning Department Memorandum To: Planning Commission From: Frank Dempsey, AICP, Associate Planner Date: September 13, 2019 Subject: Packet Material for the September 19, 2019 Planning Commission Meeting Agenda Item: Consider the application of Airlake Development, Inc. and U-Haul of Southern Minnesota for the following: 1) Preliminary and final plat of Airlake Station First Addition 2) Conditional use permit to allow a building height greater than 35 feet in the C-2, Highway Commercial District 3) Interim use permit to allow outdoor display of trucks and trailers for rent as an accessory use in the C-2 District 4) Interim use permit to allow outdoor storage of recreational vehicles in the C-2 District. 5) Vacation of drainage and utility easement Action Deadline: November 14, 2019 BACKGROUND Airlake Development, Inc. and U-Haul of Southern Minnesota representatives have submitted applications for the preliminary and final plat of two existing metes and bounds described parcels into one lot and one outlot for Airlake Station First Addition. The plans include the construction of a three-story climate-controlled U-Haul self-storage building including office and retail showroom. A conditional use permit is required to allow a building height greater than 35 feet. Interim use permits are required to allow outdoor display of U-Haul trucks and trailers for rent 2 as an accessory use and to allow outdoor storage of recreational vehicles. An easement vacation is also requested with the final plat of the property. The building foundation area will be 43,769 square feet. The total building square footage will be 131,307 square feet. The subject property consists of 19.88 acres and is located at the southeast corner of Cedar Avenue (CSAH 23) and Lakeville Boulevard (CSAH 50). The property is zoned C-2, Highway Commercial District. The proposed project abuts the following existing or planned land uses: Direction Existing Use Land Use Plan Zoning North Poquet Auto Sales Commercial C-2 General Commercial District South Manufacturing/Warehouse Building Industrial I-2, General Industrial District East Undeveloped Commercial C-2, General Commercial District West Belzer Auto Sales Commercial C-2 General Commercial District STAFF ANALYSIS PRELIMINARY AND FINAL PLAT The preliminary and final plat consists of one lot and one outlot on a 19.88 acre property. Lot 1, (U-Haul) totals 7.87 acres. The following outline describes the proposal in detail as it reflects to the Zoning Ordinance and Subdivision Ordinance requirements: a. Comprehensive Plan. The property is located in Planning District No. 8 of the 2030 Comprehensive Land Use Plan and District 6 of the draft 2040 Comprehensive Land Use Plan. The property is in the current Metropolitan Urban Service Area (MUSA) which means that City municipal services, including sanitary sewer service, are available to serve the property. The proposed Airlake Station First Addition preliminary plat meets the recommended goals and objectives of the 2030 and draft 2040 Land Use Plans. b. Existing Site Conditions. The 19.88-acre site is currently undeveloped in agricultural production of row crops. A farm homestead was located on the property with a driveway onto Lakeville Boulevard until 2006 or 2007. An agricultural storage building remains on the property and will be removed as part of the proposed development of the property. c. Lot/Block/Outlot. The preliminary and final plat of Airlake Station First Addition consists of one 7.87-acre lot and one 10.49-acre outlot totaling 18.36 acres. The final plat will include dedication of 1.52 acres for Cedar Avenue (CSAH 23) and Lakeville Boulevard (CSAH 50) right- of-way. The lots proposed with the preliminary plat exceed the minimum lot area and lot width requirements for the C-2, Highway Commercial District. The following is a tabulation of the lots as noted on the preliminary plat plans: 4 Preliminary and Final Plat Lot/Outlot Lot Area and Width Requirements Lot 1 Outlot A 20,000 sf 7.87 acres 10.49 acres 100 feet 622 feet 1,186 feet d. Streets. The preliminary and final plat of Airlake Station First Addition does not include the construction of any public streets. Access will be exclusively from a shared drive at Lakeville Boulevard (CSAH 50). Cedar Avenue (CSAH 23) is a four-lane divided road that abuts the west side of the property and is classified as a principal arterial in the Transportation Plan. There will be no access at Cedar Avenue. Additional right-of-way is required with the Airlake Station First Addition final plat in compliance with the Dakota County right-of-way needs map. Lakeville Boulevard (CSAH 50) is a two-lane undivided the first 2,250 feet east of Cedar Avenue where the concrete divided, four lane road begins. Lakeville Boulevard is classified as an arterial road. Dakota County identified Lakeville Boulevard as a future four-lane divided road. Two accesses will be constructed along Lakeville Boulevard. Lot 1 will include a right-in only access. A full access will be constructed further to the east to allow full turning movements. e. Grading, Drainage, Erosion Control and Utilities. City sanitary sewer and water is currently available to the site, which is available to Lot 1 and Outlot A. The area of the proposed preliminary and final plat is located within the current MUSA. All necessary public utilities will be constructed by the developer to serve the proposed first phase development following final plat approval. Sewer and water will be available to serve Lot 2 when it is final platted. The existing and planned future City sanitary sewer and water systems available to serve the area of the preliminary plat are adequate to accommodate the build-out of future industrial building(s) within the preliminary plat area. Grading and utility plans have been submitted with the Airlake Station First Addition preliminary and final plat. Grading, drainage, erosion control, and utility review comments are addressed in the engineering report dated September 13, 2019. A copy of the engineering report is attached for your review. Engineering recommends approval of the Airlake Station First Addition preliminary and final plat. f. Wetlands. There are no wetlands within the Airlake Station First Addition preliminary and final plat. 5 g. Tree Preservation. The area of the preliminary plat includes 80 significant trees, primarily in the area of the homestead removed in 2006 or 2007. All existing significant trees will be removed from the site. h. Park Dedication, Trails and Sidewalks. The City’s Comprehensive Parks, Trails, and Open Space Plan identifies a future trail along the south side of Lakeville Boulevard. A bituminous trail is currently located on the north side of Lakeville Boulevard and on the east side of Cedar Avenue. There are no park land needs identified in the area of the plat. Park dedication cash fees will be required with approval of the 7.87-acre Lot 1 to be calculated prior to City Council approval of the final plat. The 2019 commercial park dedication fee rate is $7,693 per acre. EASEMENT VACATION A 20-foot wide public utility easement (recorded document number 412594) located along the west side of the property adjacent to Cedar Avenue is proposed to be vacated. The City acquired the easement in 1972. The final plat will overlay the easement with platted public right of way and a platted drainage and utility easement. All utility companies with a potential interest in the easement have been notified. No notice has been received opposing the proposed vacation. SITE PLAN ANALYSIS CONDITIONAL USE AND INTERIM USE PERMITS Building Height. Section 11-72-15 of the Zoning Ordinance allows a maximum building height of 35 feet in the C-2 District. Section 11-17-17 describes the criteria to allow a building to exceed the 35-foot height requirement subject to approval of a conditional use permit. The building is proposed to be 40 feet in height, which also requires an additional five feet of setback for each 10 feet of excess building height. The proposed building exceeds that setback requirement. Building Setbacks. The building setback requirements of the C-2 District are being met with the proposed site plans for Lot 1 as follows: Required Setbacks According to Building Height Lot 1, Block 1 Front Yard (North) - 35 feet Front Yard - 145 feet Side Yards - East 15 feet, west 35 feet Side Yards – west 110 ft; east 180 ft Rear Yard -------15 feet Rear Yard – 232 ft 6 Outdoor Rental. Outdoor rental is allowed as an accessory use by Section 11-72-9.A of the Zoning Ordinance subject to approval of an interim use permit. U-Haul plans to include space for the parking of rental vehicles and trailers in 39 designated spaces along the north and west sides of the property abutting Lakeville Boulevard and Cedar Avenue and adjacent to the east side of the building. An interim use permit requires compliance with the following performance standards: A. Outdoor service, sale and rental as an accessory use, provided that: 1. Outdoor services, sales and equipment rental connected with the principal use is limited to thirty percent (30%) of the gross floor area of the principal use. The outdoor rental area will comprise 17% of the building floor area. 2. Outdoor rental areas are fenced or screened from view of neighboring residential uses or an abutting Residential District in compliance with section 11-21-9 (Landscaping/Screening) of the Zoning Ordinance. The outdoor rental area does not abut a residential use or residential district, but the rental display area will be screened with rows of shrubs and overstory trees in compliance with Zoning Ordinance requirements for commercial parking lots. 3. Sales and rental area is surfaced with asphalt, concrete or pavers to control dust. The outdoor rental area will be surfaced with bituminous asphalt pavement. 4. The use does not take up parking space as required for conformity to this title. The outdoor rental display area will not occupy required parking spaces. 5. The interim use permit shall terminate upon a change of occupancy or other date as determined by the City Council in accordance with the requirements for interim use permits per Section 11-5-7 of the Zoning Ordinance. The interim use permit for outdoor rental will terminate upon a change of use of the property that no longer includes outdoor rental. Outdoor Storage. Outdoor storage is allowed as an accessory use by Section 11-72-9.B subject to approval of an interim use permit. U-Haul plans to include outdoor storage for public 7 recreational vehicles in a 1.2-acre area covered with a flat canopy roof. The outdoor storage area would be a two-phase construction project as demand dictates. The interim use permit requires compliance with the following: B. Outdoor storage as an accessory use, provided that: 1. Outdoor storage connected with the principal use is limited to thirty percent (30%) of the gross floor area of the principal use. The proposed first phase outdoor storage area is 23,925 square feet (18.2%). Phase II would include 29,150 square feet (53,075 square feet total) which would equal 40% of the gross square footage of the principal building (131,307 square feet). Phase two would require an amendment to the Zoning Ordinance prior to expansion of the outdoor storage area. The developer is aware of this requirement. The second phase outdoor storage area will have to be reduced to comply with the maximum allowed 30% if a Zoning Ordinance amendment is not approved by the City Council. 2. The storage area is fenced and screened from view of neighboring residential uses, abutting Residential Districts and the public right-of-way in compliance with Section 11-21-9 of the Zoning Ordinance. The outdoor storage does not abut a residential use or an abutting residential district. The outdoor storage area will be screened with eight-foot tall spruce or fir trees from view of Cedar Avenue. The outdoor storage area will be screened with Cedar Avenue (CSAH 23) with a row of 10 evergreen trees. 3. The storage area is surfaced with asphalt, concrete or pavers to control dust. The storage area will be surfaced with bituminous asphalt pavement. 4. The storage area does not take up parking space as required for conformity to Section 11- 19 (Parking) of the Zoning Ordinance. The outdoor storage area will not occupy required parking spaces. 5. The storage does not include any waste, except as provided in Section 11-18-11(Accessory Buildings) of the Zoning Ordinance. This performance standard will be a stipulation of the interim use permit. 8 6. The interim use permit shall terminate upon a change of occupancy or other date as determined by the city council in accordance with Section 11-5-7 (Interim Use Permits) of the Zoning Ordinance. The interim use permit for outdoor storage will terminate upon a change of use of the property that does not include outdoor storage. Building Exterior. The building is proposed to be constructed of pre-cast concrete panel walls with brick inlay, stone and glass, equal to 67.2% of the total building wall area, on the north, west and east building walls. The south wall will be 100% pre-cast concrete panel wall with a sandblasted exterior (Grade B) equal to 32.2% of the total building wall area. The building exterior materials meet the requirements of the Zoning Ordinance. Parking. U-Haul’s 131,307 square foot rental and storage building requires 32 parking spaces based on the UTE ratio of 0.14 spaces for 1,000 square feet of warehouse space, one space for each 200 square feet of office space and one space for each 200 square feet of customer service/merchandise/showroom area. The site plan provides 32 parking spaces in compliance with Zoning Ordinance requirements. The estimated required number of parking spaces is calculated as follows: Building Square Footage – 131,307 square feet Office – 128 square feet / 200 = 1 space Retail/Showroom -2,634 square feet / 200 = 13 spaces Warehouse/Self-Storage – 128,145 sf x 0.14 per each 1,000 sf = 18 spaces On-Site Parking (total required) .……………………..….32 spaces Parking to be Constructed….……………..………..……..32 spaces Due to the unique mix of proposed uses of the building for outdoor display, vehicle and trailer rental, and warehouse/storage, the on-site parking will have to managed such that adequate customer parking remains available to the public at all times. Employees should also be encouraged to use the parking spaces on the south side of the building. Parking of rental vehicles and equipment shall not occur within drive aisles and driveways. Access. Access to Airlake Station First Addition will be from a single shared driveway on Lakeville Boulevard (CSAH 50). A shared driveway with a cross access easement will allow traffic between Lot 1 and Outlot A to share the driveway accesses. All driveway accesses to public streets meet Zoning Ordinance requirements. 9 Circulation. All parking aisles and parking stalls comply with the required aisle width of 24 feet and parking stall dimensions of 9 feet in width and 20 feet in length. The driveways provide adequate width and turning radii to accommodate truck turning movements and emergency vehicle access. A truck turning movement plan was submitted and is attached as Exhibit I. Landscaping/Screening. The landscape plan for Lot 1 (U-Haul site) proposes 32 trees and 212 shrubs plus ornamental grasses specified in the table below: Landscape Materials 20 Deciduous trees (2.5 inch min. caliper) 12 Conifer trees (8 foot minimum height) 212 Shrubs and perennials All plant materials shall be set back at least five feet from all property lines, including street right- of-way lines. All landscaped areas within and adjacent to the parking lot shall be irrigated in compliance with the Zoning Ordinance. All areas not planted with trees, shrubs or perennials will be seeded with a natural grass mixture as shown on the landscape plan. The landscape plan proposes Swiss Stone pine trees as screening from Cedar Avenue. These trees are very slow growing and excellent landscape tree, but not believed suitable to provide a quick screening effect intended adjacent to Cedar Avenue. Staff recommends that the proposed six-foot tall Swiss Stone trees be replaced with either Black Hills spruce or Norway spruce trees a minimum of eight feet in height in compliance with the Corridor and Gateway Design Study referenced in Section 11-21 of the Zoning Ordinance. A financial security shall be submitted to guarantee installation of the landscaping on Lot 1. Financial securities will be determined at the time of final plat approval. Landscaping for future lots will be completed as they are platted and following the approval of site and landscape plans. Signage. Detailed sign plans have not been submitted. Section 11-23-19.E allows a building in the C-2, Highway Commercial District one freestanding sign not to exceed 100 square feet in area and 20 feet in height. Single occupancy commercial buildings exceeding 45,000 square feet in area are allowed one individual wall sign up to 440 square feet in area for one single wall and a second wall sign for buildings on a corner lot not to exceed 200 square feet in area. Secondary wall signage is allowed for such buildings not to exceed 72 square feet per sign but not exceeding 144 square feet total. A sign permit must be issued by the Planning Department prior to the installation of any signs. 10 Site Lighting. The lighting plan proposes eight free standing light fixtures on 25-foot poles located along the west, north and east boundary of the lot. Fifteen (15) wall pack lights are proposed on the front, sides and rear of the building. The wall pack fixtures are proposed to be full cut-off style that will not glare onto public road right-of-way or skyward. The photometric plan indicates that the light intensity at the public right-of-way does not exceed one foot-candle. Trash and Recycling Enclosure. All outdoor trash and recycling containers must be stored in an enclosure screened with a structure that is a minimum of 6 feet in height or one foot taller than the containers and must be constructed of materials that match the architecture of the principal building. The preliminary plat plans do not include plans for outdoor trash containers at this time. The building permit plans and site plans shall include outdoor trash enclosure details that comply with Zoning Ordinance requirements if any outdoor trash and recycling containers are proposed. Mechanical Screening. Rooftop mechanical screening must be located so that it is not visible from the public streets. Any ground mounted mechanical units must be screened with landscaping and/or a maintenance free fence. Snow Storage. Snow storage may not take place in required parking spaces. Dakota County Plat Commission. The Dakota County Plat Commission reviewed the preliminary plat at their April 1, 2019 meeting under the provisions of the Dakota County Contiguous Plat Ordinance for access and County Road right-of-way needs and considered the preliminary plat acceptable to the needs of Dakota County. A copy of the Dakota County Plat Commission letter dated April 8, 2019 is attached. RECOMMENDATION Planning Department staff recommends approval of the Airlake Station First Addition preliminary and final plat, conditional use permit, interim use permits, and easement vacation subject to the following stipulations: 1. Implementation of the recommendations listed in the September 13, 2019 engineering report. 2. The site and building exterior shall be developed in compliance with the plans approved by the City Council and Zoning Ordinance requirements. 11 3. Parking of rental vehicles and equipment shall not occur within drive aisles and driveways. 4. A financial security shall be submitted to guarantee installation and completion of the approved landscaping for Lot 1, Block 1 and for the storm water and infiltration basins and drainage ways at the time of final plat approval. All landscaped areas within and adjacent to the building and parking lot shall be irrigated. Trees and shrubs shall not be planted in road right-of-way. 5. The evergreen trees between the outdoor storage area and Cedar Avenue shall be screened with minimum eight-foot tall Black Hills Spruce or Norway Fir trees. The landscape plan shall be amended to comply with this requirement prior to City Council consideration. 6. Construction of Phase II outdoor storage area will require an amendment to the Zoning Ordinance to allow more than 30% of the gross floor area of the building for outdoor storage. 7. A private cross-access easement between Lot 1, Block 1 and Outlot A shall be submitted prior to release of the final plat mylars. 8. All signs shall comply with the Zoning Ordinance requirements for the C-2 District. A sign permit shall be issued by the Planning Department prior to the installation of any signs. 9. Snow storage shall not take place in required parking spaces. 10. Site lighting shall not exceed one-foot candle at the property line adjacent to public right-of-way. All exterior light fixtures shall be down-cast design so as not to glare onto public right-of-way. 11. The building permit and site plans must include outdoor trash enclosure details that comply with Zoning Ordinance requirements if trash is to be stored outdoor. The trash enclosures shall match the exterior materials of the principal building and shall include maintenance free gates. 12. The interim use permits shall terminate upon a change of occupancy or use of the property for outdoor rental display or outdoor storage, as each of the two interim use permits apply. The plat is adjacent to CSAH 23 (Cedar Ave.) and CSAH 50 (Lakeville Blvd.), and is therefore subject to the Dakota County Contiguous Plat Ordinance. The proposal includes a U-Haul site on Lot 1 with two additional light industrial lots. The right-of-way needs are 75 feet of half right of way along CSAH 23 and CSAH 50. Dedication of an additional 15-foot of right of way along CSAH 50 is required from CSAH 23 to the existing jog in the right of way (approx. 1319 feet) to meet the right-of-way needs. The two accesses to CSAH 50 include right-in only access (1/8 mile from CSAH 50/CSAH 23 intersection) and one full access (1/4 mile from CSAH 50/CSAH 23 intersection). The access spacing guidelines along CSAH 50 are 1/8-mile right-turns only access and ¼-mile full access. The Plat Commission stated the concerns the County is having with similar right-in only accesses without a divided roadway. As discussed, the right-turns only access design needs to restrict the potential for westbound left turn movements. The developer/engineer will be working with the County on the design through the County permitting process (contact Butch McConnell, Dakota County Permitting). As discussed, the permit requirement will be to extend the median from the proposed full access location to Gateway Drive. Restricted access should be shown along all of CSAH 50 except for the two access openings. Upon review of the right-turns only access design, restricted access symbols should be shown along the proposed right-of- way to reflect the design. Restricted access is shown along all of CSAH 23. A quit claim deed to Dakota County for restricted access is required to accompany the plat mylars at the time of recording. The Plat Commission has reviewed the final plat and recommends approval to the County Board of Commissioners, provided that the described conditions are met. Traffic volumes on CSAH 23 and CSAH 50 are 14,000 and 14,800 ADT, respectively, and are anticipated to be 23,000 and 32,400 ADT by the year 2030. No work shall commence in the County right of way until a permit is obtained from the County Transportation Department and no permit will be issued until the plat has been filed with the County Recorder’s Office. The Plat Commission does not review or approve the actual engineering design of proposed accesses or other improvements to be made in the right of way. Three privately owned and maintained stormwater management basins will be constructed with the development improvements located on Lot 1, Block 1 and on Outlot A. The stormwater management basin design incorporates the entire site drainage area assuming full development. The basins will provide water quality treatment and rate control for the proposed development. The Developer must enter into a stormwater maintenance agreement prior to final plat approval for the privately owned and maintained stormwater basin. The final grading plan shall identify all fill lots in which the building footings will be placed on fill material. The grading specifications shall also indicate that all embankments meet FHA/HUD 79G specifications. The Developer shall certify to the City that all lots with footings placed on fill material are appropriately constructed. Building Certificate of Occupancies will not be issued until a soils report and an as-built certified grading plan have been submitted and approved by City staff. Airlake Station First Addition contains more than one acre of site disturbance. A National Pollution Discharge Elimination System General Stormwater Permit for construction activity is required from the Minnesota Pollution Control Agency for areas exceeding one acre being disturbed by grading.
