HomeMy WebLinkAboutItem 03 CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES September 19, 2019 Chair Kaluza called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The pledge of allegiance to the flag was given. Members Present: Chair Pat Kaluza, Vice Chair Scott Einck, Brooks Lillehei, Jason Swenson, Karl Drotning, Jenna Majorowicz, Paul Reuvers, Ex-officio Mike Lamm Members Absent: Jeff Witte Others Present: Daryl Morey, Planning Director; Frank Dempsey, Associate Planner, Zach Johnson, City Engineer; Penny Brevig, Recording Secretary 3. Approval of the Meeting Minutes The September 5, 2019 Planning Commission meeting minutes and Planning Commission work session minutes were approved as presented. 4. Announcements Mr. Morey stated that the September 18, 2019 Parks, Recreation and Natural Resources Committee draft motion regarding the Airlake Station First Addition preliminary and final plat was distributed at tonight’s meeting. Mr. Morey stated that if neither agenda item at tonight’s meeting is tabled, the October 3, 2019 Planning Commission meeting will be cancelled. The next meeting is scheduled for October 17, 2019. 5. City of Lakeville Chair Kaluza asked City Engineer Zach Johnson to present the 2020-2024 Capital Improvement Plan (CIP). Mr. Johnson reviewed the goals and objectives of the CIP and indicated that the CIP’s components include transportation, utilities, environmental resources, parks and recreation, facilities, equipment and technology for the years 2020-2024. Mr. Johnson reviewed the CIP map, highlighting the more significant projects and the specific year each project will be completed. Mr. Johnson stated that many departments contributed to the preparation of the CIP and he thanked them for their efforts. Planning Commission Meeting Minutes, September 19, 2018 Page 2 Mr. Johnson stated that the 2020-2024 CIP public hearing will be held at the October 7, 2019 City Council meeting. Mr. Johnson stated that staff has reviewed the 2020-2024 CIP and finds it to be consistent with the Comprehensive Plan and therefore recommends approval as presented. Chair Kaluza thanked Mr. Johnson for his presentation and asked for comments from the Planning Commission. Discussion points included: • Commissioner Swenson commented that as an engineer himself, he appreciates the City preparing a document like this which is essentially a road map for the public improvements that will take place in the next five years. He stated that the CIP is a helpful tool for the review of projects that come through the Planning Commission. • Commissioner Drotning asked Mr. Johnson to elaborate on the City’s maintenance efforts and how that extends the life of the City’s infrastructure. • Commissioner Drotning asked about the timing of the Kenrick Avenue extension north of TimberCrest to County Road 50. Mr. Johnson said that it is development driven, but he expects within the next five years this street connection will be made given recent inquiries about development in this area. • Chair Kaluza stated for the viewing audience that the CIP is available on the City’s website. Motion was made by Lillehei, seconded by Reuvers to recommend to City Council adoption of the 2020-2024 Capital Improvement Plan as presented, finding that it is consistent with the City’s Comprehensive Plan. Ayes: Swenson, Majorowicz, Lillehei, Kaluza, Einck, Reuvers, Drotning Nays: 0 6. Airlake Station First Addition Chair Kaluza opened the public hearing to consider the application of Airlake Development, Inc. and Christopher Bohlman, U-Haul of Southern Minnesota for the following, located south of Lakeville Boulevard (CSAH 50) and east of Cedar Avenue (CSAH 23): A. Preliminary plat and final plat of one commercial lot and one outlot to be known as Airlake Station First Addition; B. Conditional use permit to allow a building height greater than 35 feet in the C-2 District; C. Interim use permit to allow outdoor rental of trucks and trailers as an accessory use in the C-2 District; D. Interim use permit to allow outdoor storage of recreational vehicles as an accessory use in the C- 2 District; E. Vacation of a public utility easement. Brian Wurdeman from Kimley Horn presented a brief overview of the request on behalf of U-Haul. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey explained the applications that are included with this public hearing. The size of the Planning Commission Meeting Minutes, September 19, 2018 Page 3 proposed three-story building is 131,307 square feet. The preliminary and final plat consists of one lot and outlot on undeveloped agricultural land with row crops. Mr. Dempsey stated that the lot proposed with the preliminary and final plat exceeds the minimum lot area and lot width requirements for the C-2, Highway Commercial District. The Airlake Station First Addition preliminary and final plat does not include the construction of any public streets. Mr. Dempsey stated that the conditional use permit is for a building height greater than 35 feet in the C-2, Highway Commercial District. The building is proposed to be 40 feet in height, which requires an additional five feet of setback for each 10 feet of excess building height. The proposed building exceeds that setback requirement. Mr. Dempsey stated that the proposed building exterior consists of pre-cast concrete panel walls with brick inlay, stone and glass on the north, west and east elevations and a pre-cast concrete panel wall with a sandblasted exterior on the south elevation, all of which meet Zoning Ordinance requirements. Mr. Dempsey stated that outdoor rental is allowed as an accessory use subject to approval of an interim use permit. U-Haul plans to include 39 designated spaces for the parking of rental vehicles and trailers. Mr. Dempsey reviewed the interim use permit requirements, which are listed in detail in the September 13, 2019 planning report. Outdoor storage is also allowed as an accessory use subject to approval of an interim use permit. Mr. Dempsey indicated that U-Haul plans to include public outdoor storage of recreational vehicles in a 1.2-acre area covered with a flat canopy roof. The outdoor storage area is proposed to be a two-phase construction project as demand dictates. He reviewed the interim use permit requirements, which are listed in detail in the September 13, 2019 planning report. Mr. Dempsey stated that the site plan provides 32 customer and employee parking spaces, which are in compliance with the Zoning Ordinance. Because of the unique mix of proposed uses of the site for outdoor storage, vehicle and trailer rental and inside storage, the on-site parking will have to be managed such that adequate customer parking remains available to the public at all times. Access to the site will be exclusively from Lakeville Boulevard (CSAH 50). There will be a right-in only driveway for Lot 1 and a shared driveway with a cross access easement that will allow circulation between Lot 1 and Outlot A. The driveways provide adequate width and turning radii to accommodate truck turning movements and emergency vehicle access. Mr. Dempsey reviewed the proposed landscape plan. He indicated that staff is recommending that the proposed six-foot tall Swiss Stone trees be replaced with Black Hills Spruce or Norway Spruce trees along Cedar Avenue in compliance with the Corridor and Gateway Design Study. A financial security shall be submitted to guarantee installation of the landscaping on Lot 1. Planning Commission Meeting Minutes, September 19, 2018 Page 4 Mr. Dempsey indicated that a 20-foot wide public utility easement located along the west side of the property adjacent to Cedar Avenue is proposed to be vacated. The final plat will overlay the easement with public right of way and a drainage and utility easement. Mr. Dempsey stated that Planning Department staff recommends approval of the Airlake Station First Addition preliminary and final plat, conditional use permit, interim use permits, and easement vacation, subject to the 12 stipulations listed in the September 13, 2019 planning report, and adoption of the Findings of Facts dated September 19, 2019. Chair Kaluza opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Lillehei, seconded by Einck to close the public hearing at 6:32 p.m. Voice vote was taken on the motion. Ayes - unanimous Chair Kaluza asked for comments from the Planning Commission. Discussion points included: • The right-in only access to the site was discussed. Mr. Johnson stated City staff worked with County transportation engineers and found a solution without changing the existing access to Gateway Drive for the businesses on the north side of County Road 50. With no access to Cedar Avenue, this compromise will meet the needs of U-Haul. • Chair Kaluza asked how this U-Haul site will compare to others in the Twin Cities area in terms of customer parking. Christopher Bohlman from U-Haul addressed the parking concerns. He indicated that this site is much larger than other facilities in the metro area so there is room to add parking in the future if needed. He is confident that there will be adequate parking at this location. • Mr. Dempsey explained the difference between outdoor rental of equipment and outdoor storage and why there is an IUP for each. He stated there is a sunset provision for IUP’s, so if the use of this property changes, the IUP’s will terminate. • The Planning Commission liked the look of the building given the proposed exterior materials. Motion was made by Drotning, seconded by Lillehei to recommend to City Council approval of the Airlake Station First Addition preliminary plat and final plat of one commercial lot and one outlot, conditional use permit to allow a building height greater than 35 feet in the C-2 District, interim use permit to allow outdoor rental of trucks and trailers as an accessory use in the C-2 District, interim use permit to allow outdoor storage of recreational vehicles as an accessory use in the C-2 District, and vacation of a public utility easement, located south of Lakeville Boulevard (CSAH 50) and east of Cedar Avenue (CSAH 23), and adoption of the Findings of Facts dated September Planning Commission Meeting Minutes, September 19, 2018 Page 5 19, 2019, subject to the following 12 stipulations listed in the September 13, 2019 planning report: 1. Implementation of the recommendations listed in the September 13, 2019 engineering report. 2. The site and building exterior shall be developed in compliance with the plans approved by the City Council and Zoning Ordinance requirements. 3. Parking of rental vehicles and equipment shall not occur within drive aisles and driveways. 4. A financial security shall be submitted to guarantee installation and completion of the approved landscaping for Lot 1, Block 1 and for the storm water and infiltration basins and drainage ways at the time of final plat approval. All landscaped areas within and adjacent to the building and parking lot shall be irrigated. Trees and shrubs shall not be planted in road right-of-way. 5. The evergreen trees between the outdoor storage area and Cedar Avenue shall be screened with minimum eight-foot tall Black Hills Spruce or Norway Spruce trees. The landscape plan shall be amended to comply with this requirement prior to City Council consideration. 6. Construction of Phase II outdoor storage area will require an amendment to the Zoning Ordinance to allow more than 30% of the gross floor area of the building for outdoor storage. 7. A private cross-access easement between Lot 1, Block 1 and Outlot A shall be submitted prior to release of the final plat mylars. 8. All signs shall comply with the Zoning Ordinance requirements for the C-2 District. A sign permit shall be issued by the Planning Department prior to the installation of any signs. 9. Snow storage shall not take place in required parking spaces. 10. Site lighting shall not exceed one-foot candle at the property line adjacent to public right-of-way. All exterior light fixtures shall be down-cast design so as not to glare onto public right-of-way. 11. The building permit and site plans must include outdoor trash enclosure details that comply with Zoning Ordinance requirements if trash is to be stored outdoors. The trash enclosures shall match the exterior materials of the principal building and shall include maintenance free gates. 12. The interim use permits shall terminate upon a change of occupancy or use of the property for outdoor rental display or outdoor storage.
