Partial Release of Development Contract
Proposed Action
Staff recommends adoption of the following motion: Move to approve Partial Release of
Development Contract for Lot 1, Block 2, Heritage Commons Addition.
Overview
The owner of the US Bank Property in Heritage Commons is requesting that the property be
released from the original Development Contract for the property that was approved in 1999. The
original developer of Heritage Commons complied with requirements of the original Development
Contract. Staff recommends approval of the Partial Release of Development Contract for Lot 1,
Block 2, Heritage Commons.

PARTIAL RELEASE OF
DEVELOPMENT CONTRACT
RELEASE granted ______________________, 2019, by the CITY OF LAKEVILLE, a
Minnesota municipal corporation ("City").
WHEREAS, the City has been asked to release and discharge Lot 1, Block 2, Heritage
Commons, Dakota County, Minnesota, according to the recorded plat thereof (“Subject Property’)
from the Development Contract between the City and Heritage Commons, LLC, a Minnesota limited
liability company, dated September 7, 1999 and recorded January 7, 2000 as Document No. 1664610
in the Office of the Dakota County Recorder (“Development Contract”);
WHEREAS, all requirements of the Development Contract have been met as to the Subject
Property and there is no longer a need to have the Development Contract recorded against the
Subject Property.
NOW THEREFORE, be it resolved by the Lakeville City Council:
The Subject Property is released and discharged from the Development Contract.
