HomeMy WebLinkAboutItem 06.k Date: Item No. CONDITIONAL USE PERMIT AND FINAL PLAT EXTENSIONS Proposed Action Staff recommends adoption of the following motion: Move to approve an extension for the Four Square Preschool and Daycare conditional use permit and the Timbercrest at Lakeville 8th Addition, Spirit of Brandtjen Farm 22nd Addition, and Berean Baptist Church final plats. Overview Due to the pending expirations of the conditional use permit (CUP) for Four Square Preschool and Daycare and the final plats of Timbercrest at Lakeville 8th Addition, Spirit of Brandtjen Farm 22nd Addition, and Berean Baptist Church, applicants and property owners have requested extensions to the approvals, as indicated below. Four Square Preschool and Daycare conditional use permit (CUP) was approved by the City Council on November 19, 2018. Due to last minute changes, construction is now anticipated to begin in Spring 2020 and requests that the CUP be extended to November 19, 2020. Timbercrest at Lakeville 8th Addition final plat was approved by the City Council on August 5, 2019. Panera is no longer pursuing a restaurant on the site but the property owner, the Avalon Real Estate Group, is working with a buyer and requests that the final plat be extended to May 31, 2020. Spirit of Brandtjen Farm 22nd Addition final plat was approved by the City Council on August 19, 2019. Due to weather delays, Tradition Development has elected to delay project construction until Spring 2020 and requests that the final plat be extended to March 15, 2020. Berean Baptist Church final plat was approved by the City Council on August 26, 2019. Due to weather delays, EFH, on behalf of the church, has elected to delay project construction until Spring 2020 and requests that the final plat be extended to February 28, 2020. Although we had anticipated starting construction in August or September of 2019, we unfortunately had some last minute changes come up and have decided to delay construction until after winter. Thank you, Phil Shaver Sent from my iPhone On Nov 12, 2019, at 5:24 PM, Jenson, Kris <kjenson@lakevillemn.gov> wrote:  Phil,   On November 19, 2018, the Lakeville City Council approved a Conditional Use Permit (CUP) for a new Four Square Daycare facility adjacent to Crossroads Church. Per the Zoning Ordinance, conditional use permits expire after one year if the use (in this case the daycare) has not started construction on the facility or operate the business. The ordinance has a provision which allows the CUP to be extended by the City Council upon request by the applicant.   From what I understand, construction on the new facility is expected to begin in the Spring of 2020. In order to keep the CUP active for the new Four Square facility, please send me an email with a request to extend the CUP to November 19, 2020. Please include a sentence or two about the planned construction in the spring. I will add this to the City Council agenda for the November 18, 2019 meeting. It will be included on the consent agenda, which means it is considered routine, no separate presentation will be made regarding the request, and a representative of the project would not need to attend the meeting.   I apologize for the late notice, but I do need to have an email from you by the end of the day tomorrow, November 13. I need to submit all council items to the City Clerk on Thursday morning to ensure they are included on the agenda.   If you have any questions, please let me know.   Kris From:Kevin Brazner To:Jenson, Kris Cc:Barbara Van Auken; Olson, David Subject:Re: FW: TimberCrest at Lakeville 8th Addition Date:Wednesday, November 13, 2019 10:30:12 AM Attachments:image925115.png image315163.png image402745.png image907542.png image780312.png HI Kris - Thank you for your assistance in extending the timeframe for the TimberCrest 8th Addition final plat. Our goal is to advance the final plat as soon as possible. That being said, we are negotiating with a buyer for the property in question and it is possible that the buyer will have up to 5 months to close, once under contract. An extension to May 31, 2020 should provide us with the requisite timing, as things appear at this point. Please let me know if you have any questions or concerns. Thank you again. I do need from you a date to which you would like the final plat extended. To extend an additional 100 days would make the plat valid through February 21, 2020. You can go beyond that to a date in late Spring, say April 30 or May 31, but you should provide a brief reason for the extension. Please send me the email request by the end of the day today. Kay_Larson_Signature From: Jenson, Kris <kjenson@lakevillemn.gov> Sent: Tuesday, November 12, 2019 5:46 PM To: Dan Shaffer <dshaffer@efhco.com>; Kay Larson <kayl@BereanBaptist.com> Subject: Final Plat extension   Dan and Kay,   The final plat for Berean was approved on August 26, 2019 and expires on Dec 4, 2019. The City Council can extend the final plat approval after a request from the applicant for an extension. The extension approval requires an written request from the church to extend the final plat – I suggest requesting either an additional 100 days (March 13, 2020) or if you plan to wait until Spring to start building construction on the site, then you could request an end date of April 30, 2020 for instance.   An email is fine. Just a sentence with the new end date and another stating generally why you need the additional time.   I would like to put this on the November 18 City Council meeting, which would mean I need the email request from you by the end of the day on Wednesday, November 13. There are a few other projects requesting extensions so I am planning to prepare 1 council memo for all of the projects/plats. A representative would not need to attend the City Council meeting next Monday as it is considered routine and a presentation would not be made for the request.
