HomeMy WebLinkAbout11-21-19 CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES November 21, 2019 Alternate Chair Lillehei called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The pledge of allegiance to the flag was given. Members Present: Alternate Chair Brooks Lillehei, Karl Drotning, Jenna Majorowicz, Jeff Witte, Jason Swenson, Jason Kelvie Members Absent: Chair Pat Kaluza, Vice Chair Scott Einck, Ex-officio Mike Lamm Others Present: Daryl Morey, Planning Director; Frank Dempsey, Associate Planner; Monica Waite, Planning and Zoning Specialist; Penny Brevig, Recording Secretary 3. Approval of the Meeting Minutes The November 7, 2019 Planning Commission meeting minutes were approved as presented. 4. Announcements Mr. Morey stated that there is a work session immediately following tonight's meeting to discuss the new Corridor Mixed Use (CMU) performance standards. 5. Hypointe Child Care Alternate Chair Lillehei opened the public hearing to consider the application of Hypointe Child Care, LLC for a conditional use permit amendment to allow an th expansion of the Hypointe childcare facility, located at 8755 Upper 208Street. Jennifer Orth and Tricia DeMariais, from Hypointe Child Care, were in attendance at tonight's meeting and were available to answer any questions that the Planning Commission may have. Planning and Zoning Specialist Monica Waite presented the planning report. Ms. Waite stated that Hypointe Child Care is proposing a CUP amendment to expand and occupy the entirety of their current building. The daycare is proposed to have a maximum licensed capacity of 170 children with the addition of three more classrooms and eight additional full-time staff. Ms. Waite reviewed the history of the daycare building and the land uses and zoning surrounding the subject building. She stated that the lot and building comply with Zoning Ordinance requirements. The total amount of available parking for the site exceeds the minimum parking requirements. A minimum of one loading space shall Page2 Planning Commission Meeting Minutes, November 21, 2018 be provided for the child daycare facility, which is located at the south entrance to the building. Ms. Waite stated that staff recommends approval of the Hypointe Child Care conditional use permit amendment, subject to the four stipulations listed in the November 15, 2019 planning report and adoption of the Findings of Fact dated November 21, 2019. Alternate Chair Lillehei opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Kelvie, seconded by Drotning to close the public hearing at 6:06 p.m. Voice vote was taken on the motion. Ayes - unanimous Alternate Chair Lillehei asked for comments from the Planning Commission. Discussion points included: • Commissioner Kelvie asked the applicants if they had any traffic concerns with the proposed increase in capacity. Ms. Orth commented that the high traffic drop-off times are between 7:45 a.m. to 8:15 a.m. and 4:45 p.m. to 5:15 p.m. She did not believe there would be any issues. • Commissioner Witte asked if cars ever backed up on Holyoke Avenue at these times. Ms. DeMariais stated that there is a pretty quick turnaround for drop off and pick up so this has not been an issue. Motion was made by Swenson, seconded by Kelvie to recommend to City Council approval of the Hypointe Child Care, LLC conditional use permit amendment to allow th an expansion of the Hypointe childcare facility, located at 8755 Upper 208Street, and adoption of the Findings of Fact dated November 21, 2019, subject to the following four stipulations listed in the November 15, 2019 planning report: 1. All permits and requirements of the Minnesota Department of Human Services shall be met prior to occupancy of the child daycare expansion area. 2. Licensed occupancy for the child daycare facility shall not exceed 170 children. 3. A building permit is required prior to commencing any construction or remodeling work. 4. A permit shall be obtained prior to the installation of any new permanent or temporary signage. Ayes: Swenson, Majorowicz, Kelvie, Lillehei, Witte, Drotning Nays: 0 6. Gander Outdoors Alternate Chair Lillehei opened the public hearing to consider the application of Gander Outdoors for an interim use permit to allow the outdoor display and sales of Page3 Planning Commission Meeting Minutes, November 21, 2018 recreational vehicles and equipment as an accessory use in the C-3, General Commercial District, located at 16861 Kenyon Avenue. Dylan Blackshear, Senior Project Manager for Corestates Group and Darek Mander from Gander Outdoors were present to answer any questions the Planning Commission may have. Mr. Blackshear presented a short overview of the request. He thanked City staff for their assistance with the interim use permit application. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey thanked Gander Outdoors for getting the RV display in compliance until they could get approval of their interim use permit. Mr. Dempsey reviewed the history of the building. He stated that Ganders Outdoors has occupied the building since 2017 and has since undertaken a significant remodel of the interior of the building to accommodate the Gander Outdoors corporate offices and recreational vehicle service bays. Gander Outdoors is now requesting approval to sell recreational vehicles which would include an outdoor sales and display area. Mr. Dempsey explained where the proposed outdoor sales and display areas would be, which are within the parking lot located north of the building, an area on the south side of the building, and a smaller area on part of the sidewalk along the east face (front) of the building. The proposed outdoor sales and display areas identified on the site plan is slightly less than the maximum 30% allowed. Mr. Dempsey indicated that an amended parking deferment agreement shall be required for deferment of not more than 142 parking spaces. Mr. Dempsey reviewed the Zoning Ordinance interim use permit criteria, which are listed in the November 15, 2019 planning report. Mr. Dempsey stated that Planning Department staff recommends approval of the interim use permit for Gander Outdoors and adoption of the Findings of Fact dated November 21, 2019, subject to the seven stipulations listed in the November 15, 2019 planning report. Alternate Chair Lillehei opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Kelvie, seconded by Drotning to close the public hearing at 6;20 p.m. Voice vote was taken on the motion. Ayes - unanimous Alternate Chair Lillehei asked for comments from the Planning Commission. Discussion points included: Page4 Planning Commission Meeting Minutes, November 21, 2018 • Commissioner Drotning asked for clarification on the location of the deferred parking. Mr. Dempsey responded that the majority of the deferred parking spaces are located in the outdoor display areas. • Commissioner Drotning asked if there was any thought to expanding the parking further to the north. Mr. Dempsey responded that due to the topography in this area, that would not be possible. • Alternate Chair Lillehei wanted to recognize Dylan Blackshear for the project narrative he submitted with the interim use permit application. • Fencing the sales area in the parking lot was discussed but Mr. Mander indicated that it would not make sense at this location. They do have cameras and the parking lot is well lit. • Commissioner Kelvie asked about the service department. Mr. Mander stated that they have two bays. The service department mainly installs parts and accessories on the RV's that are sold inside their store. Motion was made by Drotning, seconded by Witte to recommend to City Council approval of the Gander Outdoors interim use permit to allow the outdoor display and sales of recreational vehicles and equipment as an accessory use in the C-3, General Commercial District, located at 16861 Kenyon Avenue, and adoption of the Findings of Fact dated November 21, 2019, subject to the following seven stipulations listed in the November 15, 2019 planning report: 1. Outdoor sales and display shall be restricted to the areas outlined on the approved site plan and shall not exceed 30% of the floor area of the principal building. 2. Outdoor sales and display shall not block the building entrance and exit doors and shall not impede access by emergency vehicles. 3. An amended parking deferment agreement shall be required for deferment of not more than 142 parking spaces. The parking deferment shall be recorded with Dakota County prior to commencing the outdoor sales and display of recreational vehicles and equipment. 4. A Minnesota dealers license shall be obtained prior to commencing the sale of recreational vehicles or equipment. 5. Signage shall be installed and maintained in compliance with Zoning Ordinance requirements and subject to approval of a sign permit. 6. All landscaping shall be maintained and any dead material shall be replaced as weather permits. 7. The interim use permit will terminate at such time that outdoor sales and display of recreational vehicles and equipment is no longer occurring on the property. Ayes: Majorowicz, Kelvie, Lillehei, Witte, Drotning, Swenson Nays: 0 7. City of Lakeville Alternate Chair Lillehei opened the public hearing to consider an amendment to Title 11 of the Lakeville City Code (the Zoning Ordinance) concerning subdivision signs. Pages Planning Commission Meeting Minutes, November 21, 2018 Planning Director Daryl Morey presented the planning report. Mr. Morey stated that questions have been raised as to whether the Zoning Ordinance provision that establishes sign allowances for properties used for model home purposes within developing subdivisions can be interpreted to permit installation of the allowed signs off-premise from the model home lot. Mr. Morey indicated that to remove any possible ambiguity regarding the permitted location for signs allowed by the Zoning Ordinance, City staff has initiated an amendment to Section 11-23-15.X.2.b of the Zoning Ordinance by proposing the following amendment: b. Model homes as provided for by Chapter 27 of this title shall be allowed the following signs to be installed upon the same lot as the model home: Mr. Morey stated that the proposed amendment will clarify where the signs can be installed and aid City staff in the administration of the Zoning Ordinance. City staff recommends approval of the proposed Zoning Ordinance amendment, as presented. Alternate Chair Lillehei opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Drotning, seconded by Kelvie to close the public hearing at 6:28 p.m. Voice vote was taken on the motion. Ayes - unanimous Alternate Chair Lillehei asked for comments from the Planning Commission. The Planning Commission agreed that this amendment made sense. Motion was made by Swenson, seconded by Witte to recommend to City Council approval of an amendment to Title 11 of the Lakeville City Code (the Zoning Ordinance) concerning subdivision signs, as presented. Ayes: Kelvie, Lillehei, Witte, Drotning, Swenson, Majorowicz Nays: 0 There being no further business, the meeting was adjourned at 6:29 pm.
