CITY COUNCIL MEETING MINUTES
December 16, 2019
Mayor Anderson called the meeting to order at 7:00 p.m. in the Council Chambers at City
Hall. After a moment of silence, the Pledge of Allegiance to the flag was given.
Members Present: Mayor Anderson, Council Members Hellier and Lee
Absent: Council Members Volk and Wheeler
Staff Present: Justin Miller, City Administrator; Andrea McDowell Poehler, City Attorney;
Jeff Long, Police Chief, Paul Oehme, Public Works Director; David Olson, Community &
Economic Development Director; John Hennen, Parks & Recreation Director; Daryl Morey,
Planning Director; Charlene Friedges, City Clerk

5. Presentations/Introductions:
Chief Meyer introduced three of the four firefighters who successfully completed their
two-year probationary period.
Chief Long recognized Colleen LaBeau of LaBeau and Associates, who donated first aid kits
valued at approximately $6,500 to the Police Department. Chief Long then presented the
Police Department quarterly report.
6. Consent Agenda
Motion was made by Lee, seconded by Hellier, to approve the following:
a. Check register review
b. Minutes of the December 2, 2019 City Council meeting
c. Minutes of the November 25, 2019 City Council work session
d. Minutes of the December 9, 2019 City Council work session
e. Renewal of mixed municipal solid waste and recyclable material collection licenses
Resolution No. 19-158 accepting donations from Lakeville Liquor customers to the Fire
Department
g. Agreement for Legal Services with Campbell Knutson, Professional Association

h. Resolution No. 19-159 accepting donation from Lakeville Public Safety Foundation to
the Police Department
Resolution No. 19-160 accepting donation from Tom and Colleen LaBeau to the Police
Department
j. Accept quotation from Galls, LLC for the purchase of Police Department safety
equipment
k. Termination Agreement with Cool Air Mechanical, Inc.
I. Contracts with Hawkins, Inc. and Carus LLC for water treatment chemicals
m. Contract with Vonage Business, Inc. for the least of a new city phone system
n. Mutual Police Assistance Agreement with Dakota County for traffic safety
o. Community Development Block Grant Subrecipient Agreement with DARTS for loop

Voice vote was taken on the motion. Ayes - unanimous
7. City Administrator performance review
Council Member Hellier read the following statement regarding the City Administrator's
performance evaluation:
The City Administrator's performance evaluation was completed by the Mayor and City
Council. Mr. Miller's direct reports were also asked to complete a modified performance

evaluation form. This modified 360 approach provided the Mayor and City Council with
multiple viewpoints for Mr. Miller's review and provided a balanced picture of his
performance. Many factors were reviewed including his engagement, his
understanding of department operations, his leadership, his presence in the
community, and his communications with the Council, the public, and the employees.
We find Mr. Miller's performance continues to be consistently above the Council's
expectations. The City Council completed an annual performance evaluation for City
Administrator Justin Miller tonight at a special closed meeting. Per the City
Administrator's employment agreement, the City Council will review compensation on
an annual basis.
Mayor Anderson stated Council Members Volk and Wheeler concur with the Personnel
Committee's recommendation regarding the City Administerartor's performance review
and salary increase.
Motion was made by Hellier, seconded by Lee, to approve a salary increase to $178,782
effective January 1, 2020; and to approve an annual salary increase to $182,465.85
effective 30 days from receiving official notification of receiving the salary cap waiver from
Minnesota Management & Budget, as recommended by the Personnel Committee.
Roll call was taken on the motion. Ayes - Anderson, Hellier, Lee
