AMENDED COMMUNICATIONS SITE LEASE AGREEMENT
WITH NEW CINGULAR WIRELESS PCS LLC. (AT&T)
Proposed Action
Staff recommends adoption of the following motion: Move to approve an amended
communications site lease agreement with New Cingular Wireless PCS LLC (AT&T).
Overview
The City of Lakeville owns an existing 110-foot-tall communications monopole at 9465 185th Street
adjacent to Fire Station 4. The city currently has a lease with AT&T for their equipment on the
monopole. Verizon Wireless has proposed to replace the monopole with a new one at 139-foot
tall and move AT&T’s equipment to the new monopole. The relocation of AT&T’s equipment to
the new monopole will require the city’s lease with AT&T to be amended to reflect the relocation.
Attached for City Council consideration is the amended lease with AT&T reflecting their
relocation to the new monopole.
Primary Issues to Consider
Who is responsible for the relocation of AT&T’s equipment?
• AT&T is the only carrier on the existing monopole. The lease and construction agreement
with Verizon Wireless require them to work directly with AT&T to transfer their equipment
onto the new tower without any cost to the City. Verizon will also be responsible for removing
the old monopole.
Who will own the new monopole being installed by Verizon?
• Verizon Wireless will construct the new monopole on City owned property at their expense.
The ownership of the monopole will then be transferred to the City and in exchange, the City
will abate Verizon’s lease payments for seven years. The City will continue to collect the lease
payment from AT&T for the duration of their lease. The new monopole will also be
constructed to allow for an additional carrier to be located on the pole.
