HomeMy WebLinkAboutItem 5City of Lakeville Planning Department Memorandum To: Planning Commission From: Monica Waite, Planning & Zoning Specialist Date: January 31, 2020 Subject: Packet Material for the February 6, 2020 Planning Commission Meeting Agenda Item: Lake Marion Elementary School Conditional Use Permit Amendment Application Action Deadline: February 20, 2020 INTRODUCTION Representatives of ISD #194 are requesting an amendment to CUP #89-05 to allow an expansion to the Lake Marion Elementary School building, located at 19875 Dodd Boulevard. The site contains the existing Lake Marion Elementary School, a parking lot, a lot for buses, baseball fields and playgrounds. The proposed addition will include 15,420 square feet on the southeast side of the existing 77,600 square foot building. The project will also include parking lot and driveway improvements to address street access and traffic flow. The existing school was constructed in 1989. The subject property is zoned RS-2, Single Family Residential District. Section 11-51-7D of the Zoning Ordinance allows public elementary schools in the RS-2 District by conditional use permit. Exterior Elevations PLANNING ANALYSIS The proposed 15,420 square foot expansion to the southeast side of the existing elementary school building will be over an existing grassy area facing Dodd Boulevard. The project includes the construction of classrooms and bathrooms off an extension of the existing building. The proposed expansion was reviewed for conformance with Zoning Ordinance performance standards as follows: Surrounding Land Uses and Zoning North –Lakeville North High School (P/OS) South – Attached Townhomes (RM-1) East – Dodd Boulevard and Office Buildings (C-3) West – Ames Arena (P/OS) Building Setbacks. The existing and proposed buildings meet all setback requirements of the RS-2 District: Front – 30 feet Side – 15 feet Rear – 30 feet The proposed building addition will have the following setbacks from the closest property line: Front (east) –115.7 feet Side (south) – 52.1 feet Building Height. The building addition is single story and 14 feet in height and will not exceed the maximum building height of 35 feet allowed in the RS-2 District. Access and Circulation. The School District and Elementary School representatives raised concerns to City staff regarding safety entering and exiting the school property and vehicle queuing along Dodd Boulevard. The applicant proposed a second access off Dodd Boulevard to serve as a right only exit. Dakota County reviewed this request and it was denied due to minimum access spacing requirements and the recorded plat requirement that the property would be subject to one access off Dodd Boulevard. The applicant proposes a redesign and expansion of the parking lot and existing access off Dodd Boulevard. This would include a two lane entrance on site to separate bus and vehicle traffic, and a right only exit, with an expanded drop off lane and parking lot improvements. City staff proposed a more comprehensive circulation plan in conjunction with changes at Ames Arena to the west of the school. This 3 would include a single lane drive connection to the Ames Arena parking lot, creating a separate entrance for the school via Ipava Avenue. City staff presented this recommendation to remove conflicts between entering/exiting vehicles during pick up and drop off times and to reduce vehicle queues along Dodd Boulevard. The School District chose not to explore the option. Parking. According to ISD 194, the current enrollment is 700 students and the projected enrollment is 900 students. The Zoning Ordinance requires one parking space per seven students, which equals 129 parking spaces to accommodate the projected enrollment. The property currently has 105 on-site parking spaces, with the proposed addition of 80 on-site parking spaces, for a total of 185 on-site parking spaces. The applicant also proposes the addition of 18 stadium area parking spaces to be used as overflow parking, for a total of 86 off- site shared parking spaces. This parking lot is to be shared with Lakeville North High School. All on and off site parking shall be constructed to meet the requirements of the Zoning Ordinance. The total amount of proposed available parking exceeds Zoning Ordinance requirements. Trails and Sidewalks. The existing pathways will be reconfigured and extended to accommodate the addition and parking lot improvements. Building Elevations and Exterior Building Materials. The proposed building addition will be sided with brick to match the existing building. Landscaping. Dodd Boulevard is identified as a roadway corridor listed in the Corridor and Gateway Design Study as adopted in the Zoning Ordinance, so additional screening from developments is required in the area that abuts a road like Dodd Boulevard. Institutional uses require a continuous opaque barrier along the off street parking area perimeter abutting public right-of-way and residentially zoned properties. Additionally, the building addition abuts a residential district to the south, which requires adequate screening from the residential properties. No landscape material shall be located in the Highway & Utility easement on the east property line or within the public right-of-way. All proposed landscape material shall comply with Zoning Ordinance requirements. A final landscape plan shall be submitted prior to City Council action. Signs. There is no new signage proposed with the addition. Mechanical Equipment. There is additional mechanical equipment proposed with the building addition that will be located on the roof and screened in compliance with Zoning Ordinance requirements. Trash Enclosure. There is an existing, compliant trash enclosure on the north side of the building. 4 Lighting. Exterior lighting is proposed to be increased for the site. Exterior lighting must comply with Section 11-16-17 of the Zoning Ordinance. Detailed fixture and photometric plans must be submitted with the Building Permit application for the proposed addition. Engineering Review. The Engineering Department has reviewed the plans and prepared a memorandum dated January 31, 2020, which references the need for a financial security in the amount of $259,997.75 prior to the issuance of a Building Permit for the addition. RECOMMENDATION Planning Department staff recommends approval of the Lake Marion Elementary School conditional use permit amendment located at 19875 Dodd Boulevard subject to the following stipulations: 1. The site plan and building addition shall be developed in accordance with the plans approved by the City Council. 2. A building permit is required prior to commencing construction of the building addition. 3. The proposed building addition shall be sided with brick to match the existing building. All building materials shall meet the requirements for an institutional use in the RS-2 District. 4. Lighting must comply with Section 11-16-17 of the Zoning Ordinance. Detailed fixture and photometric plans must be submitted with the Building Permit application for the proposed addition. 5. The building addition is subject to review by the Fire Marshal. 6. All off street parking shall be constructed to meet the requirements of the Lakeville City Code. A revised site plan shall be submitted prior to City Council Action. 7. A final landscape plan shall be submitted prior to City Council Action. The landscape plan shall comply with requirements of the Lakeville City Code. 8. The Planning Commission conducted a public hearing on the proposed conditional use permit amendment preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The property is located in Planning District No. 4 of the 2040 Comprehensive Plan, which guides the property for Public and Quasi-Public uses. 2. The property is currently zoned RS-2, Single Family Residential District. . 3. The legal description of the property is: Lot 2, Block 1, LAKEVILLE ELEMENTARY 2ND ADDITION, according to the recorded plat thereof, Dakota County, Minnesota. 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The proposed expansion of the elementary school is consistent with the policies and provisions of Planning District 4 of the Comprehensive Land Use Plan. 2 b. The proposed use is or will be compatible with present and future land uses of the area. Finding: The proposed expansion of the elementary school is compatible with existing medium family residential and commercial land uses in the area. c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. Finding: The elementary school is an existing use on the property. The proposed expansion will conform to all performance standards set forth in the Zoning Ordinance given compliance with the approved conditional use permit amendment. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The proposed expansion to the elementary school can be adequately served with existing public services. e. Traffic generation by the proposed use is within capabilities of streets serving the property. Finding: The existing street (Dodd Boulevard) that serves the property can accommodate the proposed expansion, given the changes proposed with the redesign and expansion of the existing access. 5. SSIITTEE CCOONNDDIITTIIOONNSS The site contains the existing Lake Marion Elementary School, a 77,600 square-foot building with a parking lot northeast of the school, a lot for buses northwest of the school, and a private drive access to a parking lot on the Lakeville North High School parcel north of the school. The western portion of the parcel contains baseball fields and playgrounds. Existing access to the school is from Dodd Boulevard across from Itea Way. Parking lot improvements include additional parking stalls and access improvements. Existing access has one lane of traffic entering the site and two lanes of traffic with full access exiting the site. The proposed access has one lane of traffic entering the site then widens to allow for an additional lane for car stacking, the proposed exit restricts turning movement to right-turn only. The applicant is proposing additional stalls on the private drive to the parcel to the north. The parking lot and site access improvements were discussed with City and County Transportation Staff. The School District and Elementary School representatives raised concerns to City staff regarding safety entering and exiting the school property and vehicle queuing along Dodd Boulevard. Alternative accesses were considered and discussed with City and County staff. To address the District’s concerns, City staff recommended construction of a single lane drive connection to the Ames Arena parking lot west of the school, creating a separate entrance for the school via Ipava Avenue. City staff presented this recommendation to remove conflicts between entering/exiting vehicles during pick up and drop off times and to reduce vehicle queues along Dodd Boulevard. The School District chose not to explore the option. SSTTRREEEETT AANNDD SSUUBBDDIIVVIISSIIOONN LLAAYYOOUUTT Dodd Boulevard (CSAH 9) Lake Marion Elementary School is located west of and adjacent to Dodd Boulevard, a minor arterial County highway, as identified in the City’s Transportation Plan. The Applicant is responsible to obtain a right-of-way permit from Dakota County prior to construction of the access modifications in the Dodd Boulevard right-of-way. Ideal Way Lake Marion Elementary School is located north of and adjacent to Ideal Way, a local roadway as identified in the City’s Transportation Plan. Access is not permitted to Ideal Way from the site. CCOONNSSTTRRUUCCTTIIOONN AACCCCEESSSS Construction traffic access for grading and site construction shall be from a rock construction entrance at the existing egress to Dodd Boulevard at the location of the existing access. Wastewater is conveyed to the Empire Wastewater Treatment Facility. The Lake Marion Elementary School improvements include a proposed 6-inch privately owned and maintained sanitary sewer service to serve the proposed building addition. The proposed sanitary sewer will connect to the school’s existing privately owned and maintained sanitary sewer system. WWAATTEERRMMAAIINN An existing 8-inch privately owned and maintained watermain extends to the site from public watermain along Dodd Boulevard. The watermain will be relocated with the improvements as the proposed building addition is located above the existing watermain. The existing watermain will serve the proposed building addition. DDRRAAIINNAAGGEE AANNDD GGRRAADDIINNGG Lake Marion Elementary School is located within subdistrict SC-56 of the South Creek stormwater district as identified in the City’s Water Resources Management Plan. Construction of the Lake Marion Elementary School building addition and parking lot improvements includes the construction of privately owned and maintained storm sewer and stormwater management basins. The private stormwater management basins will provide rate control and water quality/volume reduction of the stormwater runoff generated from the proposed building addition. A Stormwater Maintenance Agreement and Site Improvement Performance Agreement will be required prior to the issuance of a building permit. The final grading plan shall identify all fill areas in which the building footing will be placed on fill material. The grading specifications shall also indicate that all embankments meet FHA/HUD 79G specifications. The Applicant shall certify to the City that buildings with footings placed on fill material are appropriately constructed. SSTTOORRMM SSEEWWEERR Privately owned and maintained storm sewer will be constructed with the Lake Marion Elementary School. Private storm sewer constructed will convey runoff to privately owned and maintained stormwater management basins. The proposed privately owned and maintained stormwater basin on the northeast portion of the property will outlet to the existing regional basin on the property north of the site. The proposed privately owned and maintained stormwater basin on the southeast portion of the site will outlet to the existing storm sewer system along Dodd Boulevard (CSAH 9). FEMA FLOODPLAIN ANALYSIS Lake Marion Elementary School is shown on the Flood Insurance Rate Map (FIRM) as Zone X by the Federal Emergency Management Agency (FEMA). Based on this designation, there are no areas on the property located within a Special Flood Hazard Area (SFHA), as determined by FEMA. EERROOSSIIOONN CCOONNTTRROOLL The Applicant is responsible for obtaining a MPCA Construction Permit for the site as well as developing a SWPPP for the site prior to issuance of a building permit. The permit requires that all erosion and sediment BMPs be clearly outlined in a SWPPP. Changes made throughout construction must be documented in the SWPPP. All basin slopes and slopes adjacent to wetlands must have erosion control blanket installed. The Applicant is responsible for installing and maintaining erosion control measures per the plans. Additional erosion control measures may be required during construction as deemed necessary by City staff. Any additional measures required shall be installed and maintained by the Applicant. SECURITIES The Applicant shall provide a Letter of Credit as security for the improvements with the Conditional Use Permit relating to Lake Marion Elementary School. The security is required prior to the issuance of a Building Permit.
