ORDINANCE AMENDING TITLE 1, CHAPTERS 7 AND 8 OF THE LAKEVILLE CITY
CODE REPEALING REQUIREMENTS RELATED TO CONSTABLES AND
REGISTRATION OF VOTERS AND ADDING A FILING FEE FOR AN APPLICATION OF
CANDIDACY FOR MUNICIPAL OFFICE
Proposed Action
Staff recommends adoption of the following motion: Move to approve an Ordinance amending
Title 1, Chapters 7 and 8 of the Lakeville City Code Repealing Requirements Related to Constables
and Registration of Voters and Adding a Filing Fee for an Application of Candidacy for Municipal
Office.
Overview
City Council directed staff to review the costs associated with assembling and distributing
application packets, publication of information, etc. for candidates filing for municipal office. The
costs were estimated at about $65/candidate. State Statute limits the filing fee at $40.
The City Attorney prepared the attached ordinance amending Title 1, Chapters 7 and 8 and adding
a filing fee of $40 for an application of candidacy for municipal office.

DAKOTA COUNTY, MINNESOTA
AN ORDINANCE AMENDING TITLE 1, CHAPTERS 7 AND 8 OF THE LAKEVILLE
CITY CODE REPEALING REQUIREMENTS RELATED TO CONSTABLES AND
REGISTRATION OF VOTERS AND ADDING A FILING FEE FOR AN
AFFIDAVIT OF CANDIDACY FOR MUNICIPAL OFFICE
THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS:
SECTION 1. The following section of Title 1, Chapter 7 of the Lakeville City Code is
hereby repealed in its entirety:
1-7-3: DUTIES OF CONSTABLES ASSIGNED
The chief of police and the police officers employed by this city are hereby designated as process
officers, with all powers and duties as heretofore granted and/or held by the city constables2. (Ord.
36, sec. 2, 12-5-1968)
SECTION 2. The following section of Title 1, Chapter 8 of the Lakeville City Code is
hereby repealed in its entirety:
1-8-3: REGISTRATION OF QUALIFIED VOTERS
A. Registration System Adopted: The system for the permanent registration of voters provided for
by State law2 is hereby adopted as the system for the permanent registration of voters in the
City. (Ord. 37, sec. 1, 4-14-1969)
B. Voters Must Be Registered: No person shall be permitted to vote at any election held in the City
unless he/she shall have registered as provided in Minnesota Statutes3. (Ord. 37, sec. 2, 4-14-
1969)
SECTION 3. The Lakeville City Code is amended to add a new Section 1-8-4 to read as
follows:
1-8-4: COUNCIL CANDIDACY FILING FEE.
A filing fee of $40 shall be submitted at the time of filing an affidavit for candidacy for municipal
office in accordance with Minnesota state law.
SECTION 4. This ordinance shall be effective immediately upon its passage and
publication.
ADOPTED this 3rd day of February 2020 by the City Council of the City of Lakeville,
Minnesota.
