Local No. 128 for Police Officers Proposed Action Staff recommends adoption of the following motion: Move to approve the labor agreement between the City of Lakeville and Law Enforcement Labor Services, Inc. Local No. 128 for 2020 and 2021. Overview A two-year agreement has been reached with the Police Officer’s union which will take effect on January 1, 2020 and continue through December 31, 2021. This agreement will provide a 3% increase to wages effective January 1, 2020; a 3% increase effective January 1, 2021; and a .5% increase effective December 13, 2021. In 2018, Springsted, Inc. completed a job classification and compensation study. Police Officer positions were classified a Grade 10 and Police Investigator positions were classified a Grade 11. Employees will begin transitioning to the new pay plan in 2020. Step increases will be tied to an annual performance evaluation. Police Officers assigned to the Street Crimes Unit will receive an additional 3% due to the extra caseloads that are above and beyond regular patrol duties. The agreement also provides health insurance rates identical to all other city employees. Additional items include a cap on tuition reimbursement and a requirement to request funds during the budget cycle; a cap of 960 sick leave hours. Beginning January 1, 2021, employees with sick leave in excess of 960 hours, 55% of the excess hours will be converted to contributions to a post-retirement health care savings plan. The Personnel Committee has also reviewed the agreement and is recommending its approval. Primary Issues to Consider • How does the proposed changes provide improvements for employees and the city? The average wage increase for comparable cities is 3% per year. The tuition reimbursement changes and sick leave cap assists in the budgeting process and limits future financial liabilities for the city. An evaluation that meets or exceeds an acceptable performance report would entitle the employee to progress to the next step in their position grade. 32 EXHIBIT A 33 34 EXHIBIT B 35 36 37 38 39 40 41 1 MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF LAKEVILLE AND LAW ENFORCEMENT LABOR SERVICES WHEREAS the City of Lakeville (hereinafter the City) and Law Enforcement Labor Services, Local No. 128 (hereinafter the Union) are parties to a 2020 – 2021 collective bargaining agreement covering the City’s police officers; and WHEREAS, the City’s police officer bargaining unit may have a police officer assigned by the City to the Dakota County Drug Task Force (DTF); and WHEREAS, police officers assigned to the DTF may be assigned to a Team Lead in the DTF; and WHEREAS, the DTF provides compensation to the City for the Team Lead function; and NOW THEREFORE, the City and the Union agree as follows for the term of this Agreement: 1. Compensation. Effective with the execution of the agreement. A differential equal to the amount paid by the DTF to the City for a City employee’s assignment as a DTF Team Lead will be paid to the individual assigned on a monthly basis subject to withholding applicable to wages. 2. This payment will continue until the earlier of: a) such time as a Lakeville bargaining unit member is no longer assigned as a DTF Team Lead; b) said amount is no longer paid by the DTF; or c) December 31, 2021 or such later time as may be mutually agreed to by the parties. 3. This Agreement will remain in place for the duration of the 2020 – 2021 collective bargaining agreement. 4. This Memorandum of Agreement will not operate as a waiver of City or Union rights. CITY OF LAKEVILLE LAW ENFORCEMENT LABOR SERVICES LOCAL NO. 128 ____________________________ ______________________________ City Administrator Business Agent ____________________________ Mayor ____________________________ City Clerk Memorandum of Understanding Between City of Lakeville and L.E.L.S. Local #128 WHEREAS, the City of Lakeville and Law Enforcement Labor Services, Local No. 128 are parties to a 2020 – 2021 collective bargaining agreement covering the City’s Police Officers; and WHEREAS, Article 20 provides for a uniform allowance payable through payroll subject to State and Federal taxes. WHEREAS, according the IRS, uniforms items substantiated qualifies for exclusion from income; and NOW, THEREFORE, the parties agree to the following: 1. Uniform Allowance will be processed through Accounts Payable by the 31st of January. 2. Employees will provide receipts for qualifying uniform items to payroll by December 1st to substantiate the expense. Clothing cannot be suitable for everyday wear (i.e. jeans, suit jacket, dress pants, etc.). 3. Uniform items substantiated will be excludable as income. 4. If expenses do not qualify as a deductible expense or receipts are not provided by December 1st, then the uniform allowance will be treated as a taxable fringe benefit and is subject to income, social security and Medicare taxes. 5.
