APPROVAL OF A PROFESSIONAL SERVICES AGREEMENT AMENDMENT WITH
MIDWEST SAFETY COUNSELORS, INC. FOR SAFETY TRAINING AND PROGRAM
SUPPORT TO THE REGIONAL SAFETY GROUP
Proposed Action
Staff recommends adoption of the following motion: Move to approve a professional services
agreement amendment with Midwest Safety Counselors, Inc. for safety training and program
support to the Regional Safety Group.
Overview
Under a Joint Powers Agreement approved by the Lakeville City Council on December 18, 2017,
the cities of Lakeville, Farmington, and Elko New Market formed a regional safety group to support
and improve the safety programs in each City. The group’s objective is to develop and maintain
safety programs oriented to municipal and employee needs through focused training and the
development of standardized safety manuals, processes, procedures, and programs.
Lakeville, representing the Regional Safety Group, entered into the initial professional services
agreement with Midwest Safety Counselors, Inc. on March 19, 2018. The term of the contract was
24 months with the potential for two 12-month extensions. At a meeting of the group on
December 4, 2019, it was decided to exercise both extensions.
Midwest Safety Counselors, Inc. has agreed to renew the contract for an additional 24-months with
no change in rates. Both Elko New Market and Farmington have approved the contract
amendment with Midwest Safety Counselors, Inc. Staff recommends approval of the professional
services agreement amendment.
Primary Issues to Consider
• How is training and program support funded? Each City funds its portion on the contract for
training and support. Each City is billed individually for training and program support costs.

AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT
AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT (“Amendment”) made
this 18th day of February 2020, by and between the CITY OF LAKEVILLE, a Minnesota municipal
corporation (“City”), and the undersigned provider of services MIDWEST SAFETY
COUNSELORS, INC., a Minnesota corporation (“Consultant”).
Recitals
A. The parties previously entered into a Professional Services Agreement for safety
training and program support dated March 19, 2018, (the “Agreement”).
B. The parties desire to extend the term of the Agreement for an additional 24 months.
NOW, THEREFORE, IN CONSIDERATION OF THEIR MUTUAL COVENANTS,
THE PARTIES AGREE AS FOLLOWS:
1. Incorporation by Reference. Except as modified herein, the terms of the Agreement
continue in full force and effect.
2. Amendment to Paragraph 16, Term. Paragraph 16 of the Agreement is amended to
read as follows:
16. TERM. This Agreement shall terminate on March 18, 2022.
