Overview At their February 18, 2020 meeting, the City Council tabled action on the Lake Marion Elementary School conditional use permit amendment for an addition to the existing building located at 19875 Dodd Boulevard to address traffic safety concerns due to the lack of a second access to the site. Staff has discussed partnering with ISD 194 and Dakota County on a traffic study to evaluate traffic flow and impacts on the Lake Marion Elementary School, Lakeville North High School, and Ames Arena sites. All three governmental agencies would share in the cost of the traffic study. Two conditions pertaining to the traffic study and second access are being recommended by staff and the City Attorney and have been added to the CUP amendment form (3.f and g). Staff recommends approval of the Lake Marion Elementary CUP amendment subject to the seven conditions listed in the CUP amendment form. Permit. Subject to the terms and conditions set forth herein, the City of Lakeville hereby grants an amendment to conditional use permit #89-05 to ISD #194 to allow an addition to Lake Marion Elementary School, located at 19875 Dodd Blvd. 2. Property. The permit is for the following described property in the City of Lakeville, Dakota County, Minnesota: Lot 2, Block 1, LAKEVILLE ELEMENTARY 2ND ADDITION, according to the recorded plat thereof, Dakota County, Minnesota. 3. Conditions. This conditional use permit amendment is issued subject to the following conditions: a) The site plan and building addition shall be developed in accordance with the plans approved by the City Council. b) A building permit is required prior to commencing construction of the building addition. c) The proposed building addition shall be sided with brick to match the existing building. All building materials shall meet the requirements for an institutional use in the RS-2 District. d) Lighting must comply with Section 11-16-17 of the Zoning Ordinance. Detailed fixture and photometric plans must be submitted with the Building Permit application for the proposed addition. 2 e) The building addition is subject to review by the Fire Marshal. f) Prior to issuance of a certificate of occupancy for the addition, the School District shall submit to the City a traffic study of the Lakeville North High School, Lake Marion Elementary (“LME”), and Ames Arena campus to evaluate traffic flow and impacts related to the proposed expansion of LME. g) If, upon completion of a traffic study, it is determined that a secondary access from LME is required, the School District shall submit a revised site layout showing a practical secondary access before receiving a certificate of occupancy for the addition. 4. Revocation. The City may revoke the conditional use permit amendment for cause upon determination that the conditional use permit amendment is not in conformance with the conditions of the permit or is in continued violation of the city code or other applicable regulations. 5. Expiration. This conditional use permit amendment shall expire unless the applicant commences construction of the authorized use within one year of the date of this conditional use permit amendment unless an extension is approved by the Zoning Administrator. Anderson, Mayor and by Charlene Friedges, City Clerk of the City of Lakeville, a Minnesota municipal corporation, on behalf of the corporation. __________________________ Notary Public 1 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA LAKE MARION ELEMENTARY SCHOOL CONDITIONAL USE PERMIT AMENDMENT FINDINGS OF FACT AND DECISION On February 6, 2020 the Lakeville Planning Commission met at its regularly scheduled meeting to consider the request of ISD #194 for a conditional use permit amendment to allow the construction of a building addition to Lake Marion Elementary School in the RS-2, Single Family Residential District on property located at 19875 Dodd Boulevard. The Planning Commission conducted a public hearing on the proposed conditional use permit amendment preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. The City Council hereby adopts the following: FINDINGS OF FACT 1. The property is located in Planning District No. 4 of the 2040 Comprehensive Plan, which guides the property for Public and Quasi-Public uses. 2. The property is currently zoned RS-2, Single Family Residential District. . 3. The legal description of the property is: Lot 2, Block 1, LAKEVILLE ELEMENTARY 2ND ADDITION, according to the recorded plat thereof, Dakota County, Minnesota. 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The proposed expansion of the elementary school is consistent with the policies and provisions of Planning District 4 of the Comprehensive Land Use Plan. b. The proposed use is or will be compatible with present and future land uses of the area. Finding: The proposed expansion of the elementary school is compatible with existing medium family residential and commercial land uses in the area. 2 c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. Finding: The elementary school is an existing use on the property. The proposed expansion will conform to all performance standards set forth in the Zoning Ordinance given compliance with the approved conditional use permit amendment. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The proposed expansion to the elementary school can be adequately served with existing public services. e. Traffic generation by the proposed use is within capabilities of streets serving the property. Finding: The existing street (Dodd Boulevard) that serves the property can accommodate the proposed expansion, given the changes proposed with the redesign and expansion of the existing access. 5. The planning report dated January 31, 2020 prepared by Monica Waite, Planning & Zoning Specialist, is incorporated herein. DECISION The City Council approves the Lake Marion Elementary conditional use permit amendment in the form attached thereto.
