INTRODUCTION
Representatives of ISD #194 are requesting an amendment to CUP #91-01 to allow an
expansion to the McGuire Middle School building for the construction of a gymnasium on the
east side of the existing building located at 21220 Holyoke Avenue. The proposed gymnasium
addition will be 17,345 square feet in area for a total building area of 205,050 square feet. The
subject property is zoned RM-1, Medium Density Residential District. Section 11-58-9D of
the Zoning Ordinance allows public middle schools in the RM-1 District by conditional use
permit.

PLANNING ANALYSIS
McGuire Middle School was constructed in the mid-50s to accommodate growing enrollment
in the school district and to address a lack of space in the original school building located to
the north in the area of what was recently the ISD 194 district offices. The McGuire building
housed the high school until a new high school was constructed on Kenwood Trail (now
Kenwood Middle School) in 1980.
Records of previous zoning approvals for the McGuire Middle School include the following:
• CUP 91-01 – Allowed the installation of portable temporary classrooms
• 1992 Amendment to CUP 91-01 – Additional portable temporary classrooms
• CUP 93-06 Amendment to CUP 91-01 – Expansion of the middle school building
including a new gymnasium and locker rooms and removal of the portable temporary
classroom buildings
• CUP 97-06 Amendment to CUP 91-01 – Additional portable temporary classrooms
• CUP 98-08 Amendment to CUP 91-01 – Additional portable temporary classrooms
• CUP 03-01 – Construction of additional parking spaces for McGuire and JFK
Elementary Schools
• CUP 04-07 – Installation of emergency power generator
• CUP 06-11 Amendment to CUP 91-01 – Construction of additional tennis courts
The proposed gymnasium project will include the construction of two sport courts, restrooms,
a hallway connection, storage room, utility room and a custodian room.
Surrounding Land Uses and Zoning
North –Schmitty and Sons Bus Garage (PUD) and outdoor skating rinks (RM-1)
South – Playfields and Hasse Arena (RM-1 and P/OS)
East – JFK Elementary School (RM-1)
West – Holyoke Avenue and undeveloped Schmitty and Sons parking lot
The proposed expansion was reviewed for conformance with Zoning Ordinance performance
standards as follows:
Building Setbacks. The existing building meets all setback requirements of the RM-1 District:
Front – 30 feet
Side –30 feet on the side yard (north)
Rear – Common Property Shared with JFK Elementary School (280 feet east of addition)
The proposed building addition will have the following setbacks:
Front (west) – 545 feet
Rear (east) – 615 feet
Sides – (north) 300 feet; (south) 915 feet

Building Height. The gymnasium addition will be 30 feet in height, within the maximum
allowed building height of 35 feet.
Mechanical Equipment Screening. There is additional mechanical equipment proposed with
the building addition that will be located on the roof and screened in compliance with Zoning
Ordinance requirements.
Access and Circulation. The site is accessed via an existing shared driveway with JFK
Elementary School at Holyoke Avenue and a looped (one-way) access drive in front of the
building. The property access will remain unaffected by the proposed addition.
Parking. The proposed gymnasium addition will not require the construction of additional
parking spaces. School parking requirements are based on student enrollment capacity. The
most recent building capacity project (temporary classrooms in 1998) required 168 parking
spaces. The temporary classrooms have since been removed and there are currently 196
striped parking spaces on site.
Building Elevations and Exterior Building Materials. The proposed building addition will
be sided with grey brick to match the existing building. The brick face shall be constructed
with architecturally precast concrete panels with a form liner, tooled, brick face finish to
satisfy the material requirements. The proposed building materials meet the requirements for
an institutional use in the RM-1 District.
Trash Enclosure. There is an existing, compliant trash enclosure on the northwest side of the
building.
Lighting. Downward cast exterior wall mounted light fixtures will be installed as security
lighting on the building exterior in compliance with Zoning Ordinance requirements.
Engineering Review. The Engineering Division has reviewed the plans and prepared a
memorandum dated March 13, 2020.
RECOMMENDATION
Planning Department staff recommends approval of the McGuire Middle School conditional
use permit amendment subject to the following stipulations:
1. The site plan and building addition shall be developed in accordance with the plans
approved by the City Council.
2. A building permit is required prior to commencing construction of the building
addition.

3. The proposed building addition shall be sided with brick to match the existing
building. All building materials shall meet the requirements for an institutional use in
the RM-1 District.
4. The building addition is subject to review by the Fire Marshal.
5. Lighting shall be down-cast type only and must comply with Section 11-16-17 of the
Zoning Ordinance.
6. The recommendations listed in the March 13, 2020 engineering report.

FINDINGS OF FACT AND RECOMMENDATION
On March 19, 2020 the Lakeville Planning Commission met to consider the
application of ISD #194 for a conditional use permit amendment to allow the
construction of a gymnasium addition to McGuire Middle School in the RM-1, Medium
Density Residential District. The Planning Commission conducted a public hearing on
the proposed conditional use permit amendment preceded by published and mailed
notice. The applicant was present and the Planning Commission heard testimony from all
interested persons wishing to speak.
FINDINGS OF FACT
1. The property is located in Planning District No. 6 of the 2040 Comprehensive
Plan which guides the property for Public and Quasi-Public uses.
2. The property is currently zoned RM-1, Medium Density Residential District.

3. The legal description of the property is:

4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a
conditional use permit may not be issued unless certain criteria are satisfied. The
criteria and our findings regarding them are:
a. The proposed action has been considered in relation to the specific policies and
provisions of and has been found to be consistent with the official City
Comprehensive Plan.
Finding: The proposed expansion of the middle school is consistent with the policies
and provisions of Planning District 6 of the Comprehensive Land Use Plan.

b. The proposed use is or will be compatible with present and future land uses of
the area.
Finding: The proposed expansion of the middle school is compatible with existing
land uses in the area.
c. The proposed use conforms with all performance standards contained in the
Zoning Ordinance.
Finding: The middle school is an existing use on the property. The proposed
expansion will conform to all performance standards set forth in the Zoning
Ordinance given compliance with the approved conditional use permit amendment.
d. The proposed use can be accommodated with existing public services and will
not overburden the City’s service capacity.
Finding: The proposed expansion to the middle school can be adequately served
with existing public services.
e. Traffic generation by the proposed use is within capabilities of streets serving
the property.
Finding: The existing street (Holyoke Avenue) that serves the property can

courts, on the south of the site there is a track, football field, baseball fields, and soccer fields.

McGuire Middle School is located within subdistrict SC-048 and SC-081 of the South Creek
drainage district as identified in the City’s Water Resources Management Plan.
Development of the site will include the construction of one privately owned and maintained
stormwater management basin. The private stormwater basin will be located on the northern
end of the parcel and will treat runoff generated from the existing site.
Prior to the issuance of a building permit the Applicant shall sign a private stormwater
maintenance agreement for the stormwater management basin and easement over the
basin. The basin will provide water quality treatment, volume reduction and rate control of
the stormwater runoff generated from the site. Stormwater basin designs must be reviewed
by the City and be consistent with City requirements prior to the issuance of a building
permit.
The McGuire Middle School building addition and improvements include more than one acre
of site disturbance. A National Pollution Discharge Elimination System General Stormwater
Permit for construction activity is required from the Minnesota Pollution Control Agency for
areas exceeding one acre being disturbed by grading. A copy of the Notice of Stormwater
Permit Coverage must be submitted to the City upon receipt from the MPCA.
SSTTOORRMM SSEEWWEERR
Privately owned and maintained storm sewer will be constructed with the McGuire Middle
School building addition. Private storm sewer to be constructed will connect to existing
privately owned and maintained storm sewer to convey roof runoff. The proposed privately
owned and maintained stormwater management basin on the north portion of the property
will outlet to the South Creek north of the site.
Final locations and sizes of all storm sewer facilities will be reviewed by City staff with the final
construction plans.
FEMA FLOODPLAIN ANALYSIS
McGuire Middle School is shown on the Flood Insurance Rate Map (FIRM) as Zone X by the
Federal Emergency Management Agency (FEMA). Based on this designation, there are no
areas on the property located within a Special Flood Hazard Area (SFHA), as determined by
FEMA.

The Applicant is responsible for obtaining a MPCA Construction Permit for the site as well as
developing a Stormwater Pollution Prevention Plan (SWPPP) that meets all the requirements
of the MPCA prior to issuance of a building permit. Additional erosion control measures may
be required during construction as deemed necessary by City staff. All basin slopes and slopes
adjacent to wetlands must have redundant perimeter control. Any additional measures
required shall be installed and maintained by the Applicant. A copy of the MPCA Construction
Permit must be submitted to the City prior to land disturbance.

Engineering recommends approval of the site plan, grading plan, erosion control plan and
utility plan for McGuire Middle School, subject to the requirements within this report
including:
1. The Applicant shall submit as-built record drawings of the improvements
including certification by a registered land surveyor or engineer following the
completion of this project and prior to the issuance of a Certificate of
Occupancy.
2. A Certificate of Occupancy will not be issued until final restoration has been
completed.
3. A stormwater maintenance agreement and easement is required over the
proposed stormwater management area prior to the issuance of a building
permit.
