HomeMy WebLinkAboutItem 09 Date: Item No. RESOLUTION PROVIDING FOR ORDER OF SUCCESSION FOR ACTING MAYOR Proposed Action Staff recommends adoption of the following motion: Move to approve resolution approving order of succession for acting mayor. Overview Pursuant to state statutes, the city council annually appoints a member to serve as acting mayor in the case of absence of the mayor. The city attorney is recommending that the city council formally approve a process to name a replacement acting mayor in the circumstance that both the mayor and acting mayor are unable to fulfill their duties. Primary Issues to Consider How would the process work? In the case of the acting mayor not being available, the councilmember with the most tenure would automatically become the acting mayor until that designation was no longer necessary. In the case of a tie (if two members were elected at the same time), the older of the members would be named acting mayor. Financial Impact: $ Budgeted: Y☐ N☐ Source: Related Documents: (CIP, ERP, etc.): Envision Lakeville Community Values: Good Value for Public Services Report Completed by: Justin Miller, City Administrator April 6, 2020 N/A RESOLUTION NO. 20-40 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA A RESOLUTION ORDER OF SUCCESSION FOR ACTING MAYOR WHEREAS, pursuant to Minnesota Statue Section 412.121, and powers otherwise allowed by law, the Council did meet and confer during a regular meeting to choose an acting mayor to serve during the disability or absence of the Mayor of the City of Lakeville. WHEREAS, on January 6, 2020 the Lakeville City Council adopted a motion appointing Councilmember Hellier as Acting Mayor. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LAKEVILLE, MINNESOTA: 1. The individual members of the city council are hereby appointed to serve as acting mayor during the disability or absence from the city of the Mayor or annually appointed Acting Mayor. 2. The individual members of the City Council shall serve as acting mayor in successive order of their seniority in office. a. Seniority shall be calculated from the earliest date of continuous service beginning on the date each council member assumed office. b. In the event that more than one council member assumed office on the same day, the seniority of those council members shall be in age sequence beginning with the eldest. 3. Once an acting mayor enters office they shall serve as acting mayor until such time as any of the following events occur: a. Any disability or absence of the Mayor is resolved, then the Mayor shall resume active duties; b. Any disability or absence of the annually appointed Acting Mayor is resolved, then the annually appointed Acting Mayor shall resume active duties; c. Said acting mayor becomes disabled or is absent from the City, then the office of acting mayor shall vest with the most senior council member available at that time; or d. The vacant office of Mayor is filled in the manner set forth by Minnesota Statute Section 412.02. 4. This Resolution shall renew annually until superseded. 5. This Resolution shall be effective immediately upon approval by vote of the City Council. Adopted by the City Council this 6th day of April 2020 ____________________________________ Douglas P.
