HomeMy WebLinkAboutItem 06.i Date: May 18, 2020 Item No. AGREEMENTS WITH EUREKA CONSTRUCTION, NEW MARKET BANK AND THREADS & INKS FOR DRIVEWAY APRON CONSTRUCTION ON ICENIC TRAIL Proposed Action Staff recommends adoption of the following motion: Move to approve Agreements with Eureka Construction, New Market Bank and Threads & Inks for driveway apron construction on Icenic Trail. Overview The County State Aid Highway (CSAH) 50 (Kenwood Trail) Reconstruction project, City Project 14-10, included public improvements along Icenic Trail. These improvements included new concrete curb and gutter and sidewalk along Icenic Trail that modified the existing driveway approaches to Eureka Construction, New Market Bank and Threads & Inks. The business owners are requesting changes to the driveway approaches. The attached Agreements provide the scope of work, cost and schedule for completing the work. The City is the lead agency; therefore, total project cost (City, County and business owner share) is reflected in this memo. The estimated project cost is $31,075. The City, County and business owners will share in the project costs consistent with the terms of these Agreements and the existing Joint Powers Agreement; the City’s estimated net cost is $10,358. Primary Issues to Consider • Construction is anticipated to be substantially complete by August 31, 2020. The business owners will own and maintain the driveway approaches. Supporting Information • Agreements Financial Impact: $31,075 Budgeted: Y☒ N☐ Source: Pavement Management Envision Lakeville Community Values: Good Value for Public Services Report Completed by: Zach Johnson, City Engineer 1 210052v1 AGREEMENT This agreement (the “Agreement”) is made and entered into this 18th day of May 2020, by and among T & I PROPERTIES, LLC, a Minnesota limited liability company (“Owner”), and the CITY OF LAKEVILLE, a Minnesota municipal corporation (“City”). WHEREAS, Owner is the fee owner of property with a street address of 20137 Icenic Trail, Lakeville Minnesota, 55044, legally described as: Lot 4, Block 2, Viking Square, Dakota County, Minnesota according to the recorded plat thereof (“Property”); and WHEREAS, City Project No 14-10 (“Project”) involved the installation of curb, gutter and sidewalk that modified the driveway approach (“Driveway”) to the Property; and WHEREAS, the Owner has requested a modification of the Driveways to their Property; and WHEREAS, the City has agreed to the modification in accordance with the terms of this Agreement; NOW THEREFORE, in consideration of the mutual covenants herein, and other good and valuable consideration, the sufficiency of which is hereby acknowledged, the parties agree as follows: 1. DRIVEWAY RECONSTRUCTION. The City will reconstruct the sidewalk and Driveway for the Property in accordance with the plan attached hereto as Exhibit A (“Work”) on or before August 31, 2020. 2. OWNER RESPONSIBILITIES. Owner agrees to: a. Provide a right-of-entry to the City, its employees, contractors and agents for the Work in a form approved by the City; and b. Owner agrees to reimburse the City for 33.33% of the costs for the Work, estimated in the amount of $2,750.00. The City shall bill Owner for the actual costs upon completion of the Work. Owner shall reimburse the City within 30 days of receipt of the invoice for the Work. 3. MAINTENANCE.
