HomeMy WebLinkAboutItem 06.b CITY OF LAKEVILLE CITY COUNCIL MEETING MINUTES June 1, 2020 Mayor Anderson called the meeting to order at 6:30 p.m. in the Council Chambers at City Hall. After comments relating to COVID-19 and the recent protests in the Twin Cities, a moment of silence was observed and the Pledge of Allegiance to the flag was given. Members Present: Mayor Anderson, Council Members Volk, Wheeler, Hellier, Lee Staff Present: Justin Miller, City Administrator; Andrea McDowell Poehler, City Attorney; Jeff Long, Police Chief; Daryl Morey, Planning Director; Charlene Friedges, City Clerk 3. Citizen Comments: None 4. Additional Agenda Information: None 5. Presentations/Introductions: Chief Long presented the Police Department quarterly report. 6. Consent Agenda Motion was made by Lee, seconded by Hellier, to approve the following: a. Check register review b. Minutes of the May 18, 2020 City Council meeting c. ALF Ambulance 2021 budget d. Extension of Berean Baptist Church and Berres Ridge 6th Addition final plats e. Contract with B & B Commercial Coating for hydrant painting f. Encroachment Agreement with Forestar (USA) Real Estate Group, Inc. for private improvements in public easements Roll call was taken on the motion. Ayes – Volk, Wheeler, Anderson, Hellier, Lee 7. The Preserve Jeremy LeBeau with Progressive LLC requested Council approval of The Preserve preliminary plat, consisting of 89 single-family lots on 82 acres of property located east of Kenwood Trail and south of 185th Street W. This project will complete the extension of 190th Street to County Road 50 and extend several local streets from adjacent neighborhoods. City Council Meeting Minutes, June 1, 2020 Page 2 Planning Director Daryl Morey presented the planning report for The Preserve. In conjunction with the preliminary plat, the developer is requesting a rezoning of the property from RS-2 to RS-3 and a lot width variance on three buffer yard lots adjacent to 190th Street. The rezoning to RS-3 is compatible with the existing residential neighborhoods. The variance request is due to the significant challenges with the existing topography and wetlands. The preliminary plat includes five outlots, large areas of wetlands, and greenway corridor trail connections. All five outlots (37 acres total) will be deeded to the City with the various phases of the final plats. The extension of 190th Street is consistent with the City’s transportation plan. Mr. Morey addressed some of the concerns raised by the area residents at the public hearing, most of which related to street connections, lot sizes and soil contamination. He also addressed a request from a property owner regarding project phasing, specifically related to the extension of Ixonia Avenue and connection of his property to city sewer and water. Motion was made by Hellier, seconded by Wheeler, to approve the following: • Resolution No. 20-57 approving the preliminary plat of The Preserve • Findings of fact and Ordinance No. 1030 rezoning property from RS-2 to RS -3 • Findings of fact and variance for buffer yard lot width requirements Roll call was taken on the motion. Ayes – Wheeler, Anderson, Hellier, Lee, Volk 8. Ordinance Amendment – City Code Titles 4, 10 and 11 Consulting Planner Daniel Licht presented an ordinance amending Titles 4, 10 and 11 of the City Code, which fully implements the approved 2040 Lakeville Comprehensive Plan. He explained the most significant changes being proposed, which relate to the creation of three new zoning districts (RM-3, M-1 and M-2) corresponding to the Corridor Mixed Use land designation in the 2040 Land Use Plan. Other sections of the ordinance being updated relate to revised standards for residential development, expanded provisions for solar, electric vehicles and community gardens, increased sign allowances for industrial businesses, changes implementing the Downtown Development Guide and update of the City’s zoning map. Steve Devney, 5810 212th Street W., asked the council to consider reducing the minimum garage size requirements for property on the south side of 179th Street, east of Cedar Avenue, given its proximity to the park-and-ride facility. Mr. Licht stated the property is being zoned RM-2, which is consistent with the zoning on the north side of 179th Street. There would be potential to rezone this parcel from RM-2 to RM-3 when it develops in the future, which would provide additional flexibility in terms of garage size. City Council Meeting Minutes, June 1, 2020 Page 3 Motion was made by Hellier, seconded by Wheeler, to adopt Ordinance No. 1031 amending Titles 4, 10 and 11 of the Lakeville City Code and Summary Ordinance No. 1031 for publication. COVID-19 City Operation Update City Administrator Miller stated City facilities are slowly beginning to re-open, based on State guidelines. All City services continue to be provided. 10.
