Memorandum of Understanding between City of Lakeville
and Law Enforcement Labor Services, Local No. 128 (Police Officers)
Proposed Action
Staff recommends adoption of the following motion: Move to approve the Memorandum of
Understanding between Law Enforcement Labor Services, Local No. 128 (Police Officers) and
the City of Lakeville.
Overview
On April 10, 2020 the Police Department implemented an emergency schedule to respond to the
COVID-19 pandemic and temporarily restricted vacation use for Police Officers for three
months. As a result of vacation leave restriction and staff shortages, several Lieutenants may be in
a position of losing their accrued time off on December 31, 2020.
LELS union members submitted a proposal to be allowed to cash out up to a maximum of 40
hours of vacation time and carry over up to 40 hours of vacation time into 2021. The carried over
hours would be forfeited if not used by March 31, 2021. The Personnel Committee reviewed their
proposal and is recommending its approval. Staff will see if the vacation cash out is an eligible
expense through the CARES Act.
Primary Issues to Consider
• Approving the MOU will allow the Police Department to continue to effectively
manage shifts and time off requests while providing safe coverage for the
community.

Memorandum of Agreement
Between the City of Lakeville
And
Law Enforcement Labor Services, Inc. Local 128
WHEREAS the City of Lakeville (hereinafter the City) and Law Enforcement Labor
Services, Local No. 128 (hereinafter the Union) are parties to a 2020-2021 collective bargaining
agreement covering the City’s Police Officers; and
WHEREAS, on April 10, 2020 the City of Lakeville Police Department implemented an
emergency schedule to respond to the COVID-19 pandemic. Vacation leave use was temporary
restricted.
WHEREAS, as a result of vacation leave being restricted, some Police Officers may be in
a position of losing their accrued time off on December 31, 2020.
NOW, THEREFORE, the parties agree that the members of this bargaining unit will be
permitted to the following:
1. Police officers with Vacation Leave accruals in excess of their carry over limit on October
19, 2020, will be able to “cash out” up to a maximum of 40 hours. Vacation hours will be
cashed out at base pay rate only (does not include longevity pay, supplemental pay and/or
additional pay). This vacation leave cash out must be requested by the Officer in writing to
the Human Resources Manager no later than October 26, 2020. Vacation leave will be paid
no later than November 6, 2020; and
2. Police officers with Vacation Leave accruals in excess of their carry over limit on December
31, 2020, will be allowed to carryover a maximum of 40 hours of unused vacation time into
2021. This carryover will occur pursuant to this Memorandum without any required action by
the Officer. The carryover hours would need to be used no later than March 31, 2021. Any
remaining vacation hours of this carried over balance would be forfeited if not used by
March 31, 2021.
3. This Memorandum of Agreement is entered into due to a pandemic and unique and unusual
circumstance and will not operate as a waiver of Employer or Union rights and will not be
used to or create precedent regarding a past practice, or as an aid in contract interpretation.
