PLANNING COMMISSION MEETING MINUTES
August 6, 2020
Chair Kaluza called the meeting to order at 6:00 p.m. in the Council Chambers at City
Hall. The Pledge of Allegiance to the flag was given.
Members Present: Chair Pat Kaluza, Vice Chair Jeff Witte, Karl Drotning, Jason
Swenson, Brooks Lillehei, Jenna Majorowicz, Christine Zimmer, Ex-officio member Thor
Howe
Members Absent: None
Staff Present: Frank Dempsey, Associate Planner; Kris Jenson, Associate Planner;
Penny Brevig, Recording Secretary
3. Approval of the Meeting Minutes
The July 9, 2020 Planning Commission meeting minutes and July 9, 2020 Planning
Commission work session minutes were approved as presented.
4. Announcements
Mr. Dempsey introduced and welcomed the Planning Commission’s new ex-officio
member Thor Howe.
Mr. Dempsey reminded the Planning Commission of the work session immediately
following tonight’s meeting, which will be held in the Council Chambers for social
distancing purposes.
Chair Kaluza welcomed ex-officio member Thor Howe.
Chair Kaluza stated that he will abstain from the Agenda Item 5 discussion and vote
due to his association with the Metropolitan Airport Commission.
5. Metropolitan Airport Commission
Chair Kaluza opened the public hearing to consider the application of the Metropolitan
Airport Commission for the following, located at 8140 – 220th Street in the Airlake
Airport: 1. Conditional use permit to allow a liquid fuel storage tank in the I-2, General
Industrial District; and 2. Variance for front yard setback to the 220th Street roadway
easement.
Lindsay Reidt, Aviation Planning & Design for SEH, presented a brief overview of the
project. Ms. Reidt reviewed the options of where the fuel tank could be constructed
and why MAC chose the current proposed location.

Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey
stated that the Metropolitan Airports Commission (MAC) is requesting a conditional
use permit (CUP) for a 2,500 square foot aboveground fuel storage tank at Airlake
Airport to serve airport maintenance vehicles and equipment. MAC is also requesting
approval of a variance to allow the aboveground fuel storage tank to be set back 30
feet from the edge of the 200th Street roadway easement rather than 40 feet as
required in the I-2 District.
Mr. Dempsey indicated that Planning Department staff will consider a separate airport
zoning district that will include performance standards such as setbacks and
architectural requirements as well as regulation of ancillary airport uses such as
aircraft hangers and fuel storage tanks with the next annual Zoning Ordinance Update.
Mr. Dempsey indicated that installation of a 2,500-gallon aboveground fuel storage
tank will replace the existing tank located east of the maintenance building and just
south of 220th Street. The fueling system controls will be located underground and
controlled from inside the maintenance building. Mr. Dempsey stated that fuel delivery
vehicles will enter the site from 220th Street, unload, then drive around the building
and back onto 220th Street.
Mr. Dempsey stated that removal of the existing underground fuel storage tank will be
an improvement to possible environmental impacts including the ability to detect fuel
leaks originating from the aboveground tank.
Mr. Dempsey reviewed the street access and explained that when sanitary sewer was
installed in 2003, MAC agreed to dedicate a roadway, drainage and utility easement
on and adjacent to 220th Street as part of a sewer extension project. MAC did not
record the easement at that time but has committed to doing so with approval of the
proposed CUP and variance. Official recording of the easement will be required as a
stipulation of the CUP.
Mr. Dempsey stated that the Airlake Airport site plan indicates various restricted areas
where the fuel storage tank may not be located due to aircraft flight safety. The
location of the restricted areas and the location of the 220th Street easement does not
allow for flexibility to comply with I-2 District setback requirements. MAC is requesting
a 10-foot variance from the 40-foot front yard setback requirements to allow a 30-foot
front yard setback for the fuel storage tanks.
Mr. Dempsey reviewed the variance criteria that must be met according to the Zoning
Ordinance, which are described in detail in the July 30, 2020 planning report.
Planning Department staff finds that MAC meets the established criteria for the CUP
and variance applications, and the practical difficulty in support for the variance
application, and recommends approval of the Metropolitan Airport CUP and variance,
subject to the nine stipulations listed in the July 30, 2020 planning report and adoption
of the Findings of Fact dated August 6, 2020.
Chair Kaluza opened the hearing to the public for comment.

There were no comments from the audience.
Motion was made by Drotning, seconded by Lillehei to close the public hearing at
6:14 p.m.
Voice vote was taken on the motion. Ayes - unanimous
Chair Kaluza asked for comments from the Planning Commission. Discussion points
included:
• Confirmed that no additional traffic will be created due to the aboveground fuel
storage tank.
• There will be bollards constructed around the aboveground fuel storage tank
for security.
• Commissioner Lillehei indicated that he is comfortable with the variance
request and the aboveground fuel storage tank makes sense.
• Commissioner Drotning agreed with Commissioner Lillehei. He felt that by
approving the CUP, issues such as environmental, landscape screening, and
elimination of non-conformities on the subject site can be addressed.
Motion was made by Lillehei, seconded by Zimmer to recommend to City Council
approval of the Metropolitan Airport Commission conditional use permit to allow a
liquid storage tank in the I-2, General Industrial District and variance for front yard
setback to the 220th Street roadway easement, located at 8140 – 220th Street in Airlake
Airport, and adoption of the Findings of Fact dated August 6, 2020, subject to the
following stipulations:
1. The site shall be developed in accordance with plans approved by the City Council
and the engineering memorandum dated July 29, 2020.
2. The Metropolitan Airports Commission shall record the 220th Street roadway
easement prior to the issuance of a building permit for the aboveground fuel storage
tank.
3. The aboveground fuel storage tank shall be set back a minimum of 30 feet from the
220th Street roadway easement.
4. Fuel delivery vehicles shall not back into the property or back onto 220th Street.
5. The driveway from 220th Street shall be paved between 220th Street and the
aboveground fuel storage tank and the existing airport paved surface south of the
tank location. All drive surfaces shall be paved with bituminous or concrete.
6. Landscape screening of the aboveground fuel storage tank shall be included in
accordance with Zoning Ordinance requirements. MAC shall submit a landscape
screening plan for the north side of the aboveground fuel storage tank between the
tank fence and 220th Street prior to City Council consideration of the conditional use
permit and variance.
7. All building and required permits for the aboveground fuel storage tank shall be
obtained prior to installation.
8. A fence permit shall be required prior to installation of the security fence around the
aboveground fuel storage tank.

9. The lot including the maintenance building and the lot to the west shall be combined
into a single lot in compliance with Dakota County requirements prior to the
issuance of a building permit for the aboveground fuel storage tank.

There being no further business, the meeting was adjourned at 6:17 p.m. The
Planning Commission went into their scheduled work session.
