HomeMy WebLinkAboutItem 06.u Date: Item No. RAVEN LAKE THIRD ADDITION ACCESS EASEMENT AGREEMENT Proposed Action Planning Department staff recommends adoption of the following motion: Move to approve an access easement agreement for Lot 2, Block 1, Raven Lake Third Addition. Overview On June 20, 2016 the City Council approved the preliminary and final plat of Raven Lake Third Addition, which included two single family lots located on the west side of Jaguar Path. The two lots access Jaguar Path through Outlot C, Raven Lake Second Addition, which was platted with the intention of being future City right-of-way for an eyebrow cul-de-sac when the Raven Lake Third Addition parent parcel was platted into lots. Prior to the applications for the Raven Lake Third Addition plat, the City amended the Subdivision Ordinance to no longer allow eyebrow cul-de- sacs, primarily for traffic safety and street maintenance purposes. As such, the design of the Raven Lake Third plat did not include right-of-way for the eyebrow cul-de-sac and Outlot C, Raven Lake Second Addition remains in place as a City-owned outlot. The developer of Raven Lake Third Addition is selling Lot 2, Block 1 and the title company has requested the City grant an access easement over Outlot C, Raven Lake Second Addition to ensure the future homeowner will have driveway access to Jaguar Path. The access easement agreement was prepared by the City Attorney.
