Overview Representatives of an athletic training facility named ETS Elite South Metro have submitted a conditional use permit application and plans for a commercial recreation (athletic training facility) to be located at 21017 Heron Way. The business is presently located at 21021 Heron Way following approval of a conditional use permit in 2016. The ownership finds that additional space is necessary to accommodate the growing business. The property is zoned I-1, Light Industrial District. Commercial recreation uses are allowed by conditional use permit in the I-1 District. The Planning Commission held a public hearing on the conditional use permit application at the October 1, 2020 meeting. The Planning Commission recommended unanimous approval of the conditional use permit subject to three stipulations. There was no public comment at the public hearing. Primary Issues to Consider Why is a new Conditional Use Permit required? The new location is on a separate lot, so a separate CUP is required. Expansion on the current location would have required a CUP Amendment. Revocation. The City may revoke the conditional use permit for cause upon determination that the conditional use permit is not in conformance with the conditions of the permit or is in continued violation of the city code or other applicable regulations. 2 5. Expiration. This conditional use permit shall expire unless the applicant commences the authorized use within one year of the date of this conditional use permit unless an extension is approved by the Zoning Administrator. The Planning Commission conducted a public hearing on the proposed conditional use permit preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. The City Council hereby adopts the following: FINDINGS OF FACT 1. The property is located in Comprehensive Planning District No. 6, which guides the property for Industrial use. 2. The property is zoned I-1, Light Industrial District. 3. The legal description of the property is: The East 118.86 feet of Lot 10, Block 2, and all of Lot 11, Block 2, Airlake Development Fourth Addition 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a) The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the Official City Comprehensive Plan. Finding: The proposed commercial recreation use is consistent with the policies and provisions of Planning District 8 of the Comprehensive Land Use Plan. b) The proposed use is or will be compatible with future land uses of the area. Finding: The proposed commercial recreation use is compatible with surrounding industrial uses provided compliance with the stipulations of the conditional use permit. c) The proposed use conforms with all performance standards contained in the Zoning Ordinance and the City Code. Finding: The proposed commercial recreation use conforms with the performance standards set forth in the Zoning Ordinance given compliance with the stipulations of the conditional use permit. d) The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The proposed commercial recreation use will not overburden the City’s sanitary sewer and water systems and can be served with existing public services. e) Traffic generation by the proposed use is within capabilities of streets serving the property. Finding: Traffic generation by the commercial recreation use can be accommodated with the existing streets serving the property. 5. The planning report dated September 25, 2020 prepared by Associate Planner Frank Dempsey is incorporated herein. The detached accessory building shall be constructed with the materials noted on the approved conditional use permit plans including residential composite lap or similar siding consistent with the house. 3. The detached accessory building shall be kept, used and maintained in a manner that is compatible with the existing single family home on the property and shall not present a hazard to the public health, safety and general welfare. 4. No door opening in the accessory building shall be wider than eight feet unless a paved driveway is installed between the driveway of the attached garage to the accessory building. 5. Sanitary sewer service shall not be provided to the detached accessory building and the detached accessory building shall not be used as a dwelling. 6. No home occupation or other commercial use shall not occur in any accessory building on the property including no storage of commercial equipment or third-party materials or equipment. 7. The two existing detached accessory buildings shall be removed from the property before issuance of a building permit. 8. The rear of the property adjacent to Holiday Avenue shall be cleaned of the soil piles and the discarded sign posts with concrete footings. ETS Elite South Metro Chair Kaluza opened the public hearing to consider the application of ETS Elite South Metro for a conditional use permit to allow an indoor commercial recreation facility in the I-1, Light Industrial District, located at 21017 Heron Way. Chuck Morning Director of Operations presented an overview of the project. He indicated that they work with all kinds of athletes from the south metro area and they need more space. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that ETS Elite South Metro is an athletic training facility and is requesting a CUP in order to move from their existing 3,000 square foot location at 21021 Heron Way to a larger, 6,000 square foot space on a separate adjacent property located at 21017 Heron Way. A new CUP is required since the use will be located on a separate property than their previous CUP. Mr. Dempsey reviewed the five criteria of the Zoning Ordinance that allows commercial recreation facilities in the I-1 District, which are listed in detail in the September 25, 2020 planning report. Planning Department staff recommends approval of the ETS Elite South Metro CUP, subject to the three stipulations listed in the September 25, 2020 planning report, and adoption of the Findings of Fact dated October 1, 2020. Chair Kaluza opened the hearing to the public for comment. Planning Commission Meeting Minutes, October 1, 2020 Page 10 There were no comments from the audience. Motion was made by Lillehei, seconded by Witte to close the public hearing at 7:36 p.m. Voice vote was taken on the motion. Ayes - unanimous Chair Kaluza asked for comments from the Planning Commission. Discussion points included: • Commissioner Zimmer liked the idea of the garage doors in the back of the establishment. • Commissioner Witte and Swenson commented that it was great to see businesses like this come to Lakeville and succeed and grow. Motion was made by Witte, seconded by Majorowicz to recommend to City Council approval of the ETS Elite South Metro conditional use permit to allow an indoor commercial recreation facility in the I-1, Limited Industrial District, located at 21017 Heron Way, and adoption of the Findings of Fact dated October 1, 2020, subject to the following stipulations: 1. A sign permit must be issued by the City prior to the installation of any signs. 2. No H (Hazardous) Occupancy tenants are allowed in the multiple tenant industrial building as long as the commercial recreation use is a tenant in the same building. 3. If any future tenants of the building being jointly occupied by this commercial recreation use require Material Data Safety Sheets (MSDS), the building owner shall notify the City and provide the City with copies of the MSDS documents. Gala Farms Brewing Chair Kaluza opened the public hearing to consider the application of Beth Halstenson, AIA, Shelter Architects for the following, located south of 210th Street and west of Heron Way: 1. Zoning Ordinance amendment to allow brewpubs as a conditional use within the I-1, Light Industrial District; 2. Conditional use permit to allow the construction of a brewpub within the I-1 District; and 3. Conditional use permit to allow an exception to the exterior building material requirements within the I-1 District. Glen Perkins presented an overview of the project. Mr. Perkins wants to appeal to families, and not just open a beer drinking establishment. He always envisioned a brewery with a full service restaurant Planning Consultant Daniel Licht presented the planning report. Mr. Licht stated that Gala Farms Brewing is requesting a Zoning Ordinance amendment to allow brewpubs as a conditional use within the I-1, Light Industrial District. The applicant is also 1 City of Lakeville Planning Department M EMORANDUM To : Planning Commission From: Frank Dempsey, AICP, Associate Planner Date: September 25, 2020 Subject: Packet Material for the October 1, 2020 Planning Commission Meeting Agenda Item: ETS Elite South Metro Conditional Use Permit Action Deadline: November 7, 2020 INTRODUCTION Representatives of ETS Elite South Metro have submitted a conditional use permit application and plans in order to move from their existing 3,000 square foot location at 21021 Heron Way to a larger, 6,000 square foot space on a separate adjacent property located at 21017 Heron Way. A new conditional use permit is required since the use will be located on a separate property than the one on which the 2016 conditional use permit was approved. ETS is an athletic training facility allowed as a commercial recreation use subject to approval of a conditional use permit in the I-1, Limited Industrial District. EXHIBITS A. Location and Zoning Map B. Aerial Photo Map C. Site Plan D. Building Unit Plan 2 STAFF ANALYSIS Zoning. The subject property is zoned I-1, Limited Industrial District. In addition to the proposed athletic training facility, the building on the subject property has eight tenant spaces including a custom cabinetry shop, Frontier Communications, Gold Mine Dezine, Lakeville Trophy, Print Lab, QFC Industries and VEOTEC Air Quality Solutions. ETS will occupy the space previously occupied by Print Lab, doubling ETS’s current size in the space they occupy in the adjacent building. Two other commercial recreation uses were approved by conditional use permit in one of the two buildings at 21021 Heron Way in 2005 and 2012 in addition to ETS in 2016. The other commercial recreation uses have since been discontinued. Section 11-86-7.D of the Zoning Ordinance allows commercial recreation facilities in the I-1 District subject to compliance with five listed criteria. The five criteria and my analysis of each are as follows: 1. The architectural appearance and function plan of the building and the site shall be designed with a high standard of architectural and aesthetic compatibility with surrounding properties. Building materials, orientation, colors, height, roof design, lighting, signage and site landscaping shall be designed to complement the surrounding industrial properties and demonstrate potential industrial reuse. All sides of the principal and accessory structures are to have essentially the same or a coordinated, harmonious exterior finish treatment. The existing exterior building appearance and interior functional plan will not be changed with the proposed commercial recreation facility. The masonry exterior of the multiple tenant building meets the requirements of the I-1 District. 2. A commercial recreational use shall not be located within a shared tenancy building containing a use classified as an "H" occupancy as defined by Minnesota state building code, as may be amended. According to the building owner and Building Inspection records, there are no H (Hazardous) occupancy tenants in the multi-tenant building. No future H classified tenant can occupy the subject building as long as the commercial recreation use occupies the same building. 3. In multiple occupancy buildings, a material safety data sheet (MSDS) shall be required identifying all materials stored or used in the operation of the tenant businesses. Any change in building tenants shall require that the MSDS be updated and provided to all other tenants in the multitenant building. 3 There are currently no tenants in the building that require material safety data sheets (MSDS) for hazardous materials. Any future tenants that require MSDS are required to notify the City and supply the relevant MSDS information. The property owner and future tenants of the property shall notify the City of any MSDS documents of existing or future tenants of the building as long as the commercial recreation use occupies the building. 4. A commercial recreational use in a shared tenancy building shall have its own exterior entrance and exit. ETS Elite South Metro will have its own entrance and exit from the north side of the building as shown on the floor plan. There is also a rear overhead and person door exit on the south side of the building. 5. The site must be accessed via a collector street. Vehicular access points shall create a minimum of conflict with through traffic movement, shall comply with chapter 19 of this title and shall be subject to the approval of the city engineer. Heron Way is accessible via 210th Street, a major collector road. Parking is shared among the tenants in the building. ETS’s peak hours tend to be during the off peak hours of other tenants in the building. Findings of Fact are attached for your review and consideration.
