Overview ISD 194, has submitted a conditional use permit amendment application and plans to allow a building addition to Eastview Elementary School, located at 18060 Ipava Avenue. The property is zoned RS-2, Single Family Residential District. Elementary schools are allowed by conditional use permit in the RS-2 District. The Planning Commission held a public hearing on the conditional use permit amendment application at its October 1, 2020 meeting. There was no public comment. The Planning Commission recommended unanimous approval of the conditional use permit amendment subject to four stipulations. Primary Issue to Consider • How will the construction of the rain garden help drainage on the site? The grading on the site currently directs some drainage along the south property line of the school site, which has led to wet areas along the shared property line with the single family homes to the south. The construction of this rain garden will capture that drainage and water will be discharged via a pipe that will connect to an existing storm sewer pipe on site. RECITALS A. The Owner and/or affiliate of Owner is the owner of certain real property located in Dakota County, Minnesota legally described in Exhibit A attached hereto ("Property"); and B. The Owner is proceeding to expand the building located on the Property, and has requested approval of a conditional use permit for the proposed expansion; and C. The final plans for Eastview Elementary School Site Renovations, hereinafter called the "Plans", which are expressly made a part hereof, as approved or to be approved by the City, provides for detention/retention of stormwater within the confines of the Property; and D. The City and the Owner agree that the health, safety, and welfare of the residents of the City of Lakeville, Minnesota, require that on-site stormwater management/BMP facilities be constructed and maintained on the Property; and E. The City requires that on-site stormwater management/BMP facilities (“Stormwater Facilities”) as shown on the Plans be constructed and adequately maintained by the Owner as a condition of conditional use permit approval for the building; and F. As a condition of conditional use permit approval the Owner is required to enter into this Agreement and grant to the City an easement for access, drainage and utility over a portion of the Property (the “Easement Area”) legally described on Exhibit B attached hereto to comply with work required under the terms of this Agreement. NOW, THEREFORE, in consideration of mutual covenants of the parties set forth herein and other valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows: 1. Construction of Stormwater Improvements. Owner shall construct the Stormwater Facilities in accordance with the plans and specifications identified in the Plans. 2 212170v1 2. Maintenance of Stormwater Improvements. A. The Owner shall adequately maintain the Stormwater Facilities in accordance with the Stormwater Maintenance Plan and the City engineering standards for stormwater treatment facilities attached hereto as Exhibit C. This includes all pipes, channels, and other conveyances built to convey stormwater to the facility, as well as all structures, improvements, and vegetation provided to control the quantity and quality of the stormwater. Adequate maintenance is herein defined as good working condition so that these facilities are performing their design functions. B. The Owner will perform the work necessary to keep these Stormwater Facilities in good working order as appropriate. In the event a maintenance schedule for the Stormwater Facilities (including sediment removal) is outlined on the approved plans, the schedule will be followed and comply with all federal, state, and local regulations relating to the disposal of material. 3. Inspection and Reporting. The Owner shall cause the Stormwater Facilities to be inspected and submit an inspection report annually and shall be responsible for the payment of any associated costs. The purpose of the inspection is to assure safe and proper functioning of the facilities. The inspection shall cover the entire facilities, berms, outlet structure, pond areas, access roads, buffers, etc. Deficiencies shall be noted in the inspection report. A storage treatment basin will be considered inadequate if it is not compliant with all requirements of the approved Plan and City engineering standards set forth in Exhibit C. 4. City Access and Maintenance Rights. A. The Owner hereby grants permission to the City, its authorized agents and employees, to enter upon the Property and to inspect the stormwater management/BMP facilities whenever the City deems necessary. The City shall provide the Owner, its successors and assigns, copies of the inspection findings and a directive to commence with the repairs if necessary (“Inspection Report”). B. In the event the Owner, its successors and assigns, fails to maintain the Stormwater Facilities in good working condition acceptable to the City and such failure continues for 60 days after the City gives the Owner written notice of such failure, the City may enter upon the Property and take whatever steps necessary, including excavation and the storage of materials and equipment, to correct deficiencies identified in the Inspection Report. The City's notice shall specifically state which maintenance tasks are to be performed. The City may charge the costs, including assessing the City’s costs to the Owner’s property taxes of such repairs, to the Owner, its successors and assigns. This provision shall not be construed to allow the City to erect any structure of permanent nature on the land of the Owner outside of the Easement Area for the Stormwater Facilities. It is expressly understood and agreed that the City is under no obligation to routinely maintain or repair said Stormwater Facilities, and in no event shall this Agreement be construed to impose any such obligation on the City. In addition, Owner agrees that it is, and will be, solely responsible to address complaints and legal claims brought by any third party with regard to the maintenance and operation and the consequences there from the Stormwater Facilities. The Owner expressly agrees to defend and hold the City harmless from any such third-party claim, 3 212170v1 except to the extent the complaints and legal claims relate to the City’s alleged negligent or wrongful acts. 5. Grant of Easement. Owner hereby grants to the City, its successors and assigns, a permanent non-exclusive easement for the purpose of accessing and maintaining the Stormwater Facilities pursuant to the terms of this Agreement over, on, across, under and through the Easement Area. The easement shall include the rights, but not the obligation, of the City, its contractors, agents, servants, and assigns, to enter upon the Easement to construct, reconstruct, inspect, repair, and maintain said private Stormwater Facilities together with the right to grade, level, fill, drain, pave, and excavate the Easement Area, and the further right to remove trees, bushes, undergrowth, and other obstructions interfering with the location, construction, and maintenance of said private Stormwater Facilities systems. 6. Reimbursement of Costs. The Owner agrees to reimburse the City for all costs incurred by the City in the enforcement of this Agreement, or any portion thereof, including court costs and reasonable attorneys' fees. 7. Indemnification. This Agreement imposes no liability of any kind whatsoever on the City. The Owner hereby agrees to indemnify and hold harmless the City and its agents and employees against any and all claims, demands, losses, damages, and expenses (including reasonable attorneys' fees) arising out of or resulting from the Owner or the Owner’s agents or employee's negligent or intentional acts, or any violation of any safety law, regulation or code in the performance of this Agreement, without regard to any inspection or review made or not made by the City, its agents or employees or failure by the City, its agents or employees to take any other prudent precautions. 8. Notice. Annual inspection, maintenance reporting and certification by a professional engineer (Provided by Owner). Information must be submitted to the City annually. 2. Excavate pond to original design capacity when one half (1/2) of the wet volume of the pond is lost due to sediment deposition. 3. Remove floatable debris in and around the pond area including, but not limited to: oils, gases, debris and other pollutants. 4. Maintain landscape adjacent to the facility per original design, including but not limited to: maintenance of the buffer strip and other plant materials as per original plan design. 5. Maintenance of all erosion control measures including but not limited to: rip rap storm sewer outlets, catch basin inlets, etc. Infiltration/Rain Garden Maintenance Requirements 1. Inlet and Overflow Spillway – Remove any sediment build-up or blockage and correct any erosion. 2. Vegetation a. Maintain at least 80% surface area coverage of plants approved per plan. b. Removal of invasive plants and undesirable woody vegetation. c. Removal of dried, dead and diseased vegetation. d. Re-mulch void or disturbed/exposed areas. 3. Annual inspection and maintenance efforts must be documented and submitted to the City. Underground Infiltration System 1. Inspection of street or parking surface must be inspected for evidence of potholes, sinkholes, sediment build up, or surface ponding annually. 2. Annual inspections must be completed of pipe symmetry, pipe joint connections, and outlet structures to look for cracks, defects, misalignment, or seepage. 3. Inspection for accumulation of sediment must be done annually, maintenance should be performed when sediment accumulation occurs. 4. Visual inspection for trash and debris must be conducted monthly and following rain events of 1 inch or greater in 24 hours. 10 212170v1 5. Inspections must be performed annually to look for oil accumulation in device or immediately after a spill occurs. Maintenance must be done when a layer of oil/gasoline develops on the surface. Environmental Manhole Maintenance Requirements 1. Annual inspections, maintenance reporting and certification must be completed by a professional engineer licensed in the State of Minnesota at Owner’s expense. Information must be submitted to the City annually. 2. Maintenance must be performed once the sediment or oil depth exceeds the established requirements recommended by the manufacturer. 3. Maintenance must occur immediately after a spill takes place. Appropriate regulatory agencies must also be notified in the event of a spill. 4. Disposal of materials shall be in accordance with local, state and federal requirements as applicable. 1 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA EASTVIEW ELEMENTARY SCHOOL CONDITIONAL USE PERMIT AMENDMENT FINDINGS OF FACT AND DECISION On October 1, 2020 the Lakeville Planning Commission met at their regularly scheduled meeting to consider the application of ISD #194 for a conditional use permit amendment to allow a building addition to Eastview Elementary School in the RS-2, Single Family Residential District. The Planning Commission conducted a public hearing on the proposed conditional use permit amendment preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. The City Council hereby adopts the following: FINDINGS OF FACT 1. The property is located in Planning District No. 2 of the 2040 Comprehensive Plan which guides the property for Public and Quasi-Public uses. 2. The property is currently zoned RS-2, Single Family Residential District. 3. The legal description of the property is: Lot 1, Block 1, Lakeville 1996 Elementary Addition 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The proposed expansion of the elementary school is consistent with the policies and provisions of Planning District 2 of the Comprehensive Land Use Plan. b. The proposed use is or will be compatible with present and future land uses of the area. Finding: The proposed expansion of the elementary school is compatible with existing land uses in the area. 2 c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. Finding: The elementary school is an existing use on the property. The proposed expansion will conform to all performance standards set forth in the Zoning Ordinance given compliance with the approved conditional use permit amendment. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The proposed expansion to the elementary school can be adequately served with existing public services. e. Traffic generation by the proposed use is within capabilities of streets serving the property. Finding: The existing streets (Ipava Avenue and 183rd Street) that serve the property can accommodate the proposed expansion. 5. The planning report dated September 23, 2020 and prepared by Kris Jenson, Associate Planner, is incorporated herein. DECISION The City Council approves the conditional use permit amendment in the form attached hereto. Eastview Elementary School Chair Kaluza opened the public hearing to consider the application of Independent School District #194 for an amendment to Conditional Use Permit #95-14 to allow a building addition to Eastview Elementary School in the RS-2, Single Family Residential District, located at 18060 Ipava Avenue Stephen Bellairs from the DLR Group presented a brief overview of this project. He stated that the first floor will be built as a tornado shelter. This addition will be in the southeast corner of the existing building. The parking spaces will meet the Zoning Ordinance requirements. Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated that ISD 194 is requesting an amendment to CUP #95-14 to allow an 8,400 square foot two-story building addition to Eastview Elementary School that would include four classrooms, two group rooms and shared learning commons, along with additional lockers and restrooms. Ms. Jenson commented that she received two e-mails from residents asking about drainage. A stormwater pond will be added to the south to help with the drainage issues. Ms. Jenson reviewed conformance with Zoning Ordinance performance standards for the RS-2, Single Family Residential District, which include setbacks, building height, screening, access and circulation, parking, the reconfiguration of the internal sidewalks, building elevations and exterior building materials, and a site encroachment of an adjacent residential property. Motion was made by Drotning seconded by Lillehei to close the public hearing at 6:46 p.m. Voice vote was taken on the motion. Discussion points included: • The area proposed for the building addition is a grass area that is not active play space. • Commissioner Swenson indicated his appreciation for the stormwater basins being put in to help the neighboring properties. Kennedy Elementary Chair Kaluza opened the public hearing to consider the application of Independent School District #194 for an amendment to Conditional Use Permit #04-03 to allow a City of Lakeville Planning Department Memorandum To: Planning Commission From: Kris Jenson, Associate Planner Date: September 23, 2020 Subject: Packet Material for the October 1, 2020 Planning Commission Meeting Agenda Item: Eastview Elementary School Conditional Use Permit Amendment Application Action Deadline: October 25, 2020 INTRODUCTION Representatives of ISD 194 are requesting an amendment to CUP #95-14 to allow an expansion to Eastview Elementary School for the construction of classroom additions on the west side of the existing building located at 18060 Ipava Avenue. The proposed building addition will be 8,400 square feet in area for a total building area of 97,350 square feet according to the applicant. The subje ct property is zoned RS-2, Single Family Residential District. Section 11-51-7D of the Zoning Ordinance allows public elementary schools in the RS-2 District by conditional use permit. Color elevations 2 PLANNING ANALYSIS The proposed two-story building addition project will include the construction of four classrooms, two group rooms and shared learning commons, along with additional lockers and restrooms. The existing site conditions include parking lots, playground area, and various play fields. Surrounding Land Uses and Zoning North – Single family homes (RS-2) South – 183rd Street and single family homes (RS-3) West – Ipava Avenue and single family homes (RS-2) East – Single family homes (RS-3) and publicly-owned wetland area (P/OS) The proposed expansion was reviewed for conformance with Zoning Ordinance performance standards as follows: Building Setbacks. The building addition will exceed all setback requirements of the RS-2 District: Front – 30 feet Side – 30 feet on the side yard abutting public right of way, 15 feet on interior side yard Rear – 30 feet Building Height. The building addition will be 27 feet, 10 inches in height with an eight foot tall rooftop mechanical screen. The building meets the Zoning Ordinance requirements of a maximum building height of 35 feet within the RS-2 District. Mechanical Equipment Screening. There is roof mounted mechanical equipment proposed with the building addition. The equipment will be screened by a metal fence in compliance with Zoning Ordinance requirements. Access and Circulation. The site is accessed via Ipava Avenue and 183rd Street. The access and parking lot configuration will not be altered. Parking. School parking requirements are based on student enrollment capacity. Elementary schools require one space per seven students based on student enrollment capacity. Based on the 846 student enrollment capacity for Eastview Elementary School provided by the school district, 121 parking spaces are required. The site currently has 142 parking spaces on site, exceeding the minimum parking requirement by 21 spaces. Trails and Sidewalks. The existing internal sidewalks will be reconfigured and extended to accommodate the building addition and a sidewalk will be added to connect the addition to the sidewalk along the access drive from 183rd Street. 3 Building Elevations and Exterior Building Materials. The proposed building addition will be sided with brick to match the existing building materials and color and satisfies the material requirements of the Zoning Ordinance . The proposed building materials meet the requirements for an institutional use in the RS-2 District . Site Encroachments. Per the applicant, there is an adjacent residential property that has encroached on to the school property with landscape improvements. The school district is working with the property owner to ensure that the encroachments are relocated onto the residential parcel. The school district should confirm that these encroachments have been removed prior to a certificate of occupancy being issued for the building addition. Signs. There is no new signage proposed with the addition. Lighting. There is no new lighting proposed with the addition. Engineering Review. The Engineering Division has reviewed the plans and the Applicant must address all comments relating to the proposed stormwater management for the site improvements prior to issuance of a building permit. Additionally, the final grading and utility plans must be approved prior to the issuance of a building permit. RECOMMEND ATION Planning Department staff recommends approval of the Eastview Elementary School conditional use permit amendment subject to the following stipulations: 1. The site improvements and building addition shall be developed in accordance with the plans approved by the City Council. 2.
