Overview ISD 194, has submitted a conditional use permit amendment application and plans to allow a pool addition to Century Middle School, located at 18610 Ipava Avenue. The property is zoned RS-2, Single Family Residential District. Middle schools are allowed by conditional use permit in the RS-2 District. The Planning Commission held a public hearing on the conditional use permit amendment application at its October 1, 2020 meeting. There was no public comment. The Planning Commission recommended unanimous approval of the conditional use permit amendment subject to eight stipulations. Staff recommends a ninth stipulation be added stating that grading work is as it pertains to this CUP submittal is not permitted until Engineering staff has reviewed and approved the grading plan and site stormwater management plans. ISD 194 representatives indicated that events in the pool addition will not overlap with student occupancy hours. The Planning Commission recommended that the school district stripe the existing bus parking spaces in the north parking lot to accommodate for vehicle parking during special events with increased parking demands. The school district has agreed to do this and a total of 277 on-site parking spaces are now proposed with the pool addition. The proposed parking exceeds parking requirements when meets are scheduled for the pool after the normal school day. • Why have revised plans been submitted? The school district has submitted revised plans based on comments from the Planning Commission and staff discussion with school district officials following the Planning Commission meeting. Landscape materials have been added to the area where the existing entrance off of Ipava will be removed. The landscape plan has also been adjusted to provide access for snow storage, but still meets Zoning Ordinance requirements for parking lot screening. The northern access off of Ipava Avenue will be converted to a right out, exit only. Vehicles and buses will enter from the southernmost access where turn lanes currently exist, and the buses will use the north-south drive lane to access the designated bus parking spaces. Based on the revisions to the proposed parking lot, the stormwater management basin has been relocated to the south of the parking lot. A Stormwater Maintenance Agreement is required and will be considered at a future City Council meeting following Engineering staff review of the revised stormwater management plans. 1 (Reserved for Dakota County Recording Information) CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA CONDITIONAL USE PERMIT NO. 20-___ AMENDMENT TO CUP NO. 98-13 1. Permit. Subject to the terms and conditions set forth herein, the City of Lakeville approves a Conditional Use Permit Amendment to CUP No. 98-13 for ISD #194 to allow an addition to Century Middle School, located at 18610 Ipava Avenue. 2. Property. The permit is for the following described property located in the City of Lakeville, Dakota County, Minnesota: Lot 1, Block 1, Lakeville Third Junior High School 3. Conditions. The permit is issued subject to the following conditions: a) The site improvements and building addition shall be developed in accordance with the plans approved by the City Council. b) A building permit is required prior to commencing construction of the building addition. c) The proposed building addition shall be sided with materials to match the existing building color. All building materials shall meet the requirements for an institutional use in the RS-2 District. d) The building addition is subject to review by the Fire Marshal. e) The mechanical equipment shall be screen in compliance with Zoning Ordinance requirements. f) Lighting shall be down-cast type only and must comply with Section 11-16-17 of the Zoning Ordinance. 2 g) The school district shall not hold swim meets during school instructional hours in order to meet Zoning Ordinance parking requirements. h) The recommendations listed in the August 28, 2020 engineering report. i) Grading work is as it pertains to this CUP amendment submittal is not permitted until Engineering staff has reviewed and approved the grading plan and site stormwater management plans. 4. Revocation. The City may revoke the conditional use permit amendment for cause upon determination that the conditional use permit amendment is not in conformance with the conditions of this permit or is in continued violation of the Zoning Ordinance, City Code, or other applicable regulations. 5. Expiration. This conditional use permit amendment shall expire unless the applicant commences construction of the authorized use within one year of the date of this conditional use permit amendment, unless an extension is approved by the Zoning Administrator. The Planning Commission conducted a public hearing on the proposed conditional use permit amendment preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. The City Council hereby adopts the following: FINDINGS OF FACT 1. The property is located in Planning District No. 4 of the 2040 Comprehensive Plan, which guides the property for Public and Quasi-Public uses. 2. The property is currently zoned RS-2, Single Family Residential District. . 3. The legal description of the property is: Lot 1, Block 1, Lakeville Third Junior High School 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The proposed expansion of the school is consistent with the policies and provisions of Planning District 4 of the Comprehensive Land Use Plan. 2 b. The proposed use is or will be compatible with present and future land uses of the area. Finding: The proposed expansion of the school is compatible with existing residential land uses in the area. c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. Finding: The school is an existing use on the property. The proposed expansion will conform to all performance standards set forth in the Zoning Ordinance given compliance with the approved conditional use permit amendment. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The proposed expansion to the school can be adequately served with existing public services. e. Traffic generation by the proposed use is within capabilities of streets serving the property. Finding: The existing street (Ipava Avenue) that serves the property can accommodate the proposed expansion, given the changes proposed with the redesign of the existing access. 5. The planning report dated September 23, 2020 and prepared by Monica Croatt, Planning & Zoning Specialist is incorporated herein. Ms. Croatt stated that ISD 194 is requesting an amendment to CUP #98-13 to allow an expansion to Century Middle School for the construction of a 25-yard lap pool and a diving well along with seating capacity for 500 people and additional restrooms and storage facilities on the west side of the existing building. Planning Department staff recommends approval of the Century Middle School CUP amendment, subject to the eight stipulations listed in the September 25, 2020 planning report, and adoption of the Findings of Fact dated October 1, 2020. Chair Kaluza opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Majorowicz seconded by Lillehei to close the public hearing at 6:09 p.m. Voice vote was taken on the motion. Discussion points included: • Bus circulation and bus ingress and egress points. • Confirmed that the applicant received a grading permit prior to receiving approval from Planning Commission and City Council for the work currently taking place. Mitchell Cookas, from Kimley Horn on behalf of ISD 194 also indicated that they had gotten approval from Engineering to start on the watermain and stormwater basin. • With school not in session, a traffic study had not been done. • The Planning Commission stressed that there will not be sufficient parking to hold swimming events while school is in session during the day. • The Planning Commission wanted the school district to consider re-striping the parking lot where the buses park to make parking for cars easier during after school events. • The school district and the City work very well together, but the Planning Commission felt this proposal was rushed through and communication could have been better. • Better signage should be considered for the parking lot. • Commended the school district for bringing the pool to fruition. Beth Louden indicated she will bring back the Planning Commission’s suggestions to the school district. She stated the school district was rushing this request because they wanted to get the pool construction completed this fall. He stated that the first floor will be built as a tornado shelter. This addition will be in the southeast corner of the existing building. The parking spaces will meet the Zoning Ordinance requirements. Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated that ISD 194 is requesting an amendment to CUP #95-14 to allow an 8,400 square foot two-story building addition to Eastview Elementary School that would include four classrooms, two group rooms and shared learning commons, along with additional lockers and restrooms. The proposed pool addition will be 28,089 square feet in area for a total building area of 198,979 square feet according to Dakota County records. The subject property is zoned RS-2, Single Family Residential District. Section 11-51-7D of the Zoning Ordinance allows public middle schools in the RS-2 District by conditional use permit. The proposed pool addition project will include the construction of a 25-yard lap pool and a div ing well along with seating capacity for 500 people and additional restrooms and storage facilities. The existing site conditions include parking lots north and southwest of the school. The eastern portion of the property contains baseball fields, tenn is courts, and a track. The southern portion of the property contains soccer fields. Surrounding Land Uses and Zoning North –Water Treatment Facility and Fire Station #4 (P/OS), LifeTime Fitness (PUD) South – Attached Townhomes (PUD) East – Dodd Boulevard and Single family Homes (RST-2 and RS-4) West – Ipava Avenue and Single Family Homes (RS-3) The proposed expansion was reviewed for conformance with Zoning Ordinance performance standards as follows: Building Setbacks. The existing building meets all setback requirements of the RS-2 District: Front – 30 feet Side – 30 feet on the side yard abutting public right of way, 15 feet on interior side yard Rear – 30 feet The proposed pool addition will be set back 96.5 feet to the nearest property line. Building Height. The pool addition will be 32 feet in height, within the maximum allowed building height of 35 feet. Mechanical Equipment Screening. There is additional ground mounted mechanical equipment proposed with the pool addition that will be located on the north side and is to be screened by a fence in compliance with Zoning Ordinance requirements. Access and Circulation. The site is accessed via Ipava Avenue. The northern access to Ipava Avenue will be relocated to the south to align with the drop off lane and continue to be a right in, right out access. The southernmost access location will not be altered. Parking. School parking requirements are based on student enrollment capacity. Junior high schools (middle schools) require 1 space per 7 students based on student enrollment capacity. Based on the 949 student enrollment capacity provided by the school district, 136 parking spaces are required. The pool addition has a seating capacity of 500 people. Institutional uses of auditoriums and sports arenas require 1 space per 3 seats of design capacity, resulting in 3 167 required spaces. ISD 194 representatives indicated that events in the pool addition will not overlap with student occupancy hours. The northern parking lot currently contains 52 parking spaces and will not be altered. The southern parking lot currently contains 228 onsite parking spaces, based on aerial photos. The reconstruction of the southern parking lot for the pool addition proposes 172 parking spaces. A total of 224 on-site parking spaces are proposed with the pool addition, which exceeds parking requirements when meets are scheduled for the pool after the normal school day. Trails and Sidewalks. The existing internal sidewalks will be reconfigured and extended to accommodate the pool addition and parking lot improvements. Building Elevations and Exterior Building Materials. The proposed building addition will be sided with brick face and sandblasted/acid etched precast concrete panels to match the existing building color. The brick face shall be constructed with architecturally precast concrete panels with a form liner, tooled, brick face finish to satisfy the material requirements of the Zoning Ordinance. The proposed building materials meet the requirements for an institutional use in the RS-2 District. Landscaping. Institutional uses require a continuous opaque barrier along the off-street parking area perimeter abutting public right-of-way and residentially zoned properties. There is existing landscaping along Ipava Avenue adjacent to the parking lot and pool addition. The landscape plan proposes additional landscaping within and adjacent to the southwest parking lot. All proposed landscape material shall comply with Zoning Ordinance requirements. Signs. There is no new signage proposed with the addition. Lighting. Downward cast light fixtures will be installed in the parking lot in compliance with Zoning Ordinance requirements. Engineering Review. The Engineering Division has reviewed the plans and prepared a memorandum dated August 28, 2020 (attached). RECOMMENDATION Planning Department staff recommends approval of the Century Middle School conditional use permit amendment subject to the following stipulations: 1. Wastewater is conveyed to the Empire Wastewater Treatment Facility. The Century Middle School improvements include a proposed 6-inch privately owned and maintained sanitary sewer service to serve the proposed building addition. The proposed sanitary sewer will connect to the school’s existing privately owned and maintained sanitary sewer system. DDRRAAIINNAAGGEE AANNDD GGRRAADDIINNGG Century Middle School is located within subdistrict SC-150 of the South Creek stormwater district and FO-129 of the Farmington Outlet stormwater district as identified in the City’s Water Resources Management Plan. Construction of the Century Middle School pool addition and parking lot improvements includes the construction of privately owned and maintained storm sewer and a stormwater management basin. The private stormwater management basin will provide rate control and water quality/volume reduction of the stormwater runoff generated from the parking lot southwest of the school. A Stormwater Maintenance Agreement will be required prior to the issuance of a building permit. The final grading plan shall identify all fill areas in which the building footing will be placed on fill material. The grading specifications shall also indicate that all embankments meet FHA/HUD 79G specifications. The Applicant shall certify to the City that buildings with footings placed on fill material are appropriately constructed. SSTTOORRMM SSEEWWEERR Privately owned and maintained storm sewer will be constructed with the Century Middle School improvements. A curb cut in the southwestern parking lot will convey runoff to the privately owned and maintained stormwater management basin. The proposed privately owned and maintained stormwater basin will outlet to existing privately owned and maintained storm sewer on the property and ultimately drain to City’s storm sewer within 185th Street north of the site. Final locations and sizes of all storm sewer facilities will be reviewed by City staff with the final construction plans. FEMA FLOODPLAIN ANALYSIS Lake Marion Elementary School is shown on the Flood Insurance Rate Map (FIRM) as Zone X by the Federal Emergency Management Agency (FEMA). Based on this designation, there are no areas on the property located within a Special Flood Hazard Area (SFHA), as determined by FEMA.
