HomeMy WebLinkAbout0416 ORDINANCE NO. 416 z CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLE 4, CHAPTER 2 OF THE LAKEVILLE CITY CODE CONCERNING GARBAGE, RUBBISH, AND RECYCLABLE MATERIALS The City Council of the City of Lakeville does hereby ordain.: Section 1. Title 4, Chapter 2, Sections 1,2,3, 4 and S of the Lakeville City Code i hereby amended. to read as follows: SECTION: 4-2-1: Definitions "4-2-2: Disposal Requirements 4 2-3: Container Requirements 4-2-4; Paymen for Services 4-2-5: Anti-Scavenging 4-2-1: DEFINITIONS: For the purposes of this Chapter the following. terms, phrases, words, and their derivations shall have the meanings given-herein: GARBAGE: Waste foodstuffs or table wastes of vegetable or animal origin, together with :other incidental admixtures. Dead animals :weighing ten (10) pounds or less shall be classified as garbage.. RECYCLABLE MATERIAL CONTAINER: A curbside recycling container owned by the City and provided to the residentfor the purpose of collection and disposal of. recyclable material. .RECYCLABLE. MATERIAL: Any material. that can be readily separated for use and reuse as substitutes for raw materials such as: .aluminum and steel beverage cans, plastic beverage bottles, .scrap metal, tin cans, glass, newsprint, .mixed paper, cardboard, automoble..and household batteries and used oil. RUBBISH: Waste. materials from normal household. or living conditions and business operations, other than "garbage" or "ashes", but not to include. garden, lawn. or tree trimmings, leaves or waste materials .from building construction or repair; it shall not include .factory ..wastes or :refuse from .industrial plants of any character. In, general, the kinds of materials..classed as "rubbish" .are uch as non-recyclable gaper, rags,. bottles, tin cans,. cardboard, worn-out clothing and .the like. REFUSE: Mixtures, in any proportions, of garbage, ashes andF rubbish. YARDWASTE: Garden wastes, leaves, lawn cuttings, weeds and prunings. 4-2-2: DISPOSAL REQUIREMENTS: A. Services of Col ectors: It shall be unlawful for. any person to fail to .promptly dispose of garbage,. rubbish .and/or recyclable material in a sanitary manner which may be, or which may accumu- late, upon: property they own or. occupy. Every person .who shall fail or refuse to make provision for and secure such disposal shall be guilty. of a misdemeanor. Persons desiring fio make use of the services of licensed garbage, rubbish and/or recyclable;- material collectors may do so by :notifying. one of said"collectors and paying the fee therefore, and may obtain he names ,of the licensed collectors from the City Clerk. B. Rubbish Disposal: -Every householder, owner, occupant or tenant-of any premises who does not otherwise dispose of rubbish in a sanitary manner, shall .place all rubbish in a tight receptacle. If rubbish. and garbage are placed in the same container, the entire contents shall be treated as garbage for disposal purposes. C. Regular Removals It is the intention of the City Council by means. of this Chapter, to establish a system of complete, regular garbage and rubbish collection throughout the City so that the disposal of such materials shall be accomplished in a sanitary manner and so that the health and sanitary conditions of the residents of the .City shall be properly safeguarded. All resi- dents. are required by this Chapter to make adequate provisions. for` sanitary removal of garbage. and xubbish by means of licensed collectors unless such .persons have provided :other adequate means of disposal which meet with the approval of the City Clerk :and whchcomplywith all other ordinances and regulations of the .city. D. Unlicensed .Collections Prohibitedi Any person who permits garbage, rubbish andJor recyclable material to be, picked up from` their premises by an unauthorized or unlicensed collector .shall be guilty of a violation of this Chapter.. Non-profit organizations .collecting recyclable material shall be exempt from the: license requirement. The indiscrimate discarding of garbage, rubbish and/or .recyclable material on any streets., .alleys., drves,;parks,- playgrounds or other public places or on any vacant 1o'ts privately owned shall constitute a violation of this Chapter whether such garbage, rubbish and/or recyclable material is discarded by the individual upon whose .premises the garbage, rubbish and/or recyclable material .originates or whether. it is discarded-by some 'other person or collector, licensed or-unlicensed. 2 E. Yardwaste Disposal: It shall be unlawful for any person to ; dispose of yardwaste in mixed municipal solid waste; in a_dis- posal facility; or in a resource recovery facility except for the purposes of composting or co-composting.. 4-2-3: CONTAINER REQUIREMENTS: A. Garbage Containers: Every householder or occupant of_any dwelling house and every operator of any boarding house, restaurant, or any other place of business having garbage to dispose o€, who does'not otherwise provide for the .disposal of such garbagein a sanitary manner shall provide themselves with one or more metal or plastic cans sufficient to receive all garbage which may accumulate between the times of collection. Each can in use in a single family detached dwelling shall have a capacity not to exceed one hundred (100) gallons and shall be provided with a bail or handles and a tight fitting cover. All garbage accumulating between times of collection shall be placed in cans after having first been drained of surplus water and wrapped in paper in a manner sufficient to prevent leakage before it is placed in .cans. B. Recyclable Material Containers: All recyclable material contain- ers provided by the City to the resident shall be .owned, by the City and shall remain with the premises at such time as the , resident moves or vacates the premises. Recyclable material .containers shall be used only for the storage of recyclable mat8rai and shall not be used for any other purpose. C. Location of Containers: Garbage cans and recyclable material containers shall be kept in rear or side yards and shall be screened from neighboring properties and the public right-of-way or shall be kept indoors. Said containers shall be accessible at .times of collection and if normally stored indoors shall be placed outside at designated collection times. Such garbage cans shall not be used for incinerators or burning cans and no garbage shall be placed. in any can or incinerator or container used for burning paper and other combustibles. No garbage shall at any time be burned in any bonfire or other fire, whether in a container or in the open. 4-2-4: PAYMENT FOR SERVLCES: The. expense of garbage, rubbish and/or recyclable material collection shall be paid to the collector... by the owner.,.agent,.occupant or tenant of the premises from which such' garbage, rubbish and/or recyclable material is collected, and such fee shall be full compensation for their services of such collection. 4-2-5: ANTI-SCAVENGING: It shall be unlawful for any person or business to scavenge, collect or otherwise. remove. recyclable materials after said materials have been placed or deposited for collection without a license from the City and an account relationship with the owner, lessee, or occupant of the.. premises. Non-profit organizations collecting recyclable material shall be exempt from the license " requirment. 3 s Section 2. .This ordinance shall be effective immediately upon its passage and publication. Dead animals weighing ten (10) pounds or less shall be classified as garbage. RECYCLABLE MATERIAL CON- TAINER: A curbside recycling container owned by the City and provided to the resident for the purpose of collection and disposal of recyclable material. RECYCLABLE MATERIAL: Any material that can be readily separated comply with all other ordinances and regulations of the City. D. Unlicensed Collections Prohibited: Any person who permits garbage, rubbish and/or recyclable material to be picked up from their premises by an unauthorized or unlicensed collector shall be guilty of a violation of this Chapter. Non-profit or- ganizations collecting recyclable material shall be exempt from the license re- quirement. E.
