HomeMy WebLinkAbout10-05-20CITY OF LAKEVILLE CITY COUNCIL MEETING MINUTES October 5, 2020 Mayor Anderson called the meeting to order at 6:30 p.m. in the Council Chambers at City Hall. After a moment of silence, the Pledge of Allegiance to the flag was given. Members Present: Mayor Anderson, Council Members Volk, Wheeler, Hellier, Lee Staff Present: Justin Miller, City Administrator; Andrea McDowell Poehler, City Attorney; Jeff Long, Police Chief, Paul Oehme, Public Works Director; David Olson, Community & Economic Development Director; Jerilyn Erickson, Finance Director; Charlene Friedges, City Clerk 3. Citizen Comments: Eastview Elementary School parents expressed concerns regarding the safety of their children crossing Ipava Avenue near the school. They asked the City Council to revisit the matter of pedestrian safety on Ipava Avenue. City staff will follow up. 4. Additional Agenda Information: None 5. Presentations/Introductions: League of Minnesota Cities representatives Mike Mornson, Brad Wiersum and Dave Unmacht presented the 2020 James F. Miller Leadership Award to City Administrator Justin Miller. Paul Oehme presented the Public Works quarterly report. 6. Consent Agenda Motion was made by Wheeler, seconded by Hellier, to approve the following: a. Check register review b. Minutes of the September 21, 2020 City Council meeting c. Ordinance No. 1034 amending Title 7, Chapter 15 and Ordinance No. 1035 amending Title 11, Chapter 30 of the Lakeville City Code concerning right-of-way management (small cell wireless facilities) d. Findings of fact and decision related to a tobacco violation at Vape City Tobacco e. Resolution No. 20-109 calling a public hearing relating to the imposition of a service charge for the downtown special service district f. Resolution No. 20-110 appointing election judges for the November 3, 2020 General Election City Council Meeting Minutes, October 5, 2020 Page 2 g. Raven Lake Third Addition development contract assignment h. Cedar Hills temporary drainage and utility easements i. Timbercrest at Lakeville 81h Addition final plat extension j. Continued Public Assessment Hearing for 2020 Street Reconstruction Mayor Anderson invited public comments related to the proposed assessments for the 2020 street reconstruction project. A resident expressed concerns regarding the construction schedule and the amount being assessed to his property. Mohamed EI Deeb,17075 Judicial Road, stated he objects to the proposed assessments. Motion was made by Hellier, seconded by Lee, to continue the public hearing to the November 2, 2020 City Council meeting. Roll call was taken on the motion. Continued Public Assessment Hearing for 170t' Street Project Mayor Anderson invited public comments related to the proposed assessments for the 1701h Street project. There were no public comments. Motion was made by Hellier, seconded by Wheeler, to continue the public hearing to the November 2, 2020 City Council meeting. Delinquent Utility Unpaid Special Charges Mayor Anderson opened the public hearing on the certification of delinquent utility accounts and assessments for unpaid special charges. Finance Director Erickson presented the proposed certification and assessments. The charges include costs incurred by the city for mowing of grass, removal of weeds, maintenance of nuisance properties, false alarms and unpaid utility bills. In addition to certifying the amount delinquent, the city collects service charges and interest. The City received a letter from Central Housing Associates, owner of Mr. Sparkle Car Wash, appealing the delinquent utility assessment. Michael Dickerson, Central Housing Associates, addressed the City Council regarding his delinquent utility bill at Mr. Sparkle Car Wash, 10841 -175th Street W. He stated he was not fully aware of the outstanding obligations when he purchased the property in 2019. Staff will review the matter and identify any potential options for the property owner. Motion was made by Hellier, seconded by Lee, to close the public hearing. Roll call was taken on the motion. Ayes - Hellier, Lee, Volk, Wheeler, Anderson Motion was made by Lee, seconded by Wheeler, to approve Resolution No. 20-112 adopting assessments for unpaid special charges. Capital Improvement Plan and Street Reconstruction Plan Mayor Anderson opened the public hearing to consider the proposed 2021-2025 Capital Improvement Plan and Street Reconstruction Plan. Finance Director Erickson presented the proposed Capital Improvement Plan and Street Reconstruction Plan. The Capital Improvement Plan, she explained, provides the financial framework for the city's infrastructure improvements for the next five years. The document reflects the best estimate of the project costs at the time of preparation. There were no questions or comments from the public. Motion was made by Wheeler, seconded by Volk, to close the public hearing. Roll call was taken on the motion. Ayes -- Volk, Wheeler, Anderson, Hellier, Lee City Council Meeting Minutes, October 5, 2020 Page 4 Motion was made by Hellier, seconded by Wheeler, to approve the following: • Resolution No. 20-113 adopting the 2021-2025 Capital Improvement Plan and approving the issuance of General Obligation Capital Improvement Bonds • Resolution No. 20-114 adopting the 2021-2025 Street Reconstruction Plan and approving the issuance of General Obligation Street Reconstruction Bonds • Resolution No. 20-115 declaring the official intent of the City of Lakeville to reimburse certain expenditures from bond proceeds Roll call was taken on the motion.
