The Pledge of Allegiance to the flag was given. Approval of the Meeting Minutes The September 17, 2020 Planning Commission meeting minutes were approved as presented. 4. Announcements The following items were distributed to the Planning Commission at tonight’s meeting: 1. Agenda Item 5: Revised plans for the Century Middle School pool 2. Agenda Item 8: For Christina Huddleston Elementary, a short memo describing the trip generation and access volumes to the site 5. Century Middle School (Tabled at the September 3, 2020 meeting) Chair Kaluza opened the public hearing to consider the application of Independent School District 194 for an amendment to Conditional Use Permit #98-13 to allow a pool addition to Century Middle School in the RS-2, Single Family Residential District, located at 18610 Ipava Avenue. Beth Louden, from ISD 194 introduced Stephen Bellairs, from the DLR Group who presented an overview of their request. Mr. Bellairs stated that Century Middle School would not hold school and pool events at the same time due to the lack of parking if both were in use simultaneously. The exterior finishes will match the current facility. Planning & Zoning Specialist Monica Croatt presented the planning report. Ms. Croatt stated that ISD 194 is requesting an amendment to CUP #98-13 to allow an expansion to Century Middle School for the construction of a 25-yard lap pool and a diving well along with seating capacity for 500 people and additional restrooms and storage facilities on the west side of the existing building. Planning Commission Meeting Minutes, October 1, 2020 Page 2 Ms. Croatt reviewed conformance with Zoning Ordinance performance standards for the RS-2 Single Family Residential District, which include setbacks, building height screening, access and circulation of the site, parking, mechanical equipment, building elevations, exterior building materials, landscaping and lighting. Planning Department staff recommends approval of the Century Middle School CUP amendment, subject to the eight stipulations listed in the September 25, 2020 planning report, and adoption of the Findings of Fact dated October 1, 2020. Chair Kaluza opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Majorowicz seconded by Lillehei to close the public hearing at 6:09 p.m. Voice vote was taken on the motion. Ayes - unanimous Chair Kaluza asked for comments from the Planning Commission. Discussion points included: • Bus circulation and bus ingress and egress points. • Confirmed that the applicant received a grading permit prior to receiving approval from Planning Commission and City Council for the work currently taking place. Mitchell Cookas, from Kimley Horn on behalf of ISD 194 also indicated that they had gotten approval from Engineering to start on the watermain and stormwater basin. • With school not in session, a traffic study had not been done. • The Planning Commission stressed that there will not be sufficient parking to hold swimming events while school is in session during the day. • The Planning Commission wanted the school district to consider re-striping the parking lot where the buses park to make parking for cars easier during after school events. • The school district and the City work very well together, but the Planning Commission felt this proposal was rushed through and communication could have been better. • Better signage should be considered for the parking lot. • Commended the school district for bringing the pool to fruition. Beth Louden indicated she will bring back the Planning Commission’s suggestions to the school district. She stated the school district was rushing this request because they wanted to get the pool construction completed this fall. Motion was made by Drotning, seconded by Witte to recommend to City Council approval of the amendment to Conditional Use Permit #98-13 to allow a pool addition to Century Middle School in the RS-2, Single Family Residential District, located at 18610 Ipava Avenue, and adoption of the Findings of Fact dated October 1, 2020, subject to the following stipulations: Planning Commission Meeting Minutes, October 1, 2020 Page 3 1. The site improvements and building addition shall be developed in accordance with the plans approved by the City Council. 2. A building permit is required prior to commencing construction of the building addition. 3. The proposed building addition shall be sided with materials to match the existing building color. All building materials shall meet the requirements for an institutional use in the RS-2 District. 4. The building addition is subject to review by the Fire Marshal. 5. The mechanical equipment shall be screened in compliance with Zoning Ordinance requirements. 6. Lighting shall be down-cast type only and must comply with Section 11-16-17 of the Zoning Ordinance. 7. The school district shall not hold swim meets during school instructional hours in order to meet Zoning Ordinance parking requirements. 8. The recommendations listed in the August 28, 2020 engineering report. Ayes: Swenson, Majorowicz, Lillehei, Kaluza, Witte, Zimmer, Drotning Nays: 0 6. Eastview Elementary School Chair Kaluza opened the public hearing to consider the application of Independent School District #194 for an amendment to Conditional Use Permit #95-14 to allow a building addition to Eastview Elementary School in the RS-2, Single Family Residential District, located at 18060 Ipava Avenue. Stephen Bellairs from the DLR Group presented a brief overview of this project. He stated that the first floor will be built as a tornado shelter. This addition will be in the southeast corner of the existing building. The parking spaces will meet the Zoning Ordinance requirements. Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated that ISD 194 is requesting an amendment to CUP #95-14 to allow an 8,400 square foot two-story building addition to Eastview Elementary School that would include four classrooms, two group rooms and shared learning commons, along with additional lockers and restrooms. Ms. Jenson commented that she received two e-mails from residents asking about drainage. A stormwater pond will be added to the south to help with the drainage issues. Ms. Jenson reviewed conformance with Zoning Ordinance performance standards for the RS-2, Single Family Residential District, which include setbacks, building height, screening, access and circulation, parking, the reconfiguration of the internal sidewalks, building elevations and exterior building materials, and a site encroachment of an adjacent residential property. Planning Commission Meeting Minutes, October 1, 2020 Page 4 Planning Department staff recommends approval of the Eastview Elementary School CUP amendment, subject to the four stipulations listed in the September 23, 2020 planning report and adoption of the Findings of Fact dated October 1, 2020. Motion was made by Drotning seconded by Lillehei to close the public hearing at 6:46 p.m. Voice vote was taken on the motion. Discussion points included: • The area proposed for the building addition is a grass area that is not active play space. • Commissioner Swenson indicated his appreciation for the stormwater basins being put in to help the neighboring properties. Motion was made by Lillehei, seconded by Majorowicz to recommend to City Council approval of the application of Independent School District 194 for an amendment to Conditional Use Permit #95-14 to allow a building addition to Eastview Elementary School in the RS-2, Single Family Residential District, located at 18060 Ipava Avenue, and adoption of the Findings of Fact dated October 1, 2020, subject to the following stipulations: 1. The site improvements and building addition shall be developed in accordance with the plans approved by the City Council. 2. The proposed building addition shall be sided with brick to match the existing building. All building materials shall meet the requirements for an institutional use in the RS-2 District. 3. The encroachments onto the school property by an adjacent residential lot shall be removed prior to the issuance of a certificate of occupancy for the building. 4. The Applicant must address all comments relating to the proposed stormwater management for the site improvements prior to issuance of a building permit. The final grading and utility plans must be approved by the City Engineer prior to the issuance of a building permit. Ayes: Majorowicz, Lillehei, Kaluza, Witte, Zimmer, Drotning, Swenson Nays: 0 7. John F. Kennedy Elementary Chair Kaluza opened the public hearing to consider the application of Independent School District #194 for an amendment to Conditional Use Permit #04-03 to allow a Planning Commission Meeting Minutes, October 1, 2020 Page 5 building addition to John F. Kennedy (JFK) Elementary School in the RM-1, Medium Density Residential District, located at 21240 Holyoke Avenue. Stephen Bellairs from the DLR Group presented a brief overview of the proposed amendment. Planning & Zoning Specialist Monica Croatt presented the planning report. Ms. Croatt stated that ISD 194 is requesting an amendment to CUP #04-03 to allow an 8,750 square foot building addition to John F. Kennedy (JFK) Elementary School which would include the construction of four classrooms, two group rooms and shared learning commons, along with additional lockers and restrooms. Ms. Croatt reviewed conformance with Zoning Ordinance performance standards for the RM-1, Medium Density Residential District, which include setbacks, building height, mechanical equipment screening, parking, reconfiguration of the internal sidewalk, building elevations and exterior building materials. Planning Department staff recommends approval of the CUP amendment, subject to the five stipulations listed in the September 25, 2020 planning report, and adoption of the Findings of Fact dated October 1, 2020. Chair Kaluza opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Majorowicz, seconded by Witte to recommend to City Council approval of application of Independent School District 194 for an amendment to Conditional Use Permit #04-03 to allow a building addition to John F. Kennedy (JFK) Elementary School in the RM-1, Medium Density Residential District, located at 21240 Holyoke Avenue and adoption of the Findings of Fact dated October 1, 2020, subject to the following stipulations: 1. The site improvements and building addition shall be developed in accordance with the plans approved by the City Council. 2. The proposed building addition shall be sided with standard brick to match the existing building. All building materials shall meet the requirements for an institutional use in the RM-1 District. Christina Huddleston Elementary Chair Kaluza opened the public hearing to consider the application of Independent School District 194 for a conditional use permit amendment to allow a building addition to Christina Huddleston Elementary School in the RS-2, Single Family Residential District, located at 9569 175th Street. Stephen Bellairs from the DLR Group presented an overview of the project. This addition will be on the west side of the existing building. The number of parking spaces will exceed the Zoning Ordinance requirements. He stated that the exterior finish will match the existing building. Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated that ISD #194 is requesting a conditional use permit amendment to allow a 9,365 square foot expansion to Christina Huddleston Elementary School that would include four classrooms, two group rooms and shared learning commons, along with additional lockers and restrooms. Ms. Jenson reviewed conformance with Zoning Ordinance performance standards for the RS-2, Single Family Residential District, which include setbacks, building height, mechanical equipment screening, access and circulation, parking, internal sidewalks, landscaping, building elevations and exterior building materials, Planning Department staff recommends approval of the CUP amendment, subject to the five stipulations listed in the September 23, 2020 planning report, and adoption of the Findings of Fact dated October 1, 2020. Discussion points included: Planning Commission Meeting Minutes, October 1, 2020 Page 7 • The Planning Commission appreciated seeing the traffic analysis. It was very helpful and will make a difference for this area. They liked that the eastern entrance on 175th Street will be removed. Motion was made by Witte, seconded by Lillehei to recommend to City Council approval of the Independent School District 194 conditional use permit amendment to allow a building addition to Christina Huddleston Elementary School in the RS-2, Single Family Residential District, located at 9569 175th Street, and adoption of the Findings of Fact dated October 1, 2020 subject to the following stipulations: 1. The site improvements and building addition shall be developed in accordance with the plans approved by the City Council. 2. The proposed building addition shall be sided with brick to match the existing building. All building materials shall meet the requirements for an institutional use in the RS-2 District. 3. The CMU block used for the trash enclosure and mechanical yard must be a color that is consistent with the brick color of the school building. 4. The applicant must address all comments relating to the proposed stormwater management for the site improvements prior to issuance of a building permit. The final grading and utility plans must be approved by the City Engineer prior to the issuance of a building permit. 5. The applicant must submit to the City Engineer a narrative detailing the proposed traffic patterns and circulation changes for the site and any improvements to 175th Street (signing, striping, etc.) must be reviewed and identified prior to the issuance of a building permit. Dennis Prawdzik Chair Kaluza opened the public hearing to consider the application of Dennis Prawdzik for a conditional use permit to allow the construction of a detached accessory building exceeding the maximum combined allowable floor area in the RS-CBD, Single Family Residential-Central Business District, located at 8540 – 208th Street. Dennis Prawdzik presented an overview of his project. Mr. Prawdzik indicated that this proprosed accessory building will be in the southwest rear corner of his lot. He feels it will bring up his property value. He will use it for personal storage. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that Mr. Prawdzik is requesting a conditional use permit to allow him to construct a detached accessory building resulting in a total accessory building area greater than 840 square feet in the RS-CBD, Single Family Residential Central Planning Commission Meeting Minutes, October 1, 2020 Page 8 Business District. The proposed accessory building is 24’ x 32’ totaling 678 square feet. Mr. Dempsey identified the non-conforming conditions, which Mr. Prawdzik will correct prior to issuance of a building permit. The setbacks are in compliance with the minimum setback requirements in the RS- CBD District. The applicant has indicted that the proposed accessory building will be used to store personal related items and yard maintenance equipment. The proposed accessory building will include residential lap composite siding similar in look to the house in compliance with the Zoning Ordinance requirements. Mr. Prawdzik meets the Zoning Ordinance requirements for a conditional use permit to allow total accessory building area in excess of 840 square feet in the RS-CBD District. Planning Department staff recommends approval of the Prawdzik CUP, subject to the eight stipulations listed in the September 25, 2020 planning report, and adoption of the Findings of Fact dated October 1, 2020. Chair Kaluza opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Lillehei, seconded by Drotning to close the public hearing at 7:23 p.m. Voice vote was taken on the motion. Ayes - unanimous Chair Kaluza asked for comments from the Planning Commission. Discussion points included: • Discussed the accessory building backing up to 209th Street and confirmed that there would be no access to the garage from 209th Street. • Confirmed that only one shed is allowed on the property and the two sheds currently on the property will be removed prior to the start of construction of the proposed accessory building. Motion was made by Zimmer, seconded by Witte to recommend to City Council approval of the Dennis Prawdzik conditional use permit to allow the construction of a detached accessory building exceeding the maximum combined allowable floor area in the RS-CBD, Single Family Residential-Central Business District, located at 8540 – 208th Street, and adoption of the Findings of Fact dated October 1, 2020, subject to the following stipulations: 1. The detached accessory building shall be constructed in the location identified on the certificate of survey prepared by Jacobson Engineers and Surveyors dated June 7, 2019. The detached accessory building shall be constructed with the materials noted on the approved conditional use permit plans including residential composite lap or similar siding consistent with the house. 3. The detached accessory building shall be kept, used and maintained in a manner that is compatible with the existing single family home on the property and shall not present a hazard to the public health, safety and general welfare. 4. No door opening in the accessory building shall be wider than eight feet unless a paved driveway is installed between the driveway of the attached garage to the accessory building. 5. Sanitary sewer service shall not be provided to the detached accessory building and the detached accessory building shall not be used as a dwelling. 6. No home occupation or other commercial use shall occur in any accessory building on the property including no storage of commercial equipment or third-party materials or equipment. 7. The two existing detached accessory buildings shall be removed from the property before issuance of a building permit. 8. The rear of the property adjacent to Holiday Avenue shall be cleaned of the soil piles and the discarded sign posts with concrete footings. ETS Elite South Metro Chair Kaluza opened the public hearing to consider the application of ETS Elite South Metro for a conditional use permit to allow an indoor commercial recreation facility in the I-1, Light Industrial District, located at 21017 Heron Way. Chuck Morning, Director of Operations presented an overview of the project. He indicated that they work with all kinds of athletes from the south metro area and they need more space. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that ETS Elite South Metro is an athletic training facility and is requesting a CUP in order to move from their existing 3,000 square foot location at 21021 Heron Way to a larger, 6,000 square foot space on a separate adjacent property located at 21017 Heron Way. A new CUP is required since the use will be located on a separate property than their previous CUP. Mr. Dempsey reviewed the five criteria of the Zoning Ordinance that allows commercial recreation facilities in the I-1 District, which are listed in detail in the September 25, 2020 planning report. Planning Department staff recommends approval of the ETS Elite South Metro CUP, subject to the three stipulations listed in the September 25, 2020 planning report, and adoption of the Findings of Fact dated October 1, 2020. Discussion points included: • Commissioner Zimmer liked the idea of the garage doors in the back of the establishment. • Commissioner Witte and Swenson commented that it was great to see businesses like this come to Lakeville and succeed and grow. Motion was made by Witte, seconded by Majorowicz to recommend to City Council approval of the ETS Elite South Metro conditional use permit to allow an indoor commercial recreation facility in the I-1, Limited Industrial District, located at 21017 Heron Way, and adoption of the Findings of Fact dated October 1, 2020, subject to the following stipulations: 1. A sign permit must be issued by the City prior to the installation of any signs. 2. No H (Hazardous) Occupancy tenants are allowed in the multiple tenant industrial building as long as the commercial recreation use is a tenant in the same building. 3. If any future tenants of the building being jointly occupied by this commercial recreation use require Material Data Safety Sheets (MSDS), the building owner shall notify the City and provide the City with copies of the MSDS documents. Ayes: Zimmer, Drotning, Swenson, Majorowicz, Lillehei, Kaluza, Witte Nays: 0 11. Gala Farms Brewing Chair Kaluza opened the public hearing to consider the application of Beth Halstenson, AIA, Shelter Architects for the following, located south of 210th Street and west of Heron Way: 1. Zoning Ordinance amendment to allow brewpubs as a conditional use within the I-1, Light Industrial District; 2. Conditional use permit to allow the construction of a brewpub within the I-1 District; and 3. Conditional use permit to allow an exception to the exterior building material requirements within the I-1 District. Glen Perkins presented an overview of the project. Mr. Perkins wants to appeal to families, and not just open a beer drinking establishment. He always envisioned a brewery with a full service restaurant. Planning Consultant Daniel Licht presented the planning report. Mr. Licht stated that Gala Farms Brewing is requesting a Zoning Ordinance amendment to allow brewpubs as a conditional use within the I-1, Light Industrial District. The applicant is also Planning Commission Meeting Minutes, October 1, 2020 Page 11 requesting a conditional use permit for development of a brewpub on the subject site, and to allow exception for the required exterior finish for principal buildings within the I-1 District. Mr. Licht reviewed the Planning Commission work session discussions and the developer pursuing a text amendment to allow for brewpubs as a conditional use within the I-1 District. He also reviewed the seven conditions that would allow brewpubs as a conditional use within the I-1 District, which are listed in the September 23, 2020 planning report. With the appropriate performance standards established, a brewpub can be developed to compatibly exist consistent with the intent of the I-1 District. Mr. Licht also reviewed the building design plans that were submitted. He indicated that the developer has requested allowance of the proposed standing seem metal siding and anodized aluminum finished metal panels as an exception to the exterior finish requirements of the I-1 District by CUP as provided by the Zoning Ordinance by demonstrating quality, compatibility, and not being based solely on economic considerations. A landscape plan has been submitted. The types of plantings are subject to review and approval by the City Forester, but the sizes comply with the Zoning Ordinance requirements. Mr. Licht indicated that the landscape plan must be revised to comply with the Zoning Ordinance and specify the tree centers along Lakeville Boulevard are to be setback a minimum of 10 feet from the property line. Mr. Licht stated that the proposed principal building and off-street parking areas comply with the setback requirements established by the Zoning Ordinance. Mr. Licht reviewed access to the site, which will include two driveways to Lakeville Boulevard, off-street parking, which complies with the Zoning Ordinance, exterior lighting, and the trash and recycling enclosure. Planning Department staff recommends approval of the Gala Farms Brewing Zoning Ordinance amendment and CUP, subject to the 13 stipulations listed in the September 23, 2020 planning report, and adoption of the Findings of Fact dated October 1, 2020. Chair Kaluza opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Lillehei, seconded by Drotning to close the public hearing at 7:54 p.m. Voice vote was taken on the motion. Discussion points included: Planning Commission Meeting Minutes, October 1, 2020 Page 12 • The Planning Commission appreciated that a work session was held so they could look at Mr. Perkins’ proposal and could discuss it and come up with a good option. They thanked the applicant for working closely with City staff on his proposed building. They look forward to seeing this business in Lakeville. Motion was made by Witte, seconded by Drotning to recommend to City Council approval of a Zoning Ordinance amendment to allow brewpubs as a conditional use within the I-1, Light Industrial District; Conditional use permit to allow the construction of a brewpub within the I-1 District; and Conditional use permit to allow an exception to the exterior building material requirements within the I-1 District, located south of 210th Street and west of Heron Way, and adoption of the Findings of Facts dated October 1, 2020, subject to the following stipulations: 1. The site and principal building shall be developed in accordance with the plans on file with the City except as modified herein or approved by City staff. 2. The hours of operation for the use shall be between 7:00 A.M. and 10:00 P.M., unless extended by the City Council. 3. The developer shall provide a maintenance plan for the proposed exterior materials used for the principal building. 4. Landscape plan: a. The types of plantings shown on the landscape plan are subject to review and approval of the City Forester. b. The landscape plan shall be revised to specify the tree centers along Lakeville Boulevard are to be setback a minimum of 10 feet from the property line. c. The developer shall provide a guarantee that all of the plantings on the landscape plan be alive, in good health, of good quality and structural condition, and insect and disease free one year after the date of planting. 5. The site plan must be revised to illustrate the setbacks required within the I-1 District applicable to the subject site specified in Section 11-86-13 of the Zoning Ordinance. 6. The location of the west access to Lakeville Boulevard shall be subject to review and approval of the City Engineer. 7. The design and construction of the off-street parking area shall be subject to review and approval of the City Engineer. 8. The developer shall demonstrate that the use of the loading area will not affect the functionality of the subject site or the Main Street Automotive site across the shared access drive. 9. Signs upon the property shall comply with Section 11-23-17.D.1 of the Zoning Ordinance. A sign permit approved by the City is required prior to the installation of any signs on site. 10. All exterior lighting fixtures shall use a 90-degree horizontal shield and shall be limited to 35 feet in height. 11. All grading, drainage and erosion control issues shall be subject to review and approval by the City Engineer. 12. All utility issues shall be subject to review and approval of the City Engineer. 13. The developer shall execute a Site Improvement Performance Agreement (SIPA) is to be drafted by the City Attorney and subject to review and approval by City staff.
