Olson, Community & Economic Development Director Copy: Kati Bachmayer, Economic Development Coordinator Date: October 27, 2020 Subject: Review of Restaurant Temporary Patio Policy and Current Patio Ordinance The EDC discussed the Temporary Patio Policy and the current Outdoor Patio Ordinance for restaurants that also have a liquor license. Attached is the Temporary Patio Policy approved by the City Council in May. This temporary policy is scheduled to terminate on December 31, 2020. The City Council will need to approve a new policy for 2021. Recommendations and Input from the EDC would be helpful to the City Council as they consider an extension of the current policy or a revised policy for 2021. Staff has also attached a copy of the current Outdoor Patio Ordinance for restaurants that are licensed to serve liquor. This ordinance has been in place since 2008 and has been amended a couple of times primarily to address SAC charges and hours of operation. The City ordinance complies with MN Statutes that require that patios for restaurants that serve liquor be “compact and contiguous.” In the opinion of staff, these are two separate but related issues with the Temporary Patio Policy being the most urgent. Comments and suggestions from the EDC regarding the provisions of the current Temporary Patio Policy that should be changed or modified for 2021 would assist the City Council as they consider the next Temporary Patio Policy. If the EDC has comments or suggestions for the current Outdoor Patio Ordinance, that information can also be forwarded to the City Council for their consideration. Action Requested: Provide comments and/or recommendations to the City Council on the Temporary Patio Policy that is scheduled to terminate on 12/31/2020 as well as any comments on the current Patio Ordinance.
