HomeMy WebLinkAboutItem 07 Date: November 16, 2020 Item No. HIGHVIEW AVENUE IMPROVEMENTS RESOLUTION ORDERING IMPROVEMENTS AND PREPARATION OF PLANS Proposed Action Staff recommends adoption of the following motion: Move to approve a resolution ordering the improvements and authorizing the preparation of plans and specifications for Highview Avenue Improvements, City Project 21-03. Overview The Highview Avenue Improvements project is partially funded with property tax levies, of which a portion is financed through assessments to benefitting property owners. Pursuant to the requirements of Minnesota Statues, Chapter 429 for local improvements, two public hearings are required. The City Council approved the Feasibility Report for Highview Avenue Improvements and scheduled the first public hearing (improvement hearing) for November 16, 2020 at its October 19, 2020 meeting. Prior to the public hearing, City staff will share a presentation providing a project summary, estimated project cost, description of the proposed assessment area, estimate of the amount to be assessed and explanation of the City’s adopted Assessment Policy. Primary Issues to Consider • A 4/5th vote of the City Council is required to adopt a resolution ordering the improvement. • Notice of the public hearing was published October 30, 2020 and November 6, 2020 in the official newspaper and mailed to property owners in the proposed assessment area on October 27, 2020, pursuant to the requirements of Minnesota Statues, Chapter 429 for local improvements. The project will include the portion of Highview Avenue between 175th Street and County State Aid Highway (CSAH) 46 (160th Street), City Project 21-03; and WHEREAS, the required published notices of hearing through a weekly publication were given, the required mailed notice of the improvement hearing was given to each property owner in the proposed assessment area at least ten days prior to the hearing, and the hearing was held on November 16, 2020, at which time all persons desiring to be heard were given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lakeville: 1. The Highview Avenue Improvements are hereby ordered as identified in the Feasibility Report for City Project 21-03, dated October 19, 2020. 2. The City expects to issue bonds for the project costs. 3. The estimated project costs are $2,213,649 and anticipated funding sources are listed below. City staff is hereby authorized to make the appropriate transfers between funds with respect to the non-debt project funding sources up to 10% above the estimated costs. Funding transfers may include loans between funds to cover engineering and other costs incurred on the project in advance of receiving bond proceeds. 4. City staff is hereby authorized to prepare plans and specifications for the making of such improvements.
