OVERVIEW Jack Matasosky has submitted preliminary and final plat and easement vacation applications and plans for Airlake Development Eighth Addition, which proposes one lot on a 3.56 acre, I-2, General Industrial District zoned parcel. The property is located south of and abutting 215th Street (CSAH 70) and west of Hamburg Avenue. The property is currently combined as part of the Performance Office Papers property. Performance Office Papers purchased the property and received City Council approval of a setback variance in 2008 in anticipation of an expansion to their building. The building addition was not constructed, and the variance has since expired. A specific industrial user for the proposed Lot 1, Block 1, Airlake Development Eighth Addition has not yet been identified. Development of the site will require administrative approval of a site plan application and plans prior to issuance of a building permit. The City Council will consider the approval of the final plat following recommendation from the Planning Commission on the preliminary plat and easement vacation. The property included in the preliminary and final plat is currently combined with the property that includes the Performance Office Papers building. Performance Office Papers purchased and combined the east 3.56 acres of the Acorn Tappe property and received City Council approval of a setback variance in 2008 in anticipation of an expansion to the Performance Office Papers building. The property was preliminary graded as part of the Acorn Tappe First Addition final plat approval in 2001. One of the Acorn Tappe First Addition parcels to the west was developed in 2014, the other remains undeveloped. All three properties will share a driveway onto 215th Street. The property is zoned I-2, General Industrial District. The 3.56 acre west portion of the existing Performance Office Papers property will be administratively subdivided and then preliminary and final platted as Airlake Development Eighth Addition. The administrative subdivision is necessary to divide the property from the parent parcel before it is preliminary and final platted. The preliminary and final plat are required since the parent Acorn Tappe parcel is being subdivided for the third time. The Subdivision Ordinance requires a that more than one subdivision of property be preliminary and final platted. a. Comprehensive Plan. The property is located in Planning District No. 6 of the 2040 Comprehensive Land Use Plan. The property is in the current Metropolitan Urban Service Area (MUSA) which means that City municipal services, including sanitary sewer, are available to the property. The property is guided Industrial according to the current plan. The proposed Airlake Development Eighth Addition preliminary plat meets the recommended goals and objectives of the Comprehensive Plan. b. Existing Site Conditions. The westerly third of the existing Performance Office Papers property, originally platted as Lot 1, Block 1, Acorn Tappe Addition, is currently undeveloped and is combined with the original Performance Office Papers property, platted as Lot 1, Block 1, Airlake Industrial Park 1st Addition. c. Lot/Block/Outlot. The proposed Lot 1, Block 1, Airlake Development Eighth Addition exceeds the minimum lot area and lot width requirements for the I-2, General Industrial District. The following is a tabulation of the lot as noted on the preliminary and final plat plans. The preliminary and final plat of Airlake Development Eighth Addition will not require the construction of any streets. Access will be from the existing shared driveway at 215th Street, which also serves the two lots to the west. The current construction project for road improvements to 215th Street will result in a right-in, right-out only access for the three lots. 4 e. Grading, Drainage, Erosion Control and Utilities. The area of the proposed preliminary and final plat was preliminary grading in 2001 as part of the Acorn Tappe final plat. City sanitary sewer and water is available to the site, which is within the current MUSA. All public utilities to serve the property were already been installed with the Acorn Tappe project. Plans for further grading, drainage, erosion control and connection to public utilities will be reviewed separately at the time a site plan application is submitted for a specific building project on the lot. This process is similar to that followed with the recently developed Airlake Development Seventh Addition on Lakeville Boulevard, east of Hamburg Avenue. f. Wetlands. There are no wetlands within the boundaries of the Airlake Development Eighth Addition preliminary and final plat. g. Tree Preservation. There are no significant trees within the boundaries of the Airlake Development Eighth Addition preliminary and final plat. h. Park Dedication, Trails and Sidewalks. The City’s Comprehensive Parks, Trails, and Open Space Plan does not identify future park needs in the area of the plat. Cash payment in lieu of park land dedication was paid for the subject property as part of the Acorn Tappe final plat approval in 2001. A bituminous trail will be constructed on the south side of 215th Street as part of the current road improvement project. The Parks and Recreation Department reviewed the plans. The Parks, Recreation and Natural Resources Committee did not review the preliminary plat since there is no park land or cash fee dedication or grading and erosion control plan required as part of the Airlake Development Eighth Addition preliminary and final plat. i. Dakota County Plat Commission. The Dakota County Plat Commission reviewed the preliminary plat at their October 28, 2020 meeting under the provisions of the Dakota County Contiguous Plat Ordinance for access and County Road right-of-way needs. The Plat Commission determined that the preliminary plat design met the requirements for access and road right-of-way as noted in their November 2, 2020 letter. EASEMENT VACATION The drainage and utility easements within Acorn Tappe First Addition portion of the final plat will be vacated and will be reestablished with the Airlake Development Eighth Addition final plat. All utility companies that service the area were notified by the public hearing notice. No comments were received in opposition to the easement vacation. As shown on the easement vacation sketch (Exhibit E), Performance Office Papers will re-establish a 15 foot wide drainage 5 and utility easement along their new west property line that was vacated as part of the Performance Office Papers variance approved in 2008. RECOMMENDATION Planning Department staff recommends approval of the Airlake Development Eighth Addition preliminary and final plat and easement vacation subject to the following stipulations: 1. A permanent private driveway access easement between Lot 1, Block 1, Airlake Development 8th Addition and the existing 215th Street driveway access to the west shall be established prior to submittal of a site plan for Lot 1. 2. Prior to approval of the Airlake Development 8th Addition easement vacation, Performance Office Papers shall re-establish the drainage and utility easement along their west property line that was vacated as part of the Performance Office Papers variance in 2008. 3. The plat is adjacent to CSAH 70 (215th St. W.) and is therefore subject to the Dakota County Contiguous Plat Ordinance. The site includes one lot with one access to CSAH 70 through the property to the west. Restricted access shown be shown along all of CSAH 70 per the plat of ACORN TAPPE 1ST ADDITION. The existing right of way meets the needs of 75 feet of half right of way. The Plat Commission has approved the preliminary and final plat and will recommend approval to the County Board of Commissioners. Traffic volumes on CSAH 70 are 9,700 ADT and are anticipated to be 15,000 ADT by the year 2030. No work shall commence in the County right of way until a permit is obtained from the County Transportation Department and no permit will be issued until the plat has been filed with the County Recorder’s Office. The Plat Commission does not review or approve the actual engineering design of proposed accesses or other improvements to be made in the right of way. Nothing herein is intended to restrict or limit Dakota County’s rights with regards to Dakota County rights of way or property.
