PARTIAL RELEASE OF DEVELOPMENT CONTRACT
OUTLOT E, ARGONNE ESTATES
Proposed Action
Staff recommends adoption of the following motion: Move to approve the release of
development contract recorded against Outlot E, Argonne Estates.
Overview
The Arris Apartments developer has requested the release of Outlot E from the Argonne Estates
development contract recorded in 2005. Outlot E makes up a portion of the property included in
the Arris Apartments plat approved by the City Council at the December 7, 2020 meeting. All
requirements pertaining to Outlot E, Argonne Estates have been met and the outlot can be
released from the development contract in accordance with the attached Partial Release of
Development Contract prepared by the City Attorney’s office.

PARTIAL RELEASE OF DEVELOPMENT CONTRACT granted this ______ day
of _________________, 2020, by the CITY OF LAKEVILLE, a Minnesota municipal corporation
(“City”).
Recitals
WHEREAS, the City and D.R. Horton, Inc. - Minnesota, a Delaware corporation, entered into
a Development Contract for the plat of Argonne Estates, dated July 18, 2005 and filed for record with
the Dakota County Registrar of Titles on October 31, 2005 as Torrens Document No. 578088
(“Development Contract”).
WHEREAS, the City has been requested to release and discharge:
Outlot E, Argonne Estates, Dakota County, Minnesota,
(“Subject Property”) from the Development Contract.
WHEREAS, all requirements of the Development Contract have been met as to the Subject
Property and there is no longer a need to have the Development Contract recorded against the Subject
Property.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
The Subject Property is hereby released and discharged from the Development Contract.
