RESOLUTION REQUESTING STATE APPROPRIATIONS
FOR ORCHARD LAKE IMPROVEMENTS
Proposed Action
Staff recommends adoption of the following motion: Move to approve a resolution requesting state
appropriations for Orchard Lake Improvements and authorizing the City Engineer to apply for
funding to the Minnesota Department of Natural Resources.
Overview
The 2020 5th Special Session of the Minnesota Legislature included passing of a capital investments
(bonding) bill. The bonding bill allocates $260,000 to the City of Lakeville to reduce erosion and
improve the water quality of Orchard Lake. The funding is provided in the form of a Minnesota
Department of Natural Resources (MnDNR) grant and is subject to the requirements of Minnesota
Statutes. Prior to applying for the grant, the City must make an official request for the funds.
Primary Issues to Consider
• Following approval of the City’s application, City and MnDNR staff will prepare a Grant
Agreement with the State of Minnesota that will provide the terms, conditions and
provisions for disbursing the funds. The Grant Agreement will be placed on a future
meeting agenda for City Council consideration.

RESOLUTION NO. 21-
RESOLUTION FOR STATE APPROPRIATIONS FOR ORCHARD LAKE IMPROVEMENTS
WHEREAS, the State of Minnesota requires that the City provide an official request for
appropriations, and that the City of Lakeville will act as the lead agency for the Orchard Lake
Improvements project.
BE IT RESOLVED, that the City of Lakeville, hereinafter referred to as the “Applicant”, act as legal
sponsor for the Orchard Lake Improvement project and that the City Engineer is hereby
authorized to apply to the Department of Natural Resources for funding of this project on behalf
of the Applicant; and
BE IT FURTHER RESOLVED, that the Applicant has the legal authority to apply for financial
assistance, and the institutional, administrative, and managerial capability to ensure adequate
acquisition, maintenance and protection of the proposed project; and
BE IT FURTHER RESOLVED, that the Applicant hereby pledges to complete the project if it
exceeds the total funding provided by the State and any other funding sources; and
BE IT FURTHER RESOLVED, that the Applicant has not incurred any costs, and has not entered
into any written agreements to purchase property proposed by this project; and
BE IT FURTHER RESOLVED, that the Applicant has not violated any Federal, State, or local laws
pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or
corrupt practice; and
BE IT FURTHER RESOLVED, that upon approval of its application by the state, the Applicant
may enter into an agreement with the State of Minnesota for the above-referenced project, and
that the Applicant certifies that it will comply with all applicable laws and regulations as stated in
the contract agreement; and
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are hereby authorized
to execute such agreements as are necessary to implement the project on behalf of the Applicant.
