ZONING ORDINANCE, BY AMENDING SECTIONS 2.2, 36.4, 38.4-AND 42.4 TO ALLOW ANIMAL KENNELS AS A CONDITIONAL USE IN THE 8-2, B-4, CBD-C, I-1 AND I-2 ZONING DISTRICTS. THE CITY COUNCIL OF THE CITY OF LAKEVILLE DOES HEREBY ORDAIN: Section 1. Section 2.2 is hereby amended by adding the following.. definition: .Animal Kennel. Any place where three (3) or more domestic animals of one type, over six (6) months of age, are commercially. kept, except. .hospitals, clinics, and otherpremises-operated by a licensed veterinar- ian exclusively for the care and. treatment of animals. Section 2. Section 36.4 is hereby :;amended by amending subparagraph number. 3 to read` as follows s 3) Veterinary clinics :provided that: a) All areas in which animals are confined are located .indoors and are properly soundproofed from adjacent properties. b) Animal carcasses are ~irope~ly disposed of in a manner not. utilizing on-site garbage facili ies or incineration and..: the carcasses are properly refrigerated during 'periods -prior-to disposal. c) An animal kennel: is permitted as a use accessory to the veterinary ,clinic provided that: 1. The number of animals boarded shall not exceed: 20. 2. An indoor exercise area. shall be provided to accomodate -the periodic_exercisng of animals boarded at the kennel. No :outdoor exercising of animals shah be permitted. 3: A ventilation system shall be designed so that no odors or organisms will spread between wards or to the outside air and will be capable of completely exchang- ing internal~air at a rate of at least twice per hour. Air tempera ure must be maintained between 60 and 75 degrees Fahrenheit. 4. A room separate from the kennel area. shall be provided. of sufficient. size to. adequately. separate animals that. are sick or injured from healthy-animals. S. Indoor animal kennel floors and walls shall be made of non-porous materials 'or sealed concrete tomake it non-porous. 6. Animal.'wastes shall be flushed down an existing sanitary sewer system or enclosed in a container of sufficient construction'to eliminate odors and organ- ,isms and shall be properly disposed of at`least oncea day. 7. Control Agency requirements for such facilities are met. d) The provisions of Section 4.2(5) of this Ordinance are considered and satisfactorily met. Section 3. Section 42.4 is .hereby amended by adding subparagraph number 2 to read as follows: 2) Animal kennels provided thatc a) The animal kennel shall be .located in a free-standing building. b) The animal kennel shall be ;located on a lot at Zeast two acres in size. c) 'An exercise. area at least 100 square feet in size shall be grovded to accomodate the periodic exercising: of animals .boarded at the kennel. d) If an outdoor exercise area is provided., it shall be at least 150 square feet in size and shall be restricted to the exercising of one ..animal, on leash, .under the control. ~ of a handler, per exercise`area,_ at a time. 3 e) Outdoor exercise areas shall be fenced, not less than six feet in height with an additional at ..leash-two foot security arm with an'internal orientation set at a 30 degree angle, and shall be of sufficient strength to retain kenneled animals. Said fence 'shall be located in-a side or rear yard and shallprovide a complete visual. screen from surrounding .properties in compliance with Section 9.7 of this Ordinance. Said 'fence shall be set back at least 100 feet from any side or rear property line. f) Outdoor..exercise areas must be cleaned at east once a day to prevent-the accumulation of animal"wastes and the spread of disease. g) A ventilation system shall be designed so that no odors or organisms .will spread between wards or to the outside air and will be capable of completely exchanging internal air at-a rate of at least twice per hour. Section 42.4 is hereby amended by adding subparagraph num- ber 2 to read as follows: 2) Animal kennels provided that: a) The animal kennel shall be located in a free-standing building. b) The animal kennel shall be located on a lot at least two acres in size. c) An exercise area of at least 100 square feet in size shall be provided to accommodate the periodic exercising of animals boarded at the kennel. d) If an outdoor exercise area is provided, it shall be at least 150 square feet in size and shall be restricted to the exercising of one animal, on leash, under the control of a handler, per exercise area, at a time. e) Outdoor exercise areas shall be fenced, not less than six feet in height with an additional at least two foot security arm with an internal orientation set at a 30 degree angle, and shall be of sufficient strength to retain kenneled animals. Said fence shall be located in a side or rear yard and shall provide a complete visual screen from surrounding properties in compliance with Section 9.7 of this Ordinance.
